140, Eliminate side yard setback re, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Mr. Arthur Hadley Lot 57-E-MS ZONING CASE NO. 140 FINDINGS AND REPORT The application of Mr. Arthur Hadley, Lot 57-E-MS, Miscel- laneous Tract, for a conditional use permit under Article III, Section 3.07, Side Yard Requirements, Ordinance No. 33 came on for hearing on the 15th day of April 1975 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. David Perrin, is the owner of that certain real property described as Lot 57-E-MS, Miscellaneous Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connectionwith said appli- cation was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II . The Commission further finds that no person appeared at said public hearing in opposition to the application, and that no comment, written or oral, had been received in favor of or opposition to the request. III. The Commission further finds that the applicant requests the conditional use permit for construction of a detached garage in the side yard of his property to replace an existing non -conforming building in the side yard. The applicant stated that location is limited by an existing corral which would have to be removed if the proposed garage were located in the rear yard, and the location was chosen to take advantage of existing paving and grading. The Com- mission finds that a conditional tt.se permit should be granted in order to preserve substantial property rights possessed by other property in the same vicinity and zone, subject to certain conditions. IV. From the foregoing it is concluded that a conditional use permit should_be_ granted _under_ Article_._III,_ Section 3.07,_ Side Yard Requirements, Ordinance No. 33 to Mr. Arthur Hadley, Lot 57-E-MS, for construction of a detached three car garage in the side yard subject to the condition that the structure at no time be converted to other purposes, including a guest house, and further, that the owner submit a letter stating that the non -conforming building would be removed prior to occupation of the new building, and it is, therefore, so ordered.
