Dear Dr. and Mrs. Askari:
This letter shall serve to notify you that the City Council at their regular meeting on June
13, 2011, received and filed the Planning Commission's resolution granting your request
in Zoning Case No. 800.
The decision shall become effective thirty days after the adoption of the resolution by the
Planning Commission unless an appeal has been filed or the City Council takes
jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of
the Rolling Hills Municipal Code). Should there be an appeal, the Commission's decision
will be stayed until the Council completes its proceedings in accordance with the
provisions of the Municipal Code.
Before this case takes effect you are required to record an Affidavit of Acceptance Form,
accepting all of the conditions of the resolution, together with the subject resolution in the
Office of the County Recorder.

approval set forth by the Planning Commission and the approved Development Plan to
keep for your files. Please complete the enclosed AFFIDAVIT OF ACCEPTANCE

Please assure that your contractors and representatives adhere to the conditions of the
Resolution of Approval and that any conditions of the Resolution required to be
implemented prior to issuance of building permits are met. The City will notify the
Building & Safety Division to issue permits only after the Affidavit of Acceptance and the
Resolution are recorded and received by the City. The conditions of approval shall be
printed on the plans.
This approval is valid for two years. Therefore, the modifications must commence within
a two-year period from the effective date of the approval, including obtaining permits for
all previous work.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING A CONDITIONAL USE PERMIT TO RETAIN A
LEGAL NONCONFORMING STABLE STRUCTURE, AND VARIANCE TO
MAINTAIN THE STRUCTURE IN THE SIDE YARD SETBACK ON A
PROPERTY DEVELOPED WITH A SINGLE FAMILY RESIDENCE, IN ZONING
CASE NO. 800, AT 2 PHEASANT LANE, (LOT 89-B-RH), (ASKARI). PROJECT
HAS BEEN DETERMINED TO BE EXEMPT PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT, (CEQA).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Dr. and Mrs. Asghar Askari with
respect to real property located at 2 Pheasant Lane (Lot 89-B-RH) requesting a
Conditional Use Permit and Variance to retain an existing 1,260 square foot two story
stable structure in the setback and to allow the existing pavement adjacent to the tack
room to remain. An unauthorized addition of 105 square feet was made to lower level
of the structure, which triggered the discretionary review.
The applicant withdrew a variance from the requirement that the area adjacent to the
tack room not be entirely paved.
Section 2. The property is zoned RAS-2 and consists of 153,305 square feet
(3.5 acres) net. Records indicate that a 2-story stable in the current location was legally
constructed in 1961. Plans on record at the RHCA show the first story at 525 square feet
and a 630 square foot loft. The stable was constructed with the first story built into a
slope with a driveway leading to the residence adjacent to the upper floor. The
residence was constructed in 1958.
Section 3. The property is irregular in shape, and takes access over 25
Portuguese Bend Road. The property does not have direct access to the Road. The
stable was constructed in the narrow -most portion of the lot, both in a roadway
easement (although there is no road traversing the property) and in side setback. A 42-
foot roadway easement is located along the southwestern property line and a 60-foot
roadway easement is located along the south property line. The only access to the
residence is through the driveway that is bordering the stable structure.
Section 4. In the summer of 2009, it was brought to the City's attention that
the stable was being renovated without building permits. A letter to cease all
construction was mailed to the owners and subsequently a meeting was held with staff.
Dr. and Mrs. Askari were advised on the pending changes to the stable ordinance and
the code enforcement was held in abeyance until the new ordinance became effective.

On May 17, 2011, the Planning Commission adopted a resolution, with conditions,
granting your request for a CUP and Variance Zoning Case No. 800. That action,
accompanied by the record of the proceedings before the Commission will be reported
to the City Council on Monday, June 13, 2011 at their regular meeting beginning at 7:30
PM. You or your representative must be present to answer any questions the Council
may have.
Please familiarize yourself with the conditions and if you have any questions or
objections you may appeal the Planning Commission decision to the City Council.
The Planning Commission's decision in this matter shall become effective thirty days
after the adoption of the resolution by the Commission, unless an appeal has been filed
or the City Council takes jurisdiction of the case within that thirty (30) day appeal
period. (Section 17.54.010(B) of the Rolling Hills Municipal Code). Should there be an
appeal, the Commission's decision will be stayed until the Council completes its

Dear Dr. and Mrs. Askari:
The Planning Commission at their March 15, 2011 meeting directed you to restudy the
modifications to the stable structure. The intent is to bring the structure both, the tack
room area and the storage area, to as closely as possible comply with the ordinance and
the structure appearance as a stable, inside and out. I would suggest that you review the
original plans for the structure and try to match those configurations as closely as
possible. Some of the suggestions brought up by the Commissioners include:
• The stove area in the tack room and vents (if any) that could suggest the
presence of a cooktop/oven/stove to be eliminated
• Concrete driveway along the tack room to be eliminated and area softened with
pervious material
For the lower floor:
• No bathroom facility
• Size of the rooms to accommodate a horse (too many partitions/closets)
• Interior walls to have a stable like appearance (not finished/exposed look)
• Remove the flooring so the floor looks more agricultural
• Windows to be removable for easy conversion to animal keeping
• Exterior doors to be stable like. The Planning Commission will approve a
minimum of 4'x7'6" exterior stable doors.
• Remove the glass sliding doors
• Make the bottom level one room
• Seal the bottom level so it is not accessible
• Soften the outside of the structure so it has more of a barn -look
• Corral area to be fenced off
Please submit revised plans (7 copies) by no later than April 13, 2011. The next
Planning Commission meeting is scheduled for THURSDAY, April 21, 2011 at 6:30 PM.
