Attached is a request by Mr. Franz Fischer for a one-year time
extension for a Variance to permit a substantial amount of
previously imported soil to remain on the subject lot, and a
Variance to permit the previously constructed retaining walls that
encroach into the front yard setback to remain. The Planning
Commission approved these Variances on December 7, 1991 (Resolution
No. 91-31).
Mr. Fischer is also requesting a one-year time extension for Site
Plan Review to construct a stable on the subject property approved
by the Commission on January 11, 1992 (Resolution No. 92-4).
Mr. Fischer says he has been unable to complete the projects
because of unforeseen business circumstances requiring his full
attention and frequent travel.
RECOMMENDATION
It is recommended that the Planning Commission review the requested
time extensions.

THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND,. RESOLVE AND ORDER AS FOLLOWS:
Section 1. Applications were duly filed by Mr. Franz Fischer
with respect to real property located at 2862 Palos Verdes Drive
North, Rolling Hills (Lot 992-A-RH) requesting a Variance to permit
470 cubic yards of previously imported fill soil to remain at the
subject lot, requesting a Variance to permit the previously
constructed retaining walls to encroach within the front yard
setback and requesting a Variance to permit the construction of a
stable less than the required distance from a property line. The
applications were_submitted_as the.result of City and County Code
Enforcement.
Section 2. The Planning Commission conducted a duly noticed
public hearing to consid7r the applications on October 22, 1991 and
November 19, 1991 and a+ a field trip visit on November 2, 1991.
Section 3. The Planning Commission finds that the project is
categorically exempt from environmental review under the California
Environmental Quality Act.
Section 4. Sections 17.32.010 through 17.32.030 permit
approval of a Variance from the standards and requirements of the
Rolling Hills Municipal Code when exceptional or extraordinary
circumstances applicable to the property and not applicable to
other similar properties in the same zone prevent the owner from
making use of a parcel of property to the same extent enjoyed by
similar properties. A Variance to Section 15.04.141 is requested
to permit 470 cubic yards of previously imported fill soil to
remain at the subject property. With regard to this request, the
Planning Commission makes the following findings:
A. There are exceptional.or extraordinary circumstances and
conditions applicable to the property and the intended use that do
not apply generally to the other property in the same vicinity and
zone. The Variance is necessary in order to increase the .size of
the building pad as as to create open space around the residential
structure for access and for landscaping purposes. The existing
residential structure is constructed close to the edge of the
slope, such that without enlargement of the building pad, the

surrounding residences.
B. The Variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone, but which is denied the
property in question. The Variance is necessary in order to
provide a natural landscaped buffer between the house and roadway
and to provide open space area around the structure as required of
other properties in the community. In addition, removal of the
imported soil would despoil the subject property and interrupt the
use of driveway easements serving adjacent residences.
C. The grar:tina of the Variarce will not be materially
detrimental to the public welfare or injurious to the property or
improvements in the vicinity and zone in which the property is
located because it does not interfere with the use of adjacent
driveway easements, will provide a buffer between the existing
residence and roadway, and will provide open space area for access
around the structure., The Variance will provide improved
engineering and grading to the sutler`. property and the surrounding
properties and residences. -
Section 5. Based.upon the foregoing findings, the Planning
Commission hereby approves the Variance to permit 470 cubic yards
of previously' imported soil to remain in the front yard as

subject to the conditions specified in Section 10 below.
Section 6. Section 17.28.022 requires that required yards be
maintained unoccupied from the ground up of any structures. The
applicant is requesting a Variance to encroach up to 50 feet into
the 50 foot front yard setback to construct two retaining walls, a
total of 181 feet in length, that will not be more than 32 inches
in height at any one point. The Planning Commission finds as
follows:
A. There are exceptional or extraordinary circumstances and
conditions applicable to the property and the intended use that de

zone. The Variance for the retaining wall is necessary to support
the hillside slope and to improve the geologic stability of the
site.
B. The Variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone, but which is denied the
property in question. The Variance is necessary because the
existing retaining wall will provide stability and support for the
hillside at 2862 Palos Verdes Drive North.

located. The Variance will permit the construction of a retaining
wall which will provide improved engineering and drainage to the
subject property and the surrounding properties and residences.

