RESOLUTION NO. 22
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS CONDITIONALLY APPROVING ZONING CASE NO. 274
A ZONE VARIANCE
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS HEREBY
RESOLVES AND ORDERS AS FOLLOWS:
SECTION 1: A public hearing to consider the proposed Zone
Variance with respect to real property described in Exhibit "A" of
Zoning Case No. 274. attached hereto was duly held on April 27, 1982
in the Council Chambers of the City Hall, 2 Portuguese Bend Road,
Rolling Hills, California. Notice of the time, date, place and purpose
of the aforesaid hearing was duly given.
SECTION 2: Evidence, both written and oral, was duly presented
toand considered by the Planning Commission at the aforesaid public
hearing. Applicant in Zoning Case No. 274 appeared at the public hearing.
SECTION 3: The Planning Commission finds, pursuant to Section
17.32.060 of the Rolling Hills Municipal Code, that:
1. The Commission visited the subject property on May 4, 1982.
2. The Commission found that the subject property was developed
in such a way as to screen the proposed residence addition from street
view.
3. The Commission found that the proposed residence addition
was so situated as to be remote from surrounding residences..
4. The Commission found that the proposed encroachment of eaves
into the side yard easement was not necessary to ensure the use and enjoy-
ment of the subject property.
SECTION 4: Based on the foregoing findings the Commission hereby
approves Zoning Case No. 274, a request for modification of the side yard
setback, except that no roof overhang or part of the structure be permit-
ted to encroach into the easement.
1. This Zone Variance shall not be effective for any purpose.
until the owner of the property involved, or his duly authorized repre-
sentative, has filed with the City Clerk of the City of Rolling Hills an
affidavit stating that he is aware of and agrees to comply with all the
conditions of the grant.
2. It is declared to be the intent of the Planning Commission
that if any provision of the Planning Commission that if any provision
of the grant is held or declared to be invalid the grant shall be void
and the privileges granted thereunder shall lapse.
3. It is declared and made a condition of the grant that if any
onditions thereof are violated or if any law, statute or ordinance is
violated, the grant shall be suspended and the privileges granted there-
under, shall lapse, provided that the applicant has been given written
notice to cease such violation and has failed to do so for a period of
thirty (30) days.
4. All requirements of the Zoning Ordinance and of the zone in
which the subject property is located must be complied with unless other-
wise set forth in the grant, or shown otherwise on an approved plan.
5. The property shall be developed and maintained in substantial
conformance with the site plan on file marked Exhibit "A" except as other-
wise provided herein.
SECTION 5: The Secretary shall certify to the adoption of
this resolution and shall transmit copies of the same to the permit
holder and to the City Clerk.
SECTION 6: This action shall become final and effective twenty
(20) days after the adoption of this resolution unless within such time
an appeal is filed with the City Clerk in accordance with the provisions
of the Rolling Hills Municipal Code. This Variance shall expire unless
used within one year from the date of grant.
