748, Construct an above ground deck, CorrespondenceMEMO TO FILE: DATE: NOVEMBER 22, 2010 2 PINE TREE LANE A final inspection was granted to the property for work done to the outside: pool, deck, play area, drainage, landscaping of disturbed slopes and short wall by the play area. Prior to granting a final inspection, the play area was required to be smoothed out in the far corner and dirt berms installed, so that most of the water would be contained on 2 Pine Tree and not overflow to the neighboring property -4 Pine Tree Lane. This was done and approved by the County Inspector. Less than 2000 sq.ft. play area which required less than 3-foot cut, thus the wall, was administratively approved several years ago. On three sides of the play area the owner installed a net like loosely fitted enclosure that is attached to posts that are removable. The posts and net are 6 feet tall. The applicant was informed that because of the non -permanent and net like nature of the enclosure, staff at this time is not deeming this to fall under the definition of a sports court. However, should there be a complaint or should a permanent enclosure be installed, the play area would be considered a "sports court" and a CUP approval would be required. In addition, pursuant to the Building Code any fence over 6 feet requires a building permit. The County inspector informed the owner that if this enclosure becomes permanent and if it is over 6 ft. it will require a building permit. THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. An application was duly filed by Mr. Guido Rietdyk with respect to real property located at 2 Pine Tree Lane, (Lot 96-2RH), Rolling Hills, CA requesting a Site Plan Review to permit construction of a 106 square foot above grade deck.; Section 2. The Planning Commission conducted duly noticed public hearings to consider the application at a field trip on December 18, and at their regular 'meeting on December 18, 2007. The applicant was notified of the public hearings in writing by first class mail. Evidence was heard and presented from all persons interested in affecting said proposal and from members of the City staff and the Planning Commission having reviewed, analyzed and studied said proposal. The applicant was in attendance at the hearings. Section 3. The property is zoned RAS-2 and is 2.24 acres (gross) in size, excluding roadway easement. A residence was constructed on the site in 1985. Section 4. The Planning Commission finds that the project qualifies as a Class 3 Exemption (The State of CA Guidelines, Section 15303) and is therefore categorically exempt from environmental review under the California Environmental Quality Act. Section 5. Section 17.12.040 defines an above ground deck a structure, which requires a Site Plan Review. With respect to the Site Plan Review application requesting construction of the deck, the Planning Commission makes the following findings of fact: A. The proposed development is compatible with the General Plan, the Zoning Ordinance and surrounding uses because the proposed structure complies with the General Plan requirement of low profile, low -density residential development with sufficient open space between surrounding structures. The project conforms to Zoning Code setbacks, lot disturbance and lot coverage requirements. The proposed project is screened from the road so as to reduce the visual impact of the development. B. The development plan substantially preserves the natural and undeveloped state of the lot by minimizing building coverage because the new structure will not cause the lot to look overdeveloped. Significant portions of the lot will be left undeveloped so as to maintain open space on the property.
