FINDINGS AND FORMAL REPORT
The application of Glynn W. Rushmore, Lot. 114, Eastfield
Tract, for a side yard variance, came on for hearing on the 26th
day of January, 1965, at the hour of 800 P.M. at the City Hall of
the City of Rolling Hills, California, said hearing being continued
to the 23rd day of February, 1965, at the hour of 800 P.M. at the
City Hall of the City of Rolling Hills, California, and the appli-
cant having submitted evidence in support of his application, the
Planning Commission, being advised, now makes its Findings and
Formal Report as required by the Ordinances of the City of Rolling
Hills, California.
I.
The Commission finds that the applicant, Mr. Glynn W.
Rushmore, is the owner of that certain real property described as
Lot 114, Eastfield, located in the City of Rolling Hills, California,
and that notice of the public hearing in connection with said appli-
cation was given as required by Sections 8.06 and 8.07 of Ordinance
No. 33 of the City of Dolling Hills, California.

The Commission further finds that no person appeared at.
said public hearing in opposition to the application for a variance
and that no evidence was received by the Commission in opposition
thereto.

The Commission further finds that the proposed residence
addition will extend ten and one-half (10k) feet into the side
yard of said lot, and further finds that by reason of a five (5)
foot easement on the southwest property line and by reason of an
existing nonconforming, use as defined in Section1.21 of Ordinance
No. 33, the variance should be granted to the applicant in order
to preserve substantial property rights possessed by other
property in the same vicinity and zone, and that the granting of
such variance will not be materially detrimental to the public
welfare or injurious to property or improvements in such vicinity
and zone in which applicant's property is located.

From the foregoing it is concluded that a variance
should be granted by the Planning Commission of the City of Rolling
Hills to Glynn W. Rushmore of Lot 114, Eastfield Tract, in accor-
dance with the plot plan marked Exhibit I on file in these pro-
ceedings, and it is, therefore, so ordered.
