FINDINGS AND REPORT
The application of Mr. Robert Gray, Lot 82-EF, Eastfield Tract,
for a conditional use permit under ARTICLE III, Section 3.06, Front Yard
Requirements, Ordinance No. 33 for construction of a swimming pool in the
front yard at 1 Outrider Road came on for hearing on the 18th day of May,
1976 in the Council Chambers of the Administration Building, 2 Portuguese
BEnd Road, Rolling Hills, California, and the applicant, having submitted
evidence in support of the application, the Planning Commission, being
advised, now makes its Findings and Report as required by the Ordinances
of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Robert Gray, is
the owner of that certain real property described as Lot 82-EF, Eastfield
Tract, located in the City of Rolling Hills, California, and that notice
of the public hearing in connection with said application was given as
required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of
Rolling Hills, California. The Commission finds further that no communi-
cation, written or oral, had been received in favor of or opposition to
the request.
II.
The Commission further finds that members of the Planning
Commission had made a field trip to the site and haddetermined that the
pool would be located 110 feet from the easement for Outrider Road, and
would be thirty feet above road level, and further, statistics presented
by the applicant indicate that construction on the property, including
the pool, would cover 8.2% of the property, and total improvements would
cover 18.9%•and would be well within limits set forth in Ordinance No. 137.
III.
The Commission finds that a conditional use permit should be
granted in order to preserve substantial property rights possessed by

other properties in the same vicinity, and that in, granting such permit,
the condition be attached that no construction be higher than 36" to
eliminate the possibility of installing a slide, and so that pool equip-
ment would not be visible from Outrider Road, and that the granting of
such conditional use permit would not be materially detrimental to the
public welfare nor injurious to property in the same vicinity and zone.
IV.
From the foregoing it is concluded that a conditional use
permit should be granted under ARTICLE III, Section 3.06, Front Yard
Requirements for construction of a swimming pool in the front yard,
with no construction exceeding 36" in height to Mr. Robert L. Gray,
Lot 82-EF, and it is, therefore, so ordered.