Section 7. Based upon the foregoing findings, the Planning
Commission hereby approves the Variance to permit the two
previously constructed 181 foot long retaining walls to encroach up
to 50 feet within the front yard setback not to exceed 32 inches in
height at any one point , subject to the conditions specified in
Section 10.
Section 8. A Variance to Section 17..16.011.0 is requested to
permit the construction of a stable 17 feet from the property line
which is less than the 25 foot required distance permitted. With
regard to this request, the Planning Commission makes the following
findings:
A. The granting of the request to locate a stable 17 feet
from the property line would not be consistent with the purposes
and objectives of the Zoning Ordinance and General Plan, and would
not be desirable to the public convenience and welfare because it
is not similar and compatible with neighboring developments.
/ E. The proposed stable plan does not preserve the natural
and undeveloped state of the lot because it is too close to the
rear property line-. .
C. The Variance will not be necessary for the preservation
and enjoyment of a substantial property right possessed by other
property in the same vicinity and zone, but which is denied the
property in question.
Section 9. Based upon the foregoing findings, the Planning
Commission hereby .denies the e =t for the construction of e
stable 17 feet from the rear property line as indicated on'the
Development Plan attached hereto as Exhibit A.
Section 10. The Variance approvals specified in Sections 5
and 7 are based upon the following conditions:
A. The Variance shall expire unless used within one year
from the effective date of approval as defined in Section 17.3.2.110
of the Municipal Code.

B. It is declared;and made a condition of the Variance
approvals that if any conditions are violated, the Permit shall be
suspended and the privileges granted thereunder shall lapse,
provided that the applicant has been given written notice to cease
such violation and has failed to do so for a period of thirty ( 30
days.
C. All requirements of. the Buildings and Construction
Ordinance, the Zoning Ordinance and of. the zone in which the
subject property is located must be complied with unless otherwise
set forth in the Permit or shown otherwise on an approved plan.
D. The retaining wall incorporated into the front yard
setback shall not be greater than 32 inches in height at any point
along the easement or driveway.
E. The driveway and retaining walls shall be s.creened and
and shielded from view with native drought -resistant vegetation to
minimize the view from the residences at the North. •
F. A.Los Angeles County grading permit shall be required.
G. Fill slopes shall not exceed a steepness of two
horizontal to one vertical, or exceed a vertical height of thirty
(30) feet.
H. The project must be reviewed and approved by the Rolling
Hills Community Association Architectural Review Committee prior to
the issuance of any grading permit.
I. The applicant shall Pxe'ute an Affidavit of Acceptance
of all conditions of this Variance. pursuant to Section 17.32.087,
or the approval shall not be effective.
J. The working drawings submitted to the County Department
of Building and Safety for plan check review must conform to the
Development Plan approved with this application.
K. All conditions of this Variance approval, except for
Paragraphs (D)and (E) must be complied with prior to the issuance
of a grading permit from the County of Los Angeles.

THE CONSTRUCTION OF A STABLE ON A LOT IMPROVED WITH AN
EXISTING SINGLE FAMILY RESIDENCE IN ZONING CASE NO. 468.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. Franz Fischer
with respect to real property located at 2862 Palos Verdes Drive
North, Rolling Hills (Lot 992-A-RH) requesting Site Plan Review
approval for a proposed new stable and residential additions to an
existing single family residence. After the denial of a Variance
requesting a permit to construct a stable less than the required
distance from a property line, stable plans were revised to comply
with the Zoning Code and the applicant withdrew the request for
residential additions.
Section 2. The Planning Commission conducted a duly noticed
public hearing to consider the application on October 22, 1991.,
November 19, 1991, and December 17, 1991, and at a field trip visit
on November 2, 1991.
Section 3. The Planning Cc^;^nission Finds that the project is
categorically exempt from environmental review under the California
Environmental Quality Act.
Section 4. Section 17.34.010 requires a development plan to
be submitted for site plan review and approval before any building
or structure may be constructed or any expansion, addition,
alteration or repair to existing buildings may be made which
involve changes to grading or an increase to the size of the
building or structure by more than twenty -'five percent (25%) in,any
thirty-six month period.
Section 5. The Planning Commission makes the following
findings of fact:
A. The proposed development is compatible with the General
Plan, the Zoning Ordinance and surrounding uses because the
proposed structure complies with the General Plan requirement of
low profile, low density residential development with sufficient
open space between surrounding structures. The project conforms to
Zoning Code setback and lot coverage requirements. The lot has a
net square foot area of 37,080 square feet. The existing residence
and garage (3,560 sq.ft.), swimming pool (640 sq.ft.), and proposed
stable (800 sq.ft.) will have 5,000 square feet which .constitutes
13.5 of the lot which is within the maximum 20% structural lot
coverage requirement. The total lot coverage including paved areas
and driveway will be 11,276 square feet which equals 30.4% of the
lot, which is within the 35% maximum overall lot coverage

