Dear Mr. Noel:
This is to inform you that the City Council at their December 17, 2008 meeting
received and filed the Planning Commission's decision in your application.
The decision shall become effective thirty days after the adoption of the
resolution by the Planning Commission, unless an appeal has been filed to the
City Council within that thirty (30) day appeal period. (Section 17.54.010(B) of
the Rolling Hills Municipal Code). Should there be an appeal, the Commission's
decision will be stayed until the Council completes its proceedings in accordance
with the provisions of the Municipal Code.
Before this case takes effect you are required to record an Affidavit of Acceptance
Form together with the subject resolution in the Office of the County Recorder.
The approval is valid for two years, with the opportunity to request an up to
two-year extension. The request must be made in writing prior to the expiration
of the approval. The approval becomes null and void if work has not
commenced within the specified period of time.
Enclosed is a copy of RESOLUTION NO. 2008-21, specifying the conditions of
approval set forth by the Planning Commission. The approval will not become
effective until you complete the enclosed AFFIDAVIT OF ACCEPTANCE
FORM, have the signature(s) notarized, and forward (or hand deliver) the
completed form and a copy of the Resolution to:

The City will notify the Los Angeles County Building & Safety Division to issue
permits only after the Affidavit of Acceptance and the Resolution are recorded
and received by the City and any conditions of the Resolution required prior to
issuance of building permits are met.
As you go through the development process, please be aware of the conditions of
the Resolution, as there are conditions that have to be met at different stages of
the process. Please assure that your contractor adheres to these conditions. Also,
be advised that no grading permit will be issued for the access to the stable pad,
until the stable is approved by the City, Rolling Hills Community Association
and the Building and Safety Department (either LA County or Willdan
Consultants), and that you are either to provide a 4-foot dirt path along the side
of your driveway off of Hackamore, or show an alternate access to the future
stable along the adjacent easement and existing trail and have it approved by the
Rolling Hills Community Association.
In addition, as discussed with you before, you must obtain a building permit
for the repair of the existing deck.

THE PLANNING COMMISSION OF THE CITY OF ROLLING I-ILLLS
DOES HEREBY FIND, RESOLVE AND O1'.DLR AS FOLLOWS:
Section 1. An application was duly filed by Mr. Gregory Noel with respect
to real property located al 8 Llackamore Road (Lot 29-B-EF), Rolling Hills, CA
requesting a Site Plan Review for grading of 332 cubic yards of cut and 332 cubic
yards of fill for an access road to a proposed stable and corral, construction of a 5-foot
future stable wall, and a Conditional Use Permit to retain an existing 728 square foot
detached storage building that was previously approved as a stable. The subject
property is developed with a single-family residence.
Section 2. The Planning Commission conducted duly noticed public
hearings to consider the application on October 21, 2008, November 18, 2008,
December 9, 2008, and at a field trip visit on November 18, 2008. The applicants were
notified of the public hearings in writing by first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal and from members of
the City staff and the Planning Commission having reviewed, analyzed and studied
said proposal. The applicants' representative was in attendance at the hearings. On
November 18, 2008, the Planning Commission directed staff to prepare a resolution of
ap:rival for the Site Plan Review for wall and grading of 332 cubic yards of cut and
fill to provide an access pathway to a proposed 1,750 square foot stable with 864
square fool loft, subject to conditions. 1h, proposed stable access is proposed to
extend from the end of the existing paved rn,iin driveway serving the residence. The
Planning Commission concurrently granted approval of a Conditional Use Permit to
allow the applicant to retain an existing detached storage building on the premises.
Section 3. The property is zoned RAS-1 and consists of 3.01 acres gross and
2.38 acres (103,760 s.t.) net lot area for development purposes. The property fronts on
the cul-de-sac on Hackamore Road and is developed with a 4,160 square foot
residence, 440 square foot garage, 480 square foot swimming pool, pool equipment,
service yard, above ground deck and 728 square foot detached storage structure
originally approved as a stable and located to the rear of the residence.
Section 4, The Planning Commission finds that the project qualifies as a
Class 3 Exemption (The State of CA Guidelines, Section 15303) and is therefore
categorically exempt from environmental review under the California Environmental
Quality Act.

