We have a dangerous situation on Hackamore Road that is not getting better and may just get worse. I am writing to ask you to resolve this once and for all so that the residents of Hackamore Road can once again have a safe street on which to both drive and live. A new family moved into 4 Hackamore last summer. Since then, they have insisted on parking their vehicles, as well as those of their guests, in the street, usually while leaving their 3 car wide driveway completely empty. Please understand that they do not park half in the street and half in the dirt, but literally 100% in the driving lane, taking up the entire lane of our narrow road. This forces all of the residents of Hackamore Road, as well as all visitors, to cross completely over the median and drive their vehicles in the oncoming lane of traffic in order to leave the street. I have literally lost track of the number of close calls my wife and I have personally had when driving in the wrong lane in order to get past their vehicle(s), only to have someone turn right off Eastfield onto Hackamore before we could get past their car(s) and back into our lane. And on at least four occasions they have completely blocked the road to where we could not pass whatsoever. Rollins Hills Municipal Code Chapter 10.52.90 — Parking on Narrow Roads. states in full that "The City Manager is authorized to place signs or markings indicating no parking upon any road when the width of the roadway does not exceed twenty feet or upon one side of a road as indicated by such markings when the width of the roadway does not exceed thirty feet. When official signs or markings prohibiting parking are erected upon narrow roads as authorized herein, no person shall park a vehicle upon any such road in violation of any such sign or marking." Hackamore Road measures between 17 and 18 feet wide in front of 4 Hackamore. Our car is 8 feet wide. You do the math. The only way to get past 18 feet is to include both of the asphalt side berms/curbs that are there to direct water and are not driven on. Even when including both of them you cannot find a spot that measures more than 19 feet wide. At no point anywhere near 4 Hackamore Road does the road exceed 20 feet wide, which it must in order for on street parking. To us, the Municipal Code is very clear on this point. The road must exceed 20 feet wide in order for any street parking to be allowed. Furthermore, when a car is parked on the street, because there is no dirt walkway in front of 4 Hackamore, anyone walking up Hackamore is forced to pass these cars on the left (the driver's side) by walking in the oncoming traffic lane. I am told that our local fire department recently drove their truck down Hackamore Road at the request of the City Manager and reported back to him that the only way they could drive their fire truck on Hackamore Road is if there were no cars on the street. To me, this is the beginning and the end of the conversation. Public safety must be paramount in any discussion regarding parking or anything else. We have a street filled with small children and elderly adults. We have needed emergency vehicles on our street in the past and will certainly need them again in the future. They must be able to get to our homes both quickly and safely. I understand that the owners of 4 Hackamore either believe that parking their vehicles in the street is allowed until signs are posted, or they are planning on attempting to change our Municipal Code in order to allow them to legally park on the street. The purpose of this letter is to urge the City Council to do whatever it can to prohibit on street parking on Hackamore Road and protect this section of the Municipal Code as it is currently written. This includes posting "No Parking" signs on Hackamore Road and asking the sheriff to increase patrols on our street. The owners of 4 Hackamore recently demolished the house in order to build a new one. This is the ideal time for them to build off street parking in front of their property, just as a resident recently did around the corner on Eastfield. However, I am told that have no intention of doing so and instead will landscape their entire front easement and build stairs leading directly out to the street. In my opinion, this will encourage the exact street parking we want to eliminate. The sheriff has been called, pictures have been taken and tickets have been written. However, we are seeking a more permanent resolution to this issue. I believe "No Parking" signs would put an end to the issue once and for all. Off street parking built into their landscape plan would also help as well as would the elimination of stairs that lead directly out to the street. I am not aware of all the tools at your disposal but I would encourage you to use as many as possible, as soon as possible, to help us make our street once again safe to drive on, accessible for emergency vehicles and to preserve that rural feeling that we have all come to appreciate within our City. The Lind Use Element of the General Plan establishes the maintenance of strict grading practices to preserve the community's natural terrain. The Building Code and the Zoning Ordinance require a balanced cut and fill ratio and do not permit import or export of soil, except under special circumstances applicable to „ property or with a discretionary permission by the Planning; Commission, Due, to the location of the proposed new stable, the topography of the lot and existing development and, in order to provide access to the stable and corral, the grading is necessary. The grading of 332 cubic yards of cut and fill is the minimum necessary to provide the required stable access. 