MARION RUTH 5 OUTRIDER ROAD (LOT 48-EF) BACKGROUND Attached is a request by Mr. Douglas McHattie for a one year time extension for a Site Plan Review for a proposed residential reconstruction on the subject site. City Council Resolution No. 599 was approved on December 11, 1989 for a proposed Site Plan. A request for a Variance for construction of a stable in the front yard was withdrawn. Since that time, a number of setbacks have befallen the project as noted by Mr. McHattie. Also, the original plot plan was reduced in size. The original house and detached garage proposed was 6,180 square feet and the proposed project has been reduced to 5,020 square feet including an attached garage. There are two issues: 1) That the current plot plan is substantially the same as the approved plot plan, and 2) The extension of the Site Plan approval. RECOMMENDATION That the Planning Commission review the case. SEPTEMBER 22, 1989 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: STAFF SUBJECT: ZONING CASE NO. 396 - MARION RUTH - LOT 80-EF- 5 OUTRIDER ROAD Discussion: Subject to recent discussion regarding a future stable site location, the applicant has submitted a revised plan which now depicts the stable in the rear yard area of the subject property. However, in reviewing the plans, Staff ascertained that the stable site location may not comply with the requirements of Rolling Hills Municipal Code. Section 17.16.011 of the Zoning Ordinance requires that a stable be "located not less than thirty-five feet from any residence and not less than twenty-five feet from any property line." Correspondingly, this raised the issue of properly siting a stable location in relation to the proposed residential reconstruction that was approved by the site plan review. On the revised plan, the stable site has been located twenty-five feet (25') from the property line and outside the easement. This puts the future stable closer to the residential structure, thereby, raising a structure separation issue. In evaluating the code requirement, one may interpret the code section in the following manners: 1. Required separation is at the closest points between the stable structure and the residential structure (include attached garage). 2. Required separation is at the closest points between the stable structure and the residential "living space" or dwelling purposes (not including garage). Recommendation: Staff recommends that the City Council examine the structure separation issue, and consider the second statement above as policy as it pertains to the interpretation of the applicable ordinance section.
