REOUEST AND RECOMMENDATION
1. It is recommended that the City Council receive and file this report or
provide other direction to staff.
2. The applicant requests a Site Plan Review to construct a 106 square foot
above ground deck.
BACKGROUND
3. The Planning Commission adopted Resolution No. 2007-21, which is attached,
on December 18, 2007 at the regular meeting granting approval in Zoning Case No.
747. The vote was 3-1-1. Commissioner Sommer was absent and Commissioner
DeRoy abstained due to the fact that she did not attend the field trip.
The resolution contains standard findings of fact and standard conditions as well as
a condition that the Planning Commission review any further development on the
property.
4. The applicant is currently remodeling the existing residence and is
proposing to reconstruct and enlarge the existing pool and reconstruct the existing
deck, which would not require discretionary permit. However, pursuant to Section

17.12.190 of the Zoning Code, a raised deck is considered a structure that require
Site Plan Review.
5. The property is zoned RAS-2 and the gross lot area is 2.24 acres. The net lot
area for construction purposes is 78,927 square feet. The lot is located along a bend
on Pine Tree Lane and has a frontage along Pine Tree of over 563 feet.
6 The property was developed in 1985 with a 6,211 square foot residence, 1,033
square foot garage, 588 square foot swimming pool (proposed to be enlarged to 790
sq.ft.), 50 square foot pool equipment area, 3,280 square foot recreation court, 466
square feet covered porches, 1,154 square foot deck and 6,211 square foot basement.
A portion of the basement is out of grade in the rear of the residence where the
structure becomes two-story.
7. The existing residential building pad (outside the setbacks) is 19,153 square
feet and has coverage of 59.3%. The pad will be enlarged by 106 square feet, the size
of the deck and will be 19,259 square feet. The building pad coverage is proposed on
this pad to be 60.1%, not including the covered porches. The stable pad is 1000
square feet and will have coverage of 45.0%.
8. The structural net lot coverage is proposed at 12,482 square feet or 15.8%,
which includes all the structures and the proposed deck (20% permitted); and the total
lot coverage including structures and paved areas is proposed to be 21,614 square feet
or 27.4%, (35% permitted).
9. Currently 62,000 square feet of the lot or 78.5% is disturbed. The proposed deck
will be located on previously graded slope. The 1985 grading plans shows limits of
grading, which includes the area of the deck.
CONCLUSION
10. When reviewing a site plan review application the Planning Commission
considers whether the proposed project is consistent with the City's General Plan;
incorporates environmentally and aesthetically sensitive grading practices; preserves
existing mature vegetation; is compatible and consistent with the scale, massing and
development pattern in the immediate project vicinity; and otherwise preserves and
protects the health, safety and welfare of the citizens of Rolling Hills.
11. Under City's regulations, raised decks (raised 12 inches or more above natural
grade) are considered structures and require Planning Commission review.
12. The lot is irregular in shape with steep slopes and over 580 feet long frontage
along Pine Tree Lane.
13. The project meets the City's development standards, except that the building pad
coverage exceeds the guidelines, and the disturbed area is over 40%. However, both
conditions are pre-existing and will not be affected by the construction of the 106 square
foot raised deck.

14. The lot contains an adequate area in a feasible location to construct a stable and
corral in the future.
OTHER AGENCIES REVIEW
15. The Rolling Hills Community Association Architectural Committee reviewed
and approved the project.