13, The proposed activity preserves and integrates into the site design, t0 the maximum extent feasible, existing natural topographic features of the lot including surrounding native vegetation, mature frets, drainage courses, and land -forms (such as hillsides and knolls). Although gradi tg ict.ivity is necessary to construct the stable access road, the grading is proposed to follow the existing slope of the land. The development plan substantially preserves the natural and undeveloped state of the ,lot, as the corral area will be left as open space, and enhances it by additional landscaping, which is a requirement of this resolution. Significant portions of t e lot will be left undeveloped so.as to maintain open space on the property. The Planning Commission found that the approved location is most desirous in that it will not require great amount of grading, is in an area of the lot to the rear of and away from the residence and will not he visible from f: fackamore Road. C. The nature, condition, and development of adjacent uses, buildings, and structures and the topography of the lot hive been considered, and the construction of the access road to the stable and corral will not adversely affect or be materially detrimental to the adjacent uses, buildings, or structures because the proposed project will be constructed on a portion of the lot which is least intrusive to surrounding properties, will be screened and landscaped with trees rind shrubs, is a sufficient distance from nearby residences and the street so that the proposed construction will not impact: the view or privacy of surrounding neighbors, and will permit the owners to enjoy their property without deleterious infringement on the rights of surrounding property owners. D. The proposed access road is a harmonious use and will bleed with the natural terrain and surrounding residences. The proposed project is consistent with the scale of the neighborhood. Section 17.16.200(1) of the Rolling Hills Municipal Code permits approval of a; freestanding; storage structure exceeding 120 square feet under certain conditions, provided the .Manning Commission approves a Conditional Use Permit. \Vith respect to this request for a Conditional Use Permit, the Planning Commission finds as follows regarding the proposal to retain an existing 728 square foot storage building that was originally approved as a stable: A. • The granting of a Conditional Use Permit for the storage structure is ctisistent. with the purposes and objectives of the Zoning Ordinance and General Plan because the use is consistent ivith similar uses in the community, meets all the applicable development standards of the Zoning Ordinance, no grading is requested and no deviations from the development standards are requested. 13. The nature, condition, and development of adjacent uses, buildings, and structures have been considered, and the retention of a storage structure will not adversely affect or be materially detrimental to these. adjacent uses, buildings, or structures because the storage structure is located to the rear and away from other ancillary uses of the residence and is of sufficient distance from nearby residences so as to not impact the view or privacy of surrounding neighbors. C:. The project is harmonious in scale and mass with the site, the natural terrain, and surrounding residence's because the storage structure e-oniplies with the low profile residential development pattern of the community and is screened from neighbors' view. D. The proposed conditional use complies with all applicable•development standards of the zone district because the 726 square foot size of the storage structure does not exceed the maximum permitted under the 'Iunicipal Code and the storage structure does not encroach into any setback areas and is not located in the front. 13, The proposed conditional use is consistent with tti, portions of the Los Angeles County 1liaardous Waste Management Plan relating to siting criteria for hazardous waste facilities bc;eause the project site is not: lkted un the carrent State of California hazardous Waste and Substances Sites Resolution 2008 21 • I.C. NO, 764 3 F. The proposed conditional use observes the spirit and intent of Title 17 of the Zoning Code because in addition to retaining the subject structure for storage, the applicant concurrently proposes to con3truct a new stable and related access road, thereby eliminating the need to reserve the subject storage structure for a stable use as it was originally approved. No grading or additional disturbance is necessary to continue the existing storage use. The structure is screened from adjacent properties and is not obtrusive to neighbors. Sectionl Based upon the foregoing findings in sections 5 and 6 of this Resolution, the Planning Commission hereby approves the Site Plan Review and Conditional Use Permit in Zoning Case No. 764 for, respectively, grading of 332 cubic yards or cut and fill (balanced), a 5-foot wall and keeping the 728 square foot former stable as a storage structure, subject to the following conditions: A.he Site Plan and Conditional Use Permit approvals shall expire, within two years from the effective date of approval if work has not commenced as defined in Sections 1.7.12.070(A) and 17.4 of the Zoning Ordinance, unless otherwise extended pursuant to the requirements of tilese sections. It is declared and made a condition of the approval, that if any conditions thereof are violated, this approval shall be suspended and the privileges granted thereunder shall lapse; provided that the City has given the applicants written notice to cease such violation, the opportunity for a hearing has been provided, and if requested, has been held, and thereafter the applicant fails to correct the violation within a period of thirty (30) days from the date of the City's determination. C. All requirements of the Building and Construction Ordinance, the Zoning Ordinance, and of the zone in which the subject property is located must be complied with unless otherwise set forth in the permit, or shown otherwise on an approved plan. Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable. Bracing should be provided. Lumber, wire or other suitable material should be used to delineate roof ridges and eaves. Flags in close proximity to each other must be attached to the wire or twine to aid in the visualization of the proposed construction. Property lines, setback lines and easement lines must be staked along the areas of construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must be flagged and marked on their sides: • Property line ( red or pink flag) • Setback line (green flag) • Easement line (yellow flag) and remain in the ground throughout the entire review and approval process as well as during the entire construction process, when required by the Commission.
