FINDINGS AND REPORT
The application of Mr. Arthur F. Stribley, Lot 72-B-EF,
Eastfield Tract, for a conditional use permit under Section 3.01 (D),
Paragraph 3 (a) of Ordinance No. U-38 for construction of a building
to serve as a combination pool house and recreation building came on
for hearing on the 17th day of July, 1979 in the Council Chambers of
the Administration Building, 2 Portuguese Bend Road, Rolling Hills,
California, and the applicant, having submitted evidence in support
of the application, the Planning Commission, being advised, now makes
its Findings and Report as required by the Ordinances of the City of
Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. A. F. Stribley,
is the owner of that certain real property described as Lot 72-B-EF,
located at 8 Outrider Road in the City of Rolling Hills, and that
notice as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills, and that no communication, written or
verbal, was received in favor of or in opposition to the request.

The Commission finds that it is the applicant's intention
to have a recreation building constructed adjacent to a proposed swim-
ming pool on his property. The Commission finds further that the
proposed pool house/recreation building will be 480 square feet, and
the addition of the combined swimming pool and recreation building
will bring the total development of the property to 11% of the total
net area of the property. Further, the Commission finds that a
minimum of cut and fill will be required, and will be balanced, as
the firt from the pool excavation will be used for leveling and
landscaping the property. The Commission finds that a conditional
use permit should be granted in order to preserve substantial property
rights in the same vicinity and zone, and that the granting of such
conditional use permit would not be materially detrimental to the
public welfare, nor injurious to property in the same vicinity and
zone.
From the foregoing it is concluded that a conditional use
permit should be granted to Mr. A. F. Stribley, Lot 72-B-EF, for
construction of a pool house/recreation building, subject to the
following conditions:
1. That the building not be larger than 480 square feet,
as shown on the plan;
2. That the building not be located in any set back or
easement;
3. That the building may contain a bathroom with shower
and a wet bar as shown on the plan, but no cooking
facilities will be permitted;
and it is, therefore, so ordered. This approval shall expire one
year from the date of grant, if not acted on.
