FINDINGS AND REPORT
Zoning Case No. 368
The application of Mr. & Mrs. Thomas Vick, Lot 994-RH, Rolling
Hills Tract, for a Variance under Section 17.32.010 of the City of
Rolling Hills Municipal Code, came for hearing on the 30th day of
August, 1988, and the 20th day of September, 1988, in the Council
Chambers of the Administration Building, 2 Portuguese Bend Road,
Rolling Hills, California. The Planning Commission, after being
properly advised, now makes its Findings and Report as required by
the Municipal Code of the City of Rolling Hills, California.
I.
The Commission finds that the applicants, Mr. & Mrs. Thomas
Vick, are the owners of that certain real property described as Lot
994-RH, located at 2720 Palos Verdes Drive North in the City of
Rolling Hills, and that notice of the public hearing in connection
with said application was given as required by Section 17.32.080 of
the Municipal Code of the City of Rolling Hills, California. The
Commission finds, further, that verbal comment, was received in
support of the request. Further, that there was no comment in
opposition to the request.

II.
The Commission finds that the applicants have requested a
Variance from Section 17.08.170 lot line delineation (front, side and
rear). The property is a conforming lot of 2.08 net acres (90,706
sq. ft.) in size, which is located in the RAS - 1 zone (43,560 sq.
ft.). The lot fronts on Palos Verdes Drive North.

However, access is taken from a forty (40') wide private roadway
easement which provides access to three (3) other properties. The
property of the applicants is developed in a manner that has the
private roadway functioning as the front lot line and Palos Verdes
Drive North as the side lot line. Therefore, the applicants request
the granting of the Variance to redesignate the front, side and rear
lot lines so that they may have the same rights to property as others
in the same vicinity and zone, which would otherwise be denied if
they were not able to fully utilize the existing building area. The
applicants assert that there are significant physical conditions
which exist on the property due to the public (Palos Verdes Drive
North) and private roadway configuration which impinge upon the
applicants' ability to fully utilize their property. The applicants
assert that a Variance should be granted in order to preserve
substantial property rights in the same vicinity and zone, and that
the granting of such Variance would not be materially detrimental to
the public welfare, nor injurious to property in the same vicinity
and zone.

From the foregoing, it is concluded that a Variance should be
granted to Mr. & Mrs. Thomas Vick, Lot 994-RH, 2720 Palos Verdes

Drive North, under Section 17.32.010 of the City of Rolling Hills
Municipal Code for a Variance from Section 17.08.170 lot line
delineation (front, side and rear) subject to the following
conditions. Page Three
1) The westerly property line shall be designated as the
front lot line, the southerly and northerly (PVDN) property lines as
the side lot lines, and the easterly property line as the rear lot
line.
2) The only type of building permitted in the Palos Verdes
Drive North side yard is a stable or barn which can be used solely
for the quartering of horses or livestock; any other type is
prohibited; and,
3) Any building, per Condition No. 1 above, constructed in
the Palos Verdes Drive North side yard cannot be located closer than
fifty feet (50') from the Palos Verdes Drive North roadway easement
and/or right-of-way line; and,
4) Any building constructed, per Condition No. 1 above,
constructed cannot be located closer than fifty feet (50') from the
private roadway easement line; and,
5) A landscape plan be approved by the City with emphasis on
screening any building from Palos Verdes Drive North; and, a bond in
the amount of the estimate of cost of landscaping, plus 15%, be
posted after landscape installation, for not less than two years;
and,

6) The Variance approval be contingent upon the approval of
the applicants' architectural plans by the Rolling Hills Community
Association Architectural Committee; and,
This project is categorically exempt under the California
Environmental Quality Act.
It is, therefore, so ordered.