requirement. The proposed pro;ect is on a relatively large lot
with most of the proposed structures located away from the road so
as to reduce the visual impact of the development and is similar
and compatible with several neighboring developments.
B. The proposed development preserves and integrates into
the site design, to the maximum extent feasible, existing natural
topographic features of the lot including surrounding native
vegetation, mature trees, drainage courses, and land forms (such as
hillsides and knolls) because grading will not be necessary to
construct the stable as a pad built in 1973 already exists.
C. The development plan follows natural contours of the
site to minimize grading and the natural drainage courses will
continue to the canyons at the north side of this lot.
D. The development plan: incorporates existing large trees
and native vegetation to the maxi:ru;n extent feasible and
supplements it with landscaping that is compatible with and
enhances the rural character of the community.
E. The development plan substantially preserves the natural
and undeveloped state of the lot by minimizing building coverage
because the new structure will not cause the structural and total
lot coverage to be exceeded. Further, the existing residential pad
coverage will remain at 37%. Significant portions of the lot will
be left undeveloped so as to maintain trail access across the
property and scenic vistas across the northerly portions of the
property.
F. The proposed development is harmonious in scale and mass
with the site, the natural terrain and surrounding residences.
As indicated in Paragraph A, the lot coverage maximum will not be
exceeded and the proposed project is consistent with the scale of
the neighborhood. Grading shall be per^_teed only to restore the
natural slope of the property. T'-.e ratio cf the propcse(1 structure
to lot coverage is similar to the ratio found on several properties
in the vicinity.
C. The proposed development is sensitive and not
detrimental to convenience and safety of circulation for
pedestrians and vehicles because the proposed project will utilize
the existing vehicular access, thereby having no further impact on
the roadway.
H. The project conforms with the requirements of the
California Environmental Quality Act and is categorically exempt
from environmental review.

Section 6. Eased upon the foregoing findings, -the Planning
Commission hereby approves the Site Plan Review application. for
Zoning Case No. 468 for construction of a proposed stable as
indicated on the development plan incorporated herein as Exhibit A
and subject to the conditions contained in Section 7.
Section 7. The Site Plan Review for a proposed stable
construction approved in Section 8 are subject to the following
conditions:
A. The Site Plan Review approval shall expire within one
year from the effective date of approval as defined in Section
17.34.080.A.
B. It is declared and made a condition of the Site Plan
Review approval, that if any conditions thereof are violated, the
Permit shall be suspended and the privileges granted thereunder
shall lapse; provided that the applicant has been given written_
notice to cease such violation and has failed to do so for a period
of thirty (30) days.
C. All requirements of the Buildings -and Construction

F. The working drawings submitted to the County Department
of Building and Safety for plan check review must include a 550
square foot corral and conform to the development plan approved
with this application.
G. Any modifications to the project which would constitute
a modification to the development plan as approved by the Planning
Commission shall require the filing of an application for
modification of the Zoning Case pursuant to Section 17.34.070 of
the Rolling Hills Municipal Code.
H. The applicant shall execute an Affidavit of Acceptance
of all conditions of this Variance, pursuant to Section 17.32.087,
or the approval shall not be effective.

A request for a Variance to permit the importation of a substantial
amount of soil to the subject lot, a request for a Variance to
exceed the maximum slope, a request for a Variance to permit the
construction of retaining walls in the front yard setback, a
request for a Variance to permit the construction of a stable less
than the required distance from a property line, and a request for
Site Plan Review to permit the construction of a proposed new
stable and residential additions.
BACKGROUND
1. The Planning Commission viewed the subject site on November 2,
1991 with a silhouette of the proposed additions.
2. The original pad size was approximately 10,674 square feet
and structures on the pad comprise 4,200 square feet or 39.3%
of the pad. The current pad size is 11,250 square feet and the
existing structures comprise 37.3%. The proposed structural
coverage on the pad is 51%.
3. Planning staff has also received a letter from Peggy Minor,
Manager of the Community Association regarding the permits and
approvals given by the Association in the past and points out
that Building Regulations require that all stable/barn
structures be located at least 25 feet from the exterior
property boundary (attached).
4. The applicant has made a request for a Variance to permit the
importation of 470 cubic yards of soil to the subject lot (code
requires a balanced cut and fill, with no import or export of
soil to any lot in the City) which is proposed to remain on the
site, a request for a Variance to permit a 1.5 to 1 slope (code
requires a 2 to 1 slope), a request for a Variance to encroach
up to 50 feet into the 50 foot front yard setback, a request

for a Variance to permit astable 17 feet from the rear
property line (code requires that barns and stables not be less
than 25 feet from any property line).
5. The applicant requests a Site Plan Review for a 156 square
foot kitchen addition, the conversion of the existing garage to
residential use, an 840 square foot garage addition, a 560
square foot porte cochere to be added to the existing 3,560
square foot single family dwelling and a 1,000 square foot
stable.
6. The project has been determined to be categorically exempt
pursuant to the California Environmental Quality Act (CEQA).
RECOMMENDATION
It is recommended that the Planning Commission review the proposed
plans and take public testimony.

