FINDINGS AND REPORT
The application of Mr. Bart Cleveland, Lot 110-EF, Eastfield
Tract, for a conditional use permit under ARTICLE III, Section 3.07,
Side Yard Requirements, Ordinance No. 33 for construction of a
residence addition which would project into the side yard came on
for hearing on the 15th day of February 1977 in the Council Chambers
of the Administration Building, 2 Portuguese Bend Road, Rolling Hills
California, and the applicant, having submitted evidence in support
of the application, the Planning Commission, being advised, now makes
its Findings and Report as required by the Ordinances of the City of
Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Bart Cleveland
is the owner of that certain real property described as Lot 110-EF,
located at 2 Open Brand Road in the City of Rolling Hills, and that
notice of the public hearing in connection with said application was
given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills, California. The Commission finds, further,
that no communication, written or verbal, was received in favor of or
in opposition to the request. Mrs. Chadwick Smith, 7 Wide Loop Road,
advised the Commission that she has no objection to the proposal, and
was present to observe the meeting of the Planning Commission.

The Commission finds that the applicant requests the con-
ditional use permit for construction of a residence addition in
connection with repairs and reconstruction of his home following a
major fire. Since the entire residence needs a new roof, the appli-
cant wishes to add a bedroom and bath which would project three feet
into the side yard for a distance of six feet, since it has been
designed to provide an even roofline. A plot plan submitted indicates
that construction would cover approximately 25% of the 1.75 acre parcel,
and total development would cover approximately 30% of the net area.
Further, the applicant stated that the addition would be approximately
65 feet from the nearest residence. The Commission finds that a
conditional use permit should be granted in order to preserve sub-
stantial property rights possessed by other property in the same
vicinity and zone, and that the granting of such conditional use
permit would not be materially detrimental to the public welfare, nor
injurious to property in the same vicinity and zone.

From the foregoing it is concluded that a conditional use
permit for construction of a residence addition which would project
three feet into the• side yard should be granted to Mr. Bart Cleveland,
Lot 110-EF, and it is, therefore, so ordered.
