We have reviewed a preliminary plan prepared by the Riviera Design
Group for a waterfall in the front yard proposed for the subject
property and find that the plan does not comply with the Rolling
Hills Municipal Code. Required yards are to be be maintained
unoccupied and unobstructed by any structures as stated in
Municipal Code Section 17.16.150 (attached).
Your proposal requires a Variance. Please contact the City for an
application and submittal requirements.

A. Projecting Architectural Features
1. Chimneys, bay windows, cornices, eaves, belt courses,
sills, buttresses, or other similar architectural features
may extend or project into a side yard no more than
two and one-half inches for each one foot of the side
yard setback, but in no case shall such features
project more than five feet.
2. Such architectural features may project into a front or
rear yard no more than four feet.
3. No permitted projection shall be constructed in any
manner which increases the habitable floor area of a
structure.
B. Projecting Porches
An uncovered porch, platform, or landing place may project
into any required front or side yard no more than six feet or
into a rear yard without limitation. Such structures in a side
yard shall leave no less than five feet of unobstructed space
to the edge of the building pad to allow for pedestrian
movement within the setback. Such structures shall not
extend above the floor level of the building to which they
are attached.
17.16.150 Structures and Driveways Permitted Within Required Yards and
Easements
Required yards shall be maintained unoccupied and unobstructed
by any structures except for the following:
A. A boundary fence is permitted in any yard, provided the
fence is located outside of and parallel to the perimeter
easement line. In the absence of an easement line, a
boundary fence may be located on the property line.
B. Driveways are permitted in any yard but shall not cover
more than 20 percent of the area of the yard in which they
are located.
C. Uncovered parking areas are permitted in front or side
yards. However, such parking areas shall not exceed 10
percent of the area of the yard in which they are located and
shall be located no closer than 30 feet from any roadway
easement.

D. Walkways, steps, mail boxes, security lighting, and irrigation
systems are permitted in any yard area.
17.16.160 Access and Parking
A. Dveway Requirements
1. Each single-family dwelling is permitted only one
driveway as access to a maintained roadway, except as
otherwise permitted by Section 17.16.040.A.
2 Driveways shall be no wider than 20 feet, unless
otherwise approved by the Planning Commission. All
driveways shall have a roughened concrete driveway
apron.
3. No driveway shall exceed a maximum grade of twelve
(12) percent, unless otherwise approved by the
Planning Commission, and the first 20 feet of a
driveway shall have a maximum grade of seven (7)
percent.
4. All new driveways shall be reviewed by the Traffic
Commission.
B. Parking Requirements
Every single-family dwelling, including manufactured homes
used as a primary residence, shall have a garage with a
minimum capacity of two cars with direct paved access to a
maintained roadway.
17.16.170 Stable and Corral Site Required
A. Site Area Requirements
Every lot or parcel in the RA-S zone for which Site Plan Review
for a single-family home has been approved or extended after
February 27, 1991, shall have an area developed with or set aside
for a combination stable and corral area. The designated stable
area shall be no less than 450 square feet and the contiguous corral
area no less than 550 square feet. The combined minimum area
for a stable and corral shall be 1,000 square feet.

was exported from your property at 11 Packsaddle Road East to a
property on Eastfield Drive.
Exporting of soil to and from properties in Rolling Hills is
prohibited as noted in Section 15.04.130 of the Municipal Code
(attached).
We would appreciate your cooperation in having the general
contractor on your job site contact us if there is any further need
to export soil from your property.
We appreciate that you promptly stopped the movement of soil
between properties at our request.