We have a dangerous situation on Hackamore Road that is not getting better and may just
get worse. I am writing to ask you to resolve this once and for all so that the residents of
Hackamore Road can once again have a safe street on which to both drive and live.
A new family moved into 4 Hackamore last summer. Since then, they have insisted on
parking their vehicles, as well as those of their guests, in the street, usually while leaving
their 3 car wide driveway completely empty. Please understand that they do not park half
in the street and half in the dirt, but literally 100% in the driving lane, taking up the entire
lane of our narrow road. This forces all of the residents of Hackamore Road, as well as
all visitors, to cross completely over the median and drive their vehicles in the oncoming
lane of traffic in order to leave the street. I have literally lost track of the number of close
calls my wife and I have personally had when driving in the wrong lane in order to get
past their vehicle(s), only to have someone turn right off Eastfield onto Hackamore
before we could get past their car(s) and back into our lane. And on at least four
occasions they have completely blocked the road to where we could not pass whatsoever.
Rollins Hills Municipal Code Chapter 10.52.90 — Parking on Narrow Roads. states in full
that "The City Manager is authorized to place signs or markings indicating no parking
upon any road when the width of the roadway does not exceed twenty feet or upon one
side of a road as indicated by such markings when the width of the roadway does not
exceed thirty feet. When official signs or markings prohibiting parking are erected upon
narrow roads as authorized herein, no person shall park a vehicle upon any such road in
violation of any such sign or marking."
Hackamore Road measures between 17 and 18 feet wide in front of 4 Hackamore. Our
car is 8 feet wide. You do the math. The only way to get past 18 feet is to include both
of the asphalt side berms/curbs that are there to direct water and are not driven on. Even
when including both of them you cannot find a spot that measures more than 19 feet
wide. At no point anywhere near 4 Hackamore Road does the road exceed 20 feet
wide, which it must in order for on street parking. To us, the Municipal Code is very
clear on this point. The road must exceed 20 feet wide in order for any street parking to
be allowed. Furthermore, when a car is parked on the street, because there is no dirt
walkway in front of 4 Hackamore, anyone walking up Hackamore is forced to pass these
cars on the left (the driver's side) by walking in the oncoming traffic lane.
I am told that our local fire department recently drove their truck down Hackamore Road
at the request of the City Manager and reported back to him that the only way they could
drive their fire truck on Hackamore Road is if there were no cars on the street. To me,
this is the beginning and the end of the conversation. Public safety must be paramount
in any discussion regarding parking or anything else. We have a street filled with small
children and elderly adults. We have needed emergency vehicles on our street in the past
and will certainly need them again in the future. They must be able to get to our homes
both quickly and safely.
I understand that the owners of 4 Hackamore either believe that parking their vehicles in
the street is allowed until signs are posted, or they are planning on attempting to change
our Municipal Code in order to allow them to legally park on the street. The purpose of
this letter is to urge the City Council to do whatever it can to prohibit on street parking
on Hackamore Road and protect this section of the Municipal Code as it is currently
written. This includes posting "No Parking" signs on Hackamore Road and asking the
sheriff to increase patrols on our street.
The owners of 4 Hackamore recently demolished the house in order to build a new one.
This is the ideal time for them to build off street parking in front of their property, just as
a resident recently did around the corner on Eastfield. However, I am told that have no
intention of doing so and instead will landscape their entire front easement and build
stairs leading directly out to the street. In my opinion, this will encourage the exact street
parking we want to eliminate.
The sheriff has been called, pictures have been taken and tickets have been written.
However, we are seeking a more permanent resolution to this issue. I believe "No
Parking" signs would put an end to the issue once and for all. Off street parking built
into their landscape plan would also help as well as would the elimination of stairs that
lead directly out to the street.
I am not aware of all the tools at your disposal but I would encourage you to use as many
as possible, as soon as possible, to help us make our street once again safe to drive on,
accessible for emergency vehicles and to preserve that rural feeling that we have all come
to appreciate within our City.