SITE PLAN REVIEW CRITERIA
17.46.010 Purpose.
The site plan review process is established to provide discretionary review of
certain development projects in the City for the purposes of ensuring that the proposed
project is consistent with the City's General Plan; incorporates environmentally and
aesthetically sensitive grading practices; preserves existing mature vegetation; is
compatible and consistent with the scale, massing and development pattern in the
immediate project vicinity; and otherwise preserves and protects the health, safety and
welfare of the citizens of Rolling Hills.
17.46.050 Required findings.
A. The Commission shall be required to make findings in acting to approve,
conditionally approve, or deny a site plan review application.
B. No project which requires site plan review approval shall be approved by
the Commission, or by the City Council on appeal, unless the following findings can be
made:
1. The project complies with and is consistent with the goals
and policies of the general plan and all requirements of the zoning ordinance;
2. The project substantially preserves the natural and
undeveloped state of the lot by minimizing building coverage. Lot coverage
requirements are regarded as maximums, and the actual amount of lot coverage permitted
depends upon the existing buildable area of the lot;
3. The project is harmonious in scale and mass with the site,
the natural terrain and surrounding residences;
4. The project preserves and integrates into the site design, to
the greatest extent possible, existing topographic features of the site, including
surrounding native vegetation, mature trees, drainage courses and land forms (such as
hillsides and knolls);
5. Grading has been designed to follow natural contours of the
site and to minimize the amount of grading required to create the building area;
6. Grading will not modify existing drainage channels nor
redirect drainage flow, unless such flow is redirected into an existing drainage course;
7. The project preserves surrounding native vegetation and
mature trees and supplements these elements with drought -tolerant landscaping which is
compatible with and enhances the rural character of the community, and landscaping
provides a buffer or transition area between private and public areas;
8. The project is sensitive and not detrimental to the convenient and safe
movement of pedestrians and vehicles; and
9. The project conforms to the requirements of the California Environmental
Quality Act.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING APPROVAL OF A SITE PLAN REVIEW
TO CONSTRUCT AN ABOVE GROUND DECK AT A SINGLE
FAMILY RESIDENCE AT 2 PINE TREE LANE, IN ZONING CASE
NO. 748 (LOT 96-2-RH), (RIETDYK).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. Guido Rietdyk with respect to
real property located at 2 Pine Tree Lane, (Lot 96-2RH), Rolling Hills, CA requesting a
Site Plan Review to permit construction of a 106 square foot above grade deck.
Section 2. The Planning Commission conducted duly noticed public hearings
to consider the application at a field trip on December 18, and at their regular meeting
on December 18, 2007. The applicant was notified of the public hearings in writing by
first class mail. Evidence was heard and presented from all persons interested in
affecting said proposal and from members of the City staff and the Planning
Commission having reviewed, analyzed and studied said proposal. The applicant was
in attendance at the hearings.
Section 3. The property is zoned RAS-2 and is 2.24 acres (gross) in size,
excluding roadway easement. A residence was constructed on the site in 1985.
Section 4. The Planning Commission finds that the project qualifies as a Class
3 Exemption (The State of CA Guidelines, Section 15303) and is therefore categorically
exempt from environmental review under the California Environmental Quality Act.
Section 5. Section 17.12.040 defines an above ground deck a structure, which
requires a Site Plan Review. With respect to the Site Plan Review application requesting
construction of the deck, the Planning Commission makes the following findings of fact:
A. The proposed development is compatible with the General Plan, the
Zoning Ordinance and surrounding uses because the proposed structure complies with
the General Plan requirement of low profile, low -density residential development with
sufficient open space between surrounding structures. The project conforms to Zoning
Code setbacks, lot disturbance and lot coverage requirements. The proposed project is
screened from the road so as to reduce the visual impact of the development.
B. The development plan substantially preserves the natural and
undeveloped state of the lot by minimizing building coverage because the new
structure will not cause the lot to look overdeveloped. Significant portions of the lot will
be left undeveloped so as to maintain open space on the property. The nature,
condition, and development of adjacent uses, buildings, and structures and the
topography of the lot have been considered, and the construction of the deck will not
adversely affect or be materially detrimental to the adjacent uses, buildings, or

