FINDINGS AND REPORT
The application of Mr. Donald Marriott, Lot 81-EF, Eastfield
Tract, for a conditional use permit, Front Yard Requirements, under
Article III, Section 3.06 of Ordinance No. 33 came on for hearing on
the 17th day of January, 1973 in the Council Chambers of the Adminis-
tration Building, 2 Portuguese Bend Road, Rolling Hills, California,
and the applicant, having submitted evidence in support of the appli-
cation, the Planning Commission, being advised, now makes its Find-
ings and Report as required by the Ordinances of the City of Rofl.3,ng
Hills, California.
The Commission finds that the applicant, Mr, Donald Marriott,
is the owner of that certain real property described as Lot 81-EF,
Eastfield Tract, located in the City of Rolling Hills, California,
and that notice of the public hearing in connection with said appli-
cation was given as required by Sections 8.06 and 8.07 of Ordinance
No. 33 of the City of Rolling Hills, California.

The Commission further finds that no person appeared at said
public hearing in opposition to the application for a variance and
that Mrs. J. Richard Klein, 1 Outrider Road; Mrs. Marilyn Malmuth,
4 Outrider Road and Mr. Gordon Potter, 7 Outrider Road had stated
that they had no objection to the request; and that Mr. Arthur
Stribley, 8 Outrider Road appeared at the hearing and expressed a
concern about noise from the pool.
III.
The Commission finds that the applicant requests the conditional
use permit for construction of a swimming pool in the front yard,
which is approximately 16 feet 'above road level and screened from the
road by heavy planting. The Commission finds that the conditional
use permit should be issued for construction of a pool 34'6" from
the road easement of Outrider Road, with a requirement that a landr
soaping and/or fence plan be submitted to the Architectural Committee
for abatement of noise, in order to preserve substantial property
rights possessed by other property in the same vicinity and zone,

From the foregoing it is concluded that a conditional use permit
for variance of Front Yard Requirements under Article III, Section
3.06 of Ordinance No. 33 should be granted to Mr, Donald Marriott,
Lot 81-EF, Eastfield Tract, in accordance with the plot plan marked
Exhibit I on file in these proceedings, and it is, therefore, so
ordered.