Section 5. Section 17.46,020(A)(1) requires a Site Plan Review for grading
projects that require a grading permit. The applicants propose to grade 332 cubic
Wards of cut and 332 cubic yards of fill required for a new acc:es:s road to Serve a
proposed 1,75() square foot stable with 1 6.1 square foot loft:, and corral. With respect to
the Site Plan IZevieiv application for the grading work, the Planning Commission
males the following fincting;s of tact:
A. 3'hc proposed activity is compatible with the General Plan and the
Zoning; Ordinance in that an equestrian ase and activity is being proposed that tvi11
preserve the distinctive rural residential character of the City.. The Lind Use Element
of the General Plan establishes the maintenance of strict grading practices to preserve
the community's natural terrain. The Building Code and the Zoning Ordinance
require a balanced cut and fill ratio and do not permit import or export of soil, except
under special circumstances applicable to „ property or with a discretionary
permission by the Planning; Commission, Due, to the location of the proposed new
stable, the topography of the lot and existing development and, in order to provide
access to the stable and corral, the grading is necessary. The grading of 332 cubic
yards of cut and fill is the minimum necessary to provide the required stable access.
13, The proposed activity preserves and integrates into the site design, t0 the
maximum extent feasible, existing natural topographic features of the lot including
surrounding native vegetation, mature frets, drainage courses, and land -forms (such
as hillsides and knolls). Although gradi tg ict.ivity is necessary to construct the stable
access road, the grading is proposed to follow the existing slope of the land. The
development plan substantially preserves the natural and undeveloped state of the
,lot, as the corral area will be left as open space, and enhances it by additional
landscaping, which is a requirement of this resolution. Significant portions of t e lot
will be left undeveloped so.as to maintain open space on the property. The Planning
Commission found that the approved location is most desirous in that it will not
require great amount of grading, is in an area of the lot to the rear of and away from
the residence and will not he visible from f: fackamore Road.
C. The nature, condition, and development of adjacent uses, buildings, and
structures and the topography of the lot hive been considered, and the construction of
the access road to the stable and corral will not adversely affect or be materially
detrimental to the adjacent uses, buildings, or structures because the proposed project
will be constructed on a portion of the lot which is least intrusive to surrounding
properties, will be screened and landscaped with trees rind shrubs, is a sufficient
distance from nearby residences and the street so that the proposed construction will
not impact: the view or privacy of surrounding neighbors, and will permit the owners
to enjoy their property without deleterious infringement on the rights of surrounding
property owners.
D. The proposed access road is a harmonious use and will bleed with the
natural terrain and surrounding residences. The proposed project is consistent with
the scale of the neighborhood.

E. The development plan will be based upon compliance with the
conditions contained in this Resolution, supplement the existing vegetation with
landscaping that is conpatib.ic with and enhances the rural character of the
community.
F. The proposed development is sensitive and not. eletrirwent<tl to the
convenience and safety of circulation for pe'ciestr'aus and vehicles on the subject site in
that the slope of the new access road between the home and proposed stabie is limited
to 2.5% maximum ;,lope ;Ind will have a sur:ace treaanent suitable for equestrian use.
The project contornts to the requirements of the California
Environmental Quality Act and is exempt from its requirements.
Section ti. Section 17.16.200(1) of the Rolling Hills Municipal Code
permits approval of a; freestanding; storage structure exceeding 120 square feet under
certain conditions, provided the .Manning Commission approves a Conditional Use
Permit. \Vith respect to this request for a Conditional Use Permit, the Planning
Commission finds as follows regarding the proposal to retain an existing 728 square
foot storage building that was originally approved as a stable:
A. • The granting of a Conditional Use Permit for the storage structure is
ctisistent. with the purposes and objectives of the Zoning Ordinance and General Plan
because the use is consistent ivith similar uses in the community, meets all the
applicable development standards of the Zoning Ordinance, no grading is requested
and no deviations from the development standards are requested.
13. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the retention of a storage structure will not
adversely affect or be materially detrimental to these. adjacent uses, buildings, or
structures because the storage structure is located to the rear and away from other
ancillary uses of the residence and is of sufficient distance from nearby residences so as
to not impact the view or privacy of surrounding neighbors.
C:. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residence's because the storage structure e-oniplies with the
low profile residential development pattern of the community and is screened from
neighbors' view.
D. The proposed conditional use complies with all applicable•development
standards of the zone district because the 726 square foot size of the storage structure
does not exceed the maximum permitted under the 'Iunicipal Code and the storage
structure does not encroach into any setback areas and is not located in the front.

F. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because in addition to retaining the subject structure for storage, the
applicant concurrently proposes to con3truct a new stable and related access road,
thereby eliminating the need to reserve the subject storage structure for a stable use as
it was originally approved. No grading or additional disturbance is necessary to
continue the existing storage use. The structure is screened from adjacent properties
and is not obtrusive to neighbors.
Sectionl Based upon the foregoing findings in sections 5 and 6 of this
Resolution, the Planning Commission hereby approves the Site Plan Review and
Conditional Use Permit in Zoning Case No. 764 for, respectively, grading of 332 cubic
yards or cut and fill (balanced), a 5-foot wall and keeping the 728 square foot former
stable as a storage structure, subject to the following conditions:
A.he Site Plan and Conditional Use Permit approvals shall expire, within
two years from the effective date of approval if work has not commenced as defined
in Sections 1.7.12.070(A) and 17.4 of the Zoning Ordinance, unless otherwise
extended pursuant to the requirements of tilese sections.
B. It is declared and made a condition of the approval, that if any conditions
thereof are violated, this approval shall be suspended and the privileges granted
thereunder shall lapse; provided that the City has given the applicants written notice
to cease such violation, the opportunity for a hearing has been provided, and if
requested, has been held, and thereafter the applicant fails to correct the violation
within a period of thirty (30) days from the date of the City's determination.
C. All requirements of the Building and Construction Ordinance, the Zoning
Ordinance, and of the zone in which the subject property is located must be complied
with unless otherwise set forth in the permit, or shown otherwise on an approved
plan. This shall include, but not be limited to, the requirements of the Outdoor
Lighting Ordinance, Undergrounding of Utilities Ordinance, Root ...,:oyering
Ordinance, requirements for access to shble,:;, and others,
D. The 728 square foot storage structure shall be used exclusively for
incidental residential storage and shall not be converted to other uses, unless

I am assisting the City of Rolling Hills Planning Department with pending cases
involving non -permitted construction activities. My objective is to assist property owners
in obtaining all necessary approvals and in complying with applicable zoning and
building code regulations.
I am following up to a letter to you dated March 13, 2009 in which you were informed
that a building permit is required for the reconstruction/repair of a pre-existing deck on
your property (copy attached). Subsequently a site plan showing the deck location and
size was submitted and approved on April 10, 2009 by the City Planning Director and
Rolling Hills Community Association (copy attached). However, after obtaining these
approvals, it appears that you have not taken the next step in submitting an application for
a building permit.
The County Building and Safety Permit Office has informed that you have submitted
other permit applications including No. 0704100007 for a new barn and No. 0904230001
for related grading/drainage improvements. The plans for these applications are now in
the process of being checked by the County for building code compliance.
Please be aware that issuance of permits for the new barn and grading will be withheld
until the required permit for the deck repair/reconstruction work is issued. Please make
sure that when you submit an application for the deck, you also provide a copy of the
attached site plan as it provides evidence of the City zoning and RHCA approvals. It is
likely that the County may required more detailed plans of the deck construction, and you
are encouraged to contact the Permit Office at (310) 534-3760 if you have any questions
about application requirements.
In addition to the deck permit issue, the City has also observed that you have erected
multiple metal archways along and extending over your existing driveway, within the

front yard area of your property. The Planning Department has determined that each arch
is a "structure" that requires a building permit as well as zoning approval.
Notwithstanding concerns that the arches may not comply with County Fire Department
standards, it has been determined that, due to their number, location and overall design,
the arches are prohibited, pursuant to Section 17.16.150 of the Rolling Hills Zoning
Ordinance (Structures and driveways permitted in setbacks). You are hereby directed to
remove the arch structures nolater than August 22. 2009.

