This letter is. to serve as official notice, pursuant to
Section 17.32.090 of the Rolling Hills Municipal Code, that a
request for variances for residence additions on both- sides of
the residence on Lot 72A-EF, located at 6 Outrider Road in the
City of Rolling Hills, which was .approved by the Planning
Commission on August 18, 1987, was presented to the City Council
for review on September 14, 1987.
The Council voted to ratify the Planning Commission's approval
of the variances. A copy of the Findings and Report for Zoning
Case No. 343 is enclosed for your information. An acceptance
form, as required by Ordinance No. 207, is also enclosed. Please
complete the form, have the signature(s) notarized, and forward
the document to the Office of the County Recorder, Room 15, 227
North Broadway, Los Angeles, CA 90012 with a check in the amount
of $7.00. When the Affidavit of Acceptance has been returned
to the City, duly executed and recorded, the Los Angeles County
Department of Building and Safety will be notified that a permit
can be issued.

FINDINGS AND REPORT
The application of Dr. '& Mrs. Barton Wachs, Lot 72A-EF,
Rolling Hills Tract, for a Variance under Section 17.32.010 of the
City of Rolling Hills Municipal Code, came for hearing on the 21st
day of July 1987 and the 18th day of August 1987 in the Council
Chambers of the Administration Building, 2 Portuguese Bend Road,
Rolling Hills, California. The Planning Commission, after being
properly- advised, now makes its Findings and Report as required by
the Municipal Code of the City of Rolling Hills, California.
I.
The Commission finds that the applicants, Dr. & Mrs. Barton
Wachs, are the owners of that certain real property described as Lot
72A-EF, located at 6 Outrider Road in the City of Rolling Hills, and
that notice of the public hearing in connection with said application
was given as required by Section 17.32.080 of the Municipal Code of
the City of Rolling Hills, California. The Commission finds,
further, that no comment, written or verbal, was received in
opposition to the request.
II.
The Commission finds that the applicants have requested a
Variance from Section 17.16.070 side yard requirements. The property
is a non -conforming lot of .64 net acres (27,593 sq. ft.) in size,
which is less than the minimum lot size for the RAS - 1 zone (43,500
sq. ft.). Also, the street frontage is approximately 108 feet in
length which is less than the 150 foot lot frontage requirement. The
applicants have requested a 3.5 foot encroachment into the minimum
side yard setback of 20 feet, on the north side of the property,
which would leave a 16.5 foot side yard setback. Also, on the
southside of the property, the applicants have requested a 4 foot
encroachment into the minimum side yard setback of 20 feet where an
encroachment of 11 feet already exists (non -conforming). The
applicants indicate that the 785 sq. ft. addition to the existing
residence is most logically expanded within the established building
pad area. Therefore, the applicants request the granting of the
Variance so that they may have the same rights to property as others
in the same vicinity and zone, which would otherwise be denied if
they were not able to fully utilize the existing building pad area.
The Commission finds that there are significant topographical and
physical conditions which exist on the property, which impinge upon
the applicants' ability to fully utilize their property, without
damaging the environment. The Commission finds that a Variance
should be granted in order to preserve substantial property rights in
the same vicinity and zone, and that the granting of -such Variance
would not be materially detrimental to the public welfare, not
injurious to property in the same vicinity and zone.
III.
From the foregoing, it is concluded that a Variance should be
granted to Dr. & Mrs. Barton Wachs, Lot 72A-EF, 6 Outrider Road,
under Section 17.32.010 of the City of Rolling Hills Municipal Code
for a Variance from Section 17.16.070, side yard requirements subject
to the following conditions: 1) The side yard encroachment into the
minimum side yard on the north side of property, not exceed 3.5
feet; 2) The side yard encroachment into the minimum side yard
setback, on the south side of property, not exceed 4 feet. 3) The
existing asphalt access on the north side of property be removed and
replaced with landscaping; 4) The landscaping plan be approved by
the Planning Commission; and, a bond in the amount of estimate for
the cost of landscaping, plus 15%, be posted after landscape
installation, for not less than two years. It is, therefore,so
ordered.

THE ROLLING HILLS MUNICIPAL CODE .•
• THE CITYCOUNCIL' OF THE CITY OF ROLLING HILLS DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Title 17, Chapter 17.32.of the Rolling '
Hills_ Municipal Code is amended by adding a new Section 17.32.087
thereto to read:
17.32.087.. Affidavit.of Acceptance.
No conditional use permit or variance shall be
.effective for any purpose until the applicant executes
'an affidavit provided by the.City declaring that. the
applicant is aware. of and .accepts the.. conditions that
have been imposed upon -the permit or variance. Each
conditional use permit.. and variance granted shall
contain a condiiton to this effect.. The executed
affidavit shall be recorded with the County Recorder.

Dear Dr. and Mrs. Wachs:
This letter is to serve as official notice, pursuant to
Section 17.32.090 of the Rolling Hills Municipal Code, that your
request for a Variance for residence additions encroaching into
the side yards of Lot 72-AF, located at 6 Outrider Road in Rolling
Hills, was approved by the Planning Commission at.a regular meeting
on Tuesday, August 18, 1987, subject to the condition that on
the north side of the property a four foot encroachment into
the twenty foot side yard setback be permitted, and that the
existing asphalt surface on the northern portion of the property,
from the front of the residence to the rear of the new addition,
be removed and replaced with landscaping. An encroachment of
approximately five feet into the southerly side yard setback
has been approved, since it is less than the existing encroachment.
A formal report of the Commission's action is contained in the
minutes of the proceedings before the Planning Commission and
will be available to you after approval by the Commission.
The Planning Commisson's action will be reported to the
City Council at their next regular meeting on Monday, September
14, 1987 at 7:30 p.m., pursuant to Section 17.32.140 of the
Municipal Code. Please do not hesitate to call this office if