In reply to your request, we have reviewed the RHCA Architectural
file for the above property. The history and status of Architectural
Committee approvals is as follows:
1) The original barn submittal and approval was granted in 1973
when the property was owned by R. Size. The barn was
located 30 feet from the easterly boundary and 25 feet from
the southerly boundary.
2) A revised barn plan was submitted in 1988 by Mr. Fischer.
The barn was located 25 feet from the southerly and easterly
boundaries. This plan was approved on July 12, 1988;
however, a building permit was never requested and to date
has not been issued by the Association.

A garage addition and residence addition to the residence
was approved for Pak Fan Siu in 1987. A Building Permit was
issued June 27, 1987; however, we have no record of
inspections and the home was sold to Mr. Fischer on June 24,
1988.
4) Mr. Fischer submitted a 10 foot addition to the plan on
April 29, 1988. Permit was not issued for this addition.
At the present time, permit status is as follows: Permit No. 2928
issued June 27, 1987 to Mr. Siu for a residence addition is invalid
and Plan Check 2966 dated April 29, 1988 for the garage and residence
addition, as well as Plan Check 2967 for the barn are both expired
and plans would need to be resubmitted for consideration.
For clarification, Building Regulations require that all stable/barn
structures be located at least 25 feet from the exterior property
boundary.

Construction) and Title 17 (Zoning), staff would identify the
following issues for evaluation:
1. The applicant has made a request for a Variance to permit the
importation of 470 cubic yards of soil to the subject lot (code
requires a balanced cut and fill, with no import or export of
soil to any lot in the City), a request for a Variance to
permit a 1.5 to 1 slope (code requires a 2 to 1 slope), a
request for a Variance to encroach up to 50 feet into the 50
foot front yard setback, a request for a Variance to permit a
stable 17 feet from the rear property line (code requires that
barns and stables not be less than 25 feet from any property
line).
2. The applicant also requests a Site Plan Review for a 156 square
foot kitchen addition, an 840 square foot garage, and a 560
square foot porte cochere to be added to the existing 3,560
square foot single family dwelling.

3. The existing 2,950 square foot house and attached garage were
completed in October, 1962. A 440 square foot family room was
added in January, 1973, a 700 square foot swimming pool was
completed in August, 1979, and a 500 square foot laundry, bath
and master bedroom were completed in May 1980. It should also
be noted, that during these years, there were also a number of
permits issued that expired because no work was done. These
expired permits included a feed and tractor shelter in 1973, a
trellis in 1979, and a garage and alterations to residence in
1987.
4. On June 17, 1969, a request for a Variance to building height
for a proposed stable was denied by the Planning Commission. A
new Ordinance No. 82 amending the then Ordinance No. 33, was
going into effect on July 9, 1969, and would permit a barn or
stable with a loft without glazed openings to be used
exclusively and only for the storage of feed, tack and stable
equipment. Apparently, the applicant's plans did not meet
these requirements. These plans show a distance of 30 feet
from requirement that a stable be not less than 25 feet from
any property line and 35 feet from any residence was in effect
at that time.
5. Grading taking place at the project site came to the attention
of the City when large dump trucks were seen tying up traffic
on Palos Verdes Drive North. On September 12, 1991, all work
was stopped and notice to file for a Variance was given the
property owner by the City.
6. At the present time, 470 cubic yards of fill soil has been
imported to the property. A 32 inch high retaining wall has
been constructed within the front yard setback without permits.
7. The structural lot coverage proposed is 18.2% (20o permitted)
and the total lot coverage proposed is 32.8% (35% permitted).
8. The residential building pad area is 11,250 square feet and the
structures on the pad (residence, garage and pool) total 5,756
square feet. Existing building pad coverage is 37% and
proposed building pad coverage is 51%.
9. The project has been determined to be categorically exempt
pursuant to the California Environmental Quality Act (CEQA).
RECOMMENDATION
It is recommended that the Planning Commission review the proposed
plans and take public testimony.

Reference is made to Zoning Case 468 pertaining to Lot 992 - A - RH, address 2862 Palos
Verdes Drive North.
We were going to attend the meeting this week which has now been rescheduled to next
week at which time we will be out of town. Thus the reason for this letter to you.
The importation of this vast amount of dirt without county/city inspection/permit to the
above site has resulted in three areas of concern to me;
1. Was the compaction such that the mass will be stable in case of heavy rainfall?
2. Is the slope within proper specification or has it been exceeded?
3. Has adequate drainage been provided for?
We are situated below this mass of dirt and would like to have confidence that it wont end
up impacting our property.
Also I understand that the property is to be improved in that a stable, a new four car garage
and extended overhang of the roof are also being asked for in the form of variances.
My comment here is that I have no problem with these provided that the codes in regards to
separation from lot line and building within the guidelines of structure in regards to lot size
are within your rules for the City.
