We would like to have this release in order to completely test all of our powered equipment. The completed connection will also allow us the ability to remove the current temporary power pole and continue with landscaping the site. Because our new power is all fed to the home underground we can eliminate the unsightly temporary overhead lines as well as clear the way for Larry Fay with Edison to remove the pole located in the easement to the west of our site. For your information upon release we will schedule for permanent power. Within 5 days of receiving power the temporary power pole will be removed. Larry Fay (Edison) has said that removal of the power pole in the west easement would be scheduled shortly there after. This does not mean that the job itself is completed or final inspected. The Gas company would be the last of the utilities to be permanently installed. This utility would not be released until the job is completed and final approval given by R.H.C.H., R.H.C.A. and L.A.D.B.S.. Thank you for your cooperation. In order to certifythe permittee's intent to comply with the Permit when discharging storm water from the construction development, the permittee signed a Notice of Intent (NOI) on October 15, 2004. In signing the NOls, the permittee has certified to the State of California that he has read the Permit and will comply with all requirements specified in the Permit. As specified in the Permit, the permittee is required to develop a Storm Water Pollution Prevention Plan (SWPPP), in which the permittee must identify potential sources of pollution and describe specific best management practices (BMPs) that the permittee shall implement to eliminate or reduce storm water pollution from the construction development. The SWPPP shall remain on site while the site is under construction. On May 4, 2006, Regional Board staff (Wendy Liu) (staff) inspected the site to determine compliance with the Permit. During the inspection, staff met with your representatives and walked around the perimeter of the site. Staff found that the SWPPP and Monitoring Program (MP) were not available for review during the inspection. SWPPP not available on site is in violation of Permit Section A. MP not available on site is in violation of Permit Section B. In addition, the concrete washout area without proper control is in violation of Permit Section A.8. At the conclusion of the inspection, staff advised site representatives that the permittee was in violation of certain sections of the Permit because the SWPPP and MP were not developed or kept on site. This letter addresses a number of issues the Martins would like you to consider. Revised Site Plan Since the last Planning Commission meeting, the Martins have revised their site plan to move the house 16 feet further back on the site. The house dimensions remain the same; however because the western boundary angles westward, the distance from the western side yard set back has increased. Size and Scale of the Proposed Home The Martins' property has a number of unique characteristics that are important in assessing the size and scale of the proposed residence. First, the Martins' have a particularly large lot, with a particularly large pad, which allows for the structure they are proposing. The scale of the proposed residence relative to lot and pad size is roughly the same as the scale of houses on other properties in the area. The difference is that the Martin lot and pad are much large than other properties in the area. If the property were divided, the two lots easily would be large enough to support houses in the 7,000 square foot range, which would roughly equal the square footage of the proposed residence. Second, the Martins' property is not visible from many locations. The Martins' home would not be visible from any of the houses to the south. One would see only glimpses of it from Crest Road. The house would not be visible from most of the surrounding properties. www.coxcastle.com Los Angeles f Orange County San Francisco • • City of Rolling Hills Planning Commission December 12, 2003 Page 2 The only neighboring properties that will see the house are the immediate neighbors on either side, both of whom support the project. The Martins' house will be partially visible to only two houses that are some distance from the Martin property to the north. As a result, unlike many properties in Rolling Hills, the Martin property does not present a situation where there would be a large house in the midst of group of smaller houses. The Martin property is in an isolated location that has a direct relationship to only two neighboring properties, whose owners do not object to the Martins' proposal. One of the reasons why the two neighboring property owners support the Martin site plan application is because the home's mass has been distributed across the pad with an articulated design that reduces the home's appearance. As a result, only part of the home would be visible from any point. The owners on the east and west sides of the property would see only that portion of the home that is adjacent to those properties. The properties to the north would see only part of the home on the western end of the pad, but would not see the eastern half of the home. The home would not otherwise be visible. The Martins' proposed home is well within the City's maximum permitted building envelope. Structural lot coverage is at 9.4%, well under the 20% maximum. The total lot coverage is at 19%, well within the 35% maximum. The disturbed area is at 35.4% (all of which is existing), which is within the City's 40% maximum. Pad coverage is at 29%, which is under the City's 30% maximum guideline. In addition, the Martins' proposed home does not crowd the site. At its closest point, the home is 23 feet from the front yard set back. However, the majority of the home is approximately 97 feet from the front yard setback. Yet there is still has considerable room at the rear of the pad. The home also does not crowd the side yards. At its closest point, the home is set back approximately 19 feet from the eastern side yard set back and between four and 19 feet from the western side yard setback. The side yard setbacks for this property are already 35 feet from the property line, which produces a combined minimum side yard distance of 70 feet. The fact that the Martins' proposed home is setback even more from those side yard setbacks increases the sense of openness between the properties. The result is a home that is compatible with the community and the two immediately adjacent properties and also has no impact on surrounding properties. The unique features of the Martins' property and the design of the home make this result possible. Grading As a result of the revisions to the site plan, grading has been reduced to a balanced 875 cubic yards of cut and fill. Some fill will be added to the northerly end of the pad. There is a minor amount of fill in the driveway. The home will sit entirely on the existing pad. No grading is occurring to enlarge the pad to accommodate the home. Reducing the size of the home will not reduce the grading for the project. The Martins' Home Meets the Site Plan Findings The Martins' proposed home meets all of the site plan approval criteria. The following summarizes the basis for the findings to approve the Martins' site plan. The project is compatible with the General Plan, the Zoning Ordinance and surrounding uses. The home complies with the General Plan requirement of low profile, low density residential development with sufficient open space between surrounding structures. The proposed home conforms to all of the Zoning Code's setback and lot coverage requirements. The project preserves and integrates into the site design, to themaximum extent feasible, existing natural topographic features of the lot includes surrounding native vegetation, mature trees, drainage courses, and land forms. The home will be located on an existing pad. No grading will occur to accommodate the structure. The proposed grading is limited and does not alter any natural topographic features or drainage courses. Most of the native vegetation and mature trees will remain on the site. The site development plan follows the natural contours of the site to minimize grading. The grading will not alter the natural contours of the site. All of the development will occur on the existing graded pad. No grading is occurring to maximize the buildable area. Grading will not modify existing drainage patterns or redirect flow from existing drainage courses. The site development plan preserves surrounding native vegetation and supplements it with landscaping that is compatible with and enhances the rural character of the community. All construction will occur on the existing graded pad. The project will not change the native vegetation along Crest Road. The project will not alter any native vegetation at the rear of the property. Existing landscaping and terrain already buffers the view of the structure from other properties. The Martins will augment the natural landscape buffers on the site. The site development plan preserves the natural and undeveloped state of the lot by minimizing building coverage. The project will be located on the existing building area on the site. No grading or land form alteration will be required to accommodate the structure. The lot coverages are well within the City's maximum permitted standards. The lot coverage on the Martin property is comparable to coverages on other surrounding property. City of Rolling Hills Planning Commission December 12, 2003 Page 4 The site design plan is harmonious in scale and mass with the site, the natural terrain and surrounding residences. There is very little interface with surrounding properties. The Martin home is set back from the side yard setbacks on either side of the home. The neighbors on either side do not oppose the project. There is ample room for the Martin home on the existing pad. The design of the home distributes the density so that none of the surrounding properties that can see the home will see the full scale of the structure. The site development plan is sensitive and not detrimental to convenience and safety of circulation for pedestrians and vehicles. Existing ingress and egress will be retained. Ample parking will be provided on site. For all of these reasons, the Martins request that your Commission approve their site plan and allow them to move forward with construction of their home.