structures because the proposed structure will be constructed on a portion of the lot
which is the least intrusive to surrounding properties, will be screened and landscaped
with trees and shrubs, is a sufficient distance from nearby residences so that the
proposed structure will not impact the view or privacy of surrounding neighbors, and
will utilize the existing building pad for the new construction.
C. The proposed development, as conditioned, is harmonious in scale and
mass with the site, the natural terrain and surrounding residences. As indicated in
Paragraph A, the lot coverage maximum set forth in the Zoning Code will not be
exceeded and the proposed project is consistent with the scale of the neighborhood.
D. The development plan incorporates existing trees and native vegetation to
the maximum extent feasible. An adequate area for a future stable and corral has been
set aside on subject property.
E. Limited grading is proposed and it consists of cutting the slope for the
deck only, which is an extension of an existing walkway surrounding the residence.
F. The proposed development is sensitive and not detrimental to the
convenience and safety of circulation for pedestrians and vehicles because the deck will
be accessed from the residence and no change to the circulation is proposed.
G. The project conforms to the requirements of the California Environmental
Quality Act and is exempt.
Section 6. Based upon the foregoing findings, the Planning Commission hereby
approves the Site Plan Review application for Zoning Case No. 748 for 106 square feet
deck as shown on the Development Plan dated December 12, 2007 and marked Exhibit
A, subject to the following conditions:
A. The Site Plan Review approval shall expire within two years from the
effective date of approval if construction pursuant to this approval has not commenced
within that time period, as required by Section 17.46.080(A) of the Rolling Hills
Municipal Code, or the approval granted is otherwise extended pursuant to the
requirements of that section.
B. It is declared and made a condition of the Site Plan Review approval, that
if any conditions thereof are violated, this approval shall be suspended and the
privileges granted hereunder shall lapse; provided that the applicants have been given
written notice to cease such violation, the opportunity for a hearing has been provided,
and if requested, has been held, and thereafter the applicant fails to correct the violation
within a period of thirty (30) days from the date of the City's determination.
C. All requirements of the Building and Construction Ordinance, the Zoning
Ordinance, and of the zone in which the subject property is located must be complied
with unless otherwise set forth in the Permit, or shown otherwise on an approved plan.

D. The lot shall be developed and maintained in substantial conformance
with the site plan on file marked Exhibit A and dated December 12, 2007 except as
otherwise provided in these conditions.
E. E. The working drawings submitted to the County Department of
Building and Safety for plan check review must conform to the development plan
approved with this application.
F. There shall be no grading for this project, except for the cut for the deck.
G. Structural lot coverage shall not exceed 12,482 square feet or 15.8%.
H. Total lot coverage of structures and paved areas shall not exceed 21,614
square feet or 27.4% in conformance with lot coverage limitations.
I. The disturbed area of the lot shall not exceed 78.5% of the net lot area,
which is pre-existing, and no further disturbance is allowed.
J. Residential building pad coverage on the 19,259 square foot residential
building pad shall not exceed 60.1%.
K. During construction, the property owners shall be required to schedule
and regulate construction and related traffic noise throughout the day between the
hours of 7 AM and 6 PM, Monday through Saturday only, when construction and
mechanical equipment noise is permitted, so as not to interfere with the quiet
residential environment of the City of Rolling Hills.
L. Notwithstanding Sections 17.46.020 and 17.46.070 of the Rolling Hills
Municipal Code, any modifications to the property, which would constitute
additional structural development or grading, shall require the filing of a new
application for approval by the Planning Commission.
M. The project must be reviewed and approved by the Rolling Hills
Community Association Architectural Review Committee prior to the issuance of
building permit.
N. Until the applicants execute an Affidavit of Acceptance of all conditions of
this Site Plan Review approval, as required by Section 17.46.065, the approval shall not
be effective.
O. All conditions of the Site Plan approval, that apply, shall be complied with
prior to the issuance of a building permit from the County of Los Angeles.
P. Any action challenging the final decision of the city made as a result of the
public hearing on this application must be filed within the time limits set forth in
Section 17.54.070 of the Rolling Hills Municipal Code and Code of Civil Procedure
Section 1094.6.

December 18, review the staff report, continue the public hearing, take public testimony,

2. The applicant is currently remodeling the existing residence and is proposing to

Zoning Code, a raised deck is considered a structure that require Site Plan Review.
3. The property is zoned RAS-2 and the gross lot area is 2.24 acres. The net lot area
for construction purposes is 78,927 square feet. The lot is located along a bend on Pine
Tree Lane and has a frontage along Pine Tree of over 563 feet.

REOUEST AND RECOMMENDATION
Request for a Site Plan Review to construct a 106 square foot above ground deck.
It is recommended that the Planning Commission review the staff report, view the
project, open the public hearing, take public testimony and consider the criteria for granting
of a Site Plan Review.
BACKGROUND AND MUNICIPAL CODE COMPLIANCE
1. The applicant requests a Site Plan Review to construct a 106 square foot above
ground deck.
2. The applicant is currently remodeling the existing residence and is proposing to
reconstruct and enlarge the existing pool and reconstruct the existing deck, which
would not require discretionary permit. However, pursuant to Section 17.12.190 of the
Zoning Code, a raised deck is considered a structure that require Site Plan Review.
3. The property is zoned RAS-2 and the gross lot area is 2.24 acres. The net lot area
for construction purposes is 78,927 square feet. The lot is located along a bend on Pine
Tree Lane and has a frontage along Pine Tree of over 563 feet.
4 The property was developed in 1985 with a 6,211 square foot residence, 1,033
square foot garage, 588 square foot swimming pool (proposed to be enlarged to 790
sq.ft.), 50 square foot pool equipment area, 3,280 square foot recreation court, 466
square feet covered porches, 1,154 square foot deck and 6,211 square foot basement. A

