McCORMICK, M.D. Lot 71, Eastfield(R.& S. 58-9) ZONING CASE NO. 18 FINDINGS AND FORMAL REPORT The application of Robert P. MCCormick, Lot 71, Eastfield, for a side yard variance, came on for hearing on the 10th day of May, 1962, at the hour of 8:00 P.M., at the City Hall of the City of Rolling Hills, California, and the applicant having submitted evidence in support of his application, and the Planning Conuiiission being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California. .I. The Connnission finds that the applicant, Robert P. McCormick, is the owner of that certain real property described as Lot 71 of Eastfield, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II. That no person appeared at said public hearing in opposition to the application for a variance and that no evidence was received by the Commission in opposition thereto. • • 1 The Commission further finds that the proposed cabana 2 of applicant is to be located within a foot of the easement line, 3 4 instead of the twenty foot side yard setback as required by said 5 Zoning Ordinance, and further finds that by reason of the twenty- 6 five (25) foot width of said easement and by reason of the terrain 7 of said Lot 20, the variance should be granted to the applicant 8 in order to preserve substantial property rights possessed by 9 other property in the same vicinity and zone, and that the 10 granting of such variance will not be materially detrimental to 11 12 the public welfare or injurious to property or improvements in 13 such vicinity and zone in which applicant's property is located, 14 and that there are exceptional and extraordinary circumstances 15 and conditions by reason of physical location and terrain of said 16 Lot 71, which do not apply generally to other property in the same 17 vicinity and zone. 18 IV. 19 20 From the foregoing it is concluded that a variance 21 should be granted by the Planning Commission of the City of 22 Rolling Hills to Robert P.