As we have discussed previously, it has come to the City's attention that remodel work
and reconstruction of a deck took place or is taking place at your residence. The Building
inspector issued a "Stop Work" order several weeks ago with instructions that you stop
all work and contact City staff for permission and obtain building permits for the
construction.
Subsequently, I left a couple of messages on your phone, the latest on March 11, 2009 to
remind you of the requirements and to contact me. I have not heard from you, nor is there
evidence that you have obtained a building permit for the deck or the remodel.
Please be advised that any remodeling and/or repair work of any structure in the City of
Rolling Hills, including decks, require Planning Department approval and a building
permit. In addition, the Rolling Hills Community Association has separate requirements
for construction and they must also approve all work.
We appreciate you immediately ceasing all work on your property and submitting to us a
plan showing the deck and scope of remodel by March 24, 2009.
Should there be a need to issue a second stop work order, pursuant to the authority of the

This letter shall serve to notify you that the Planning Commission at their regular
meeting on November 18, 2008 directed staff to prepare a resolution, with
conditions, to approve your request in Zoning Case No. 764. However, the
Commission kept the public hearing open, so that your representative may
provide additional information as requested bv the Planning Commission
including plans showing:
• cross sections of the graded areas, (access road);
• slope grading study showing that the access to the proposed stable will
not be more than 25% along the entire access road and that the grading
will be balanced on site;
• a 4-foot dirt path along the existing driveway for horse passage;

The Commission will consider this resolution at their DECEMBER 9, 2008
meeting beginning at 6:30 PM. (Please note the change of date of the Planning
Commission meeting).
The resolution with findings and conditions of approval will be forwarded to
you prior to the next Planning Commission meeting. Please review the
conditions of approval when you receive the staff report.
The Planning Commission decision shall become effective thirty days after the
adoption of the resolution unless an appeal has been filed by you, any interested
party or the City Council takes jurisdiction of the case within that thirty (30) day
appeal period. (Section 17.54.010(B) of the Rolling Hills Municipal Code). Should
there be an appeal, the Commission's decision will be stayed until the Council
completes its proceedings in accordance with the provisions of the Municipal
Code.
The Planning Commission action, accompanied by the records of the
proceedings will be presented to the City Council as a report item on their
agenda at the Council's regular meeting following the Commission's approval.

The Planning Commission scheduled a field inspection of your property to view a
silhouette of the proposed project on Tuesday. November 18. 2008. at about 2:45 -
3:00 PM.
The Commission will visit another property, beginning at 2 PM, before visiting your site.
The owner and/or representative must be present to answer any questions regarding the
proposal. Please call me at (310) 377-1521 if you have any questions.
The site is to be prepared according to the enclosed Silhouette Construction Guidelines
and the following requirements. Please note that inadequate staking may result in
postponement of the case to another month.
• A full-size silhouette in conformance with the attached
guidelines must be prepared for the proposed access to
the stable;
• Stake the proposed wall behind the stable;
• Show the location of the drainage device (dissipater);
• Show/delineate the property line, setback line and
easement line in vicinity of the access road.
• Delineate limits of grading
• Although not mandatory, we would appreciate if you
would stake the corners of the proposed stable and the
highest point of the loft.
• The staking shall be done a minimum of 5-7 days prior to
the field trip, so that neighbors who may be away during
the field trip visit would be able to view the silhouette
and comment to the City prior to the meeting. The
staking must remain on the property during the entire
review process of this case, including City Council's
review. It is. therefore, imperative that the

SILHOUETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.
