264, To bring existing addition int, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application) ) of ) ) ) ) FINDINGS AND REPORT The application of Mr. William Thomas, Lot 28-GF, Georgeff Tract, for a Variance under Section 3.07, Side Yards, Ordinance No. 183, came on for hearing on the 21st day of April, 1981 in the Council Chambers of the Administration Building, 2 Portuguese Bend Raod, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of'Rolling Hills, California. I. The Commission finds that the applicant,, Mr. William Thomas, is the owner of that certain real property described as Lot 28-GF, located at 17 Georgeff Road in the City of Rolling Hills, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hi11s,California. The Commission finds, further,, that no comment, written or verbal, was received in favor of or in opposition to the request. Mr. William Thomas Lot 28-GF ZONING CASE NO. 264 II. The Commission finds that the applicant has requested a Variance of Side Yard Requirements for an existing addition to his residence. The Commission finds further that the applicant has stated that the addition, which projects 8 1/2' into the side yard, was not constructed before he purchased the property, and that he was aware of the violation until he was contacted by the City and advised that the construction was done without a permit of approval. The Commission finds that a Variance should be granted in order to preserve substantial property rights in the same vicinity and zone and that the granting of such Variance would not be materially detrimental to the public welfare, nor injurious to property in the same vicinity and zone. III. From the foregoing it is concluded that a Variance of Side Yard Requirements should be granted to Mr. William Thomas, Lot 28-GF, 17 Johns Canyon Road, to bring construction of an addition to the residence which projects 8 1/2'into the side yard into conformance with requirements of the Zoning Ordinance, and it is, therefore so ordered. irman, Plannin"Commission.