portion of the basement is out of grade in the rear of the residence and the structure
becomes two-story.
5. The existing residential building pad (outside the setbacks) is 19,153 square feet
and has coverage of 59.3%. The pad will be enlarged by 106 square feet, the size of the
deck and will be 19,259 square feet. The building pad coverage is proposed on this pad
to be 60.1%, not including the covered porches. The stable pad is 1000 square feet and
will have coverage of 45.0%.
6. The structural net lot coverage is proposed at 12,482 square feet or 15.8%, which
includes all the structures and the proposed deck (20% permitted); and the total lot
coverage including structures and paved areas is proposed to be 21,614 square feet or
27.4%, (35% permitted).
7. Currently 62,000 square feet of the lot or 78.5% is disturbed. The proposed deck
will be located on previously graded slope. The 1985 grading plans shows limits of
grading, which includes the area of the deck.
CONCLUSION
8. When reviewing a site plan review application the Planning Commission should
consider whether the proposed project is consistent with the City's General Plan;
incorporates environmentally and aesthetically sensitive grading practices; preserves
existing mature vegetation; is compatible and consistent with the scale, massing and
development pattern in the immediate project vicinity; and otherwise preserves and
protects the health, safety and welfare of the citizens of Rolling Hills.
9. Under City's regulations, raised decks (raised 12 inches or more above natural
grade) are considered structures and require Planning Commission review.
10. The lot is irregular in shape with steep slopes and has a long frontage along Pine
Tree Lane.
11. The project meets the City's development standards, except that the building pad
coverage exceeds the guidelines, and the disturbed area is over 40%. However, both
conditions are pre-existing and will not be greatly exacerbated by the construction of
106 square foot raised deck.
12. The lot contains an adequate area in a feasible location to construct a stable and
corral in the future.
OTHER AGENCIES REVIEW
13. The Rolling Hills Community Association Architectural Committee will review
the project for architectural elements and design.
14. The project has been determined to be categorically exempt pursuant to the
California Environmental Quality Act (CEQA)

SITE PLAN REVIEW CRITERIA
17.46.010 Purpose.
The site plan review process is established to provide discretionary review of
certain development projects in the City for the purposes of ensuring that the proposed
project is consistent with the City's General Plan; incorporates environmentally and
aesthetically sensitive grading practices; preserves existing mature vegetation; is
compatible and consistent with the scale, massing and development pattern in the
immediate project vicinity; and otherwise preserves and protects the health, safety and
welfare of the citizens of Rolling Hills.
17.46.050 Required findings.
A. The Commission shall be required to make findings in acting to approve,
conditionally approve, or deny a site plan review application.
B. No project which requires site plan review approval shall be approved by
the Commission, or by the City Council on appeal, unless the following findings can be
made:
1. The project complies with and is consistent with the goals
and policies of the general plan and all requirements of the zoning ordinance;
2. The project substantially preserves the natural and
undeveloped state of the lot by minimizing building coverage. Lot coverage
requirements are regarded as maximums, and the actual amount of lot coverage permitted
depends upon the existing buildable area of the lot;
3. The project is harmonious in scale and mass with the site,
the natural terrain and surrounding residences;
4. The project preserves and integrates into the site design, to
the greatest extent possible, existing topographic features of the site, including
surrounding native vegetation, mature trees, drainage courses and land forms (such as
hillsides and knolls);
5. Grading has been designed to follow natural contours of the
site and to minimize the amount of grading required to create the building area;
6. Grading will not modify existing drainage channels nor
redirect drainage flow, unless such flow is redirected into an existing drainage course;
7. The project preserves surrounding native vegetation and
mature trees and supplements these elements with drought -tolerant landscaping which is
compatible with and enhances the rural character of the community, and landscaping
provides a buffer or transition area between private and public areas;
8. The project is sensitive and not detrimental to the convenient and safe
movement of pedestrians and vehicles; and
9. The project conforms to the requirements of the California Environmental
