ZONING CASE NO. 264
II.
The Commission finds that the applicant has requested a
Variance of Side Yard Requirements for an existing addition to his
residence. The Commission finds further that the applicant has
stated that the addition, which projects 8 1/2' into the side yard,
was
not
constructed before he purchased the property, and that he was
aware of the violation until he was contacted by the City and
advised that the construction was done without a permit of approval.
The Commission finds that a Variance should be granted in order to
preserve substantial property rights in the same vicinity and zone
and that the granting of such Variance would not be materially
detrimental to the public welfare, nor injurious to property in the
same vicinity and zone.
III.
From the foregoing it is concluded that a Variance of
Side Yard Requirements should be granted to Mr. William Thomas,
Lot 28-GF, 17 Johns Canyon Road, to bring construction of an
addition to the residence which projects 8 1/2'into the side yard
into conformance with requirements of the Zoning Ordinance, and
it is, therefore so ordered.
