FINDINGS AND REPORT
The application of Mr. Marvin Malmuth, Lot 93-RH, Rolling
Hills Tract, for a variance of front yard requirements under Article
III, Section 3.06 of Ordinance No. 33 for construction of servants'
quarters in the front yard came on for hearing on the 17th day of
April, 1979 in the Council Chambers of the Administration Building,
2 Portuguese Bend Road, Rolling Hills, California, and the applicant,
having submitted evidence in support of the application, the Planning
Commission, being advised, now makes its Findings and Report as re-
quired by the Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Marvin Malmuth,
is the owner of that certain real property described as Lot 93-RH,
located at 3 Pine Tree Lane in the City of Rolling Hills, and that
notice of the public hearing in connection with said application was
given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills. The Commission finds that it is the ap-
plicant's intention to provide quarters for a family employed as
domestics on his property, and to gut the existing storage building/
servants' quarters and convert the building to a two car garage. The
Commission finds, further, that because of topographical problems on
the property it would be extremely difficult to locate the building
in a legal location without infringing on the privacy of the main
residence, and extensive grading would be necessary. The Commis-
sion finds that a variance of front yard requirements should be
granted in order to preserve substantial property rights in the same
vicinity and zone, and that the granting of such a variance would not
be materially detrimental to the public welfare, nor injurious to
property in the same vicinity and zone.

The Commission finds that the applicant has requested a
variance of front yard requirements for construction of servants'
quarters in the front yard. The Commission finds that because of
topographical problems on the property it would be extremely difficult
to locate the building in a legal location without infringing on the
privacy of the main residence, and extensive grading would be neces-
sary. The Commission finds further that the proposed location is
removed from adjacent properties and from the road, and the servants'
quarters would be tied to the existing garage by overhead construction
which would be a continuation of the roof line. The Commission finds
that a variance should be granted in order to preserve substantial
property rights in the same vicinity and zone, and that the granting
of such a variance would not be materially detrimental to the public
welfare nor injurious to property in the same vicinity and zone.
III.
From the foregoing it is concluded that a variance should be
granted to Mr. Marvin Malmuth, Lot 93-RH, 3 Pine Tree Lane, for a
guest house in the front yard, subject to the following conditions:
1. That the residential use of the building shown as
servants' quarters on the approved Exhibit "A" be
limited to persons employed on the premises and
their family;
2. That the storage building now used to house servants
be gutted and converted to a garage/storage facility
and permanently maintained as such to the satisfaction
of the City staff;
3. That the floor area of the approved building not ex-
ceed 25% of the floor area of the main residence on
the property;
4. That the stable and feed room shown on the plan
marked Exhibit "A" be removed from the property, and
that approval of Exhibit "A" showing a future stable
located in the front yard does not imply approval of
the stable location,
and it is, therefore, so ordered.

The application of Mr. Marvin Malmuth, Lot 93-RH, Rolling
Hills Tract, for a conditional 11CP permit under Section 3.01 (D),
Paragraph 3 (a) of Ordinance No. U-38 for construction of servants'
quarters come on for hearing on the 5th day of June, 1979 in the
Council Chambers of the Administration Building, 2 Portuguese Bend
Road, Rolling Hills, California, and the applicant, having submitted
evidence in support of the application, the Planning Commission, being
advised, now makes its Findings and Report as required by the Ordi-
nances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Marvin Malmuth,
is the owner of that certain real property described as Lot 93-RH,
located at 3 Pine Tree Lane in the City of Rolling Hills, and that
notice of the public hearing in connection with said application was
given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills. The Commission finds that it is the appli-
cant's intention to provide quarters for a family employed as domestics
on his property. The Commission finds that following approval of a
front yard variance for construction of servants' quarters on April 17,
1979, the Rolling Hills City Council assumed jurisdiction in the
matter, and a hearing on appeal of the Council was held on May 30, 1979
at which the City Council voted to sustain the Planning Commission's
approval on the condition that Mr. Malmuth agree in a written and
recorded covenant that the property will at no time be subdivided,
that the covenant run with the land and that all illegal structures
be removed from the easement.
II.
The Commission finds that the applicant has requested a
conditional use permit in addition to the front yard variance for

construction of the servants' quarters, as required by ordinance.
The Commission finds that a conditional use permit should be granted
in order to preserve substantial property rights in the same vicinity
and zone, and that the granting of such a conditional use permit would
not be materially detrimental to the public welfare nor injurious to
property in the same vicinity and zone.
III.
From the foregoing it is concluded that a conditional use
permit should be granted to Mr. Marvin Malmuth, Lot 93-RH, 3 Pine
Tree Lane, for a guest house, subject to conditions imposed by the
Planning Commission an April 17, 1979, and conditions imposed by the
City Council on May 30, 1979, and it is, therefore, so ordered.