AN ORDINANCE OF THE CITY OF ROLLING HILLS
REQUIRING A BALANCED CUT AND FILL SOILS RATIO
'FOR DEVELOPMENT PROJECTS AND READOPTING AND
ADDING CERTAIN AMENDMENTS TO THE COUNTY OF
LOS ANGELES BUILDING CODE RELATING TO GRADING
STANDARDS, AND AMENDING THE ROLLING HILLS
MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Purpose. The purpose of this Ordinance is
to amend the City's adopted version of the County of Los Angeles
1990 Building Code to require a balanced cut and fill soils ratio
for development projects. The Ordinance also rewords the
existing provisions regarding maximum cut and fill slopes and
updates certain references in the Municipal Code to revised
section numbers and paragraph lettering contained in the County
of Los Angeles 1990 Building Code.
Section 1. Findinas of Local Conditiong. Pursuant to
California Health and Safety Code Sections 17958.5, 17958.7 and
18941.5(c), the City Council of the City of Rolling Hills hereby
finds that the modifications and changes set forth in this
Ordinance to certain grading standards set forth in the County of
Los Angeles Building Code are reasonably necessary because of
local climatic, geological and topographic conditions. The City
of Rolling Hills contains areas of steep hillside terrain,
portions of which are unstable due to active landslides. These
conditions make it reasonably necessary to impose stricter
grading standards than are presently contained in the County of
Los Angeles Building Code, specifically with regard to the
regulation of import and export of soil and the maximum height of
cut and fill slopes.
Section 3. Section 15.04.110 of Title 15 of the
Rolling Hills Municipal Code is hereby amended to read as
follows:
25.04.112. Section 7015(a1 amended. Paragraph (a) of
Section 7015 of the County of Los Angeles Building Code, entitled
"MAXIMUM SLOPE," is amended to read:
"Section 7015(a). MAXIMUM SLOPE. Cuts shall not
be steeper in slope than two horizontal to one verti-
cal, or exceed a vertical height of thirty (30') feet,
unless the owner receives a variance for a steeper or
higher vertical height slope from the Planning
Commission of the City of Rolling Hills, pursuant to
the provisions of'Title 17 of the Municipal Code of the
City. In applying for a variance to the provisions of
this paragraph, the owner shall submit soil test data
and engineering calculations and shall provide in
writing any specific safety and/or stability problems
that presently exist on the property, or may exist if
the requested variance is granted and the proposed
grading plans are approved."
,section 4. Section 15.04.120 of Title 15 of the
Rolling Hills Municipal Code is, hereby amended to read as
follows:
25.04.120. Section 70151c) added. Section 7015 of
the County of•Los Angeles Building Code, entitled "Excavations"
is hereby amended to add paragraph (c) to read:
"Sect{on 7015(c). DRIVEWAYS. Driveways which
provide access from any lot or parcel of land to any of
the private roads in the City of Rolling Hills which
are constructed and maintained by the Rolling Hills
Community Association shall be so constructed that the
first twenty fest of said driveway, measured from the
edge of the paved portion of said private road, shall
not be steeper in grade than seven (7%) percent."
Section 5. Section 15.04.130 of Title 15 of the
Rolling Hills Municipal Code is hereby amended to read as
follows:
15.04.130. Section 7015(d1. Section 7015 of the
County of Los Angeles Building Code, entitled "Excavations" is
hereby amended to add 'paragraph (d) to read:
"Section 7015(d) BALANCED CUT AND FILL RATIO.
1. No export or import of soil shall be permitted
from or to any lot in the City.
2. No grading plan for which a permit is required
shall be approved unless the amount of soil to be
cut from the site equals the amount of soil to be
filled on the site.
3. The City Manager may grant an exception to the
requirements of parts 1 and 2 of this paragraph
(d) to allow for the import or export of soil not
to exceed 500 cubic yards if he or she finds,
based upon written reports and other information
submitted, that all of the following conditions
are present: (a) construction of a structure on
the lot or parcel has commenced, (b) that the need
to import or export the soil could not have been

and (c) that either the structure cannot be
completed without the requested import of export
of soil or that an emergency condition exists due
to the threat of land subsidence or other imminent
danger."
Section 6. Section 15.04.140 of Title 15 of the
Rolling Hills Municipal Code is hereby amended to read:
15.04.140. Section 7016(c) amended. Paragraph (c) of
Section 7016 of the County of Los Angeles Building Cods,
entitled "Fill Slops," is hereby amended to read:
"Section 7016(c). FILL SLOPE. Fill slopes shall
not exceed a steepness of two horizontal to one
vertical, or exceed a vertical height of thirty (30')
feet, unless the owner receives a variance for a
steeper or higher vertical height fill slope from the
Planning Commission of the City of Rolling, Hills, pur-
suant to the provisions of Title 17 of the Municipal
Code of the City. In applying for a variance to the
provisions of this paragraph, the owner shall submit
soil test data and engineering calculations and shall -
provide in writing any specific safety and/or stability
problems on the property that presently exist or may
exist if the requested variance is granted and the pro-

Section 7. Section 15.04.141 is hereby added to
Title 15 of the Rolling Hills Municipal Code to read as follows:
15.04.111. Section 7016(ii added. Section 7016 of
the County of Los Angeles Building Code, entitled "Fills," is
amended to add a new paragraph (i) to read:
"Section 7016(i). BALANCED CUT AND FILL RATIO.

Dear Ann,
We are writing this letter to request an extension of the approval for
Zoning Case No. 400: granting a variance to the front yard setback and
site plan review approval.
Approval was originally granted September 30, 1989. We requested a
modification to one of the conditions on April 24, 1990, which was
denied by the Planning Commission at their meeting June 19, 1990.
Subsequent to the Planning Commission denial of our request, we were
required to comply with the condition before the Architectural
Committee would review our plans.
We have been back and forth with the Architectural Committee (7
submittals) over the past few months. Conditional approval was
finally granted last week. The plans are now in plan check.
It was my understanding that the clock would start on the date of the
last Planning Commission action (June 19, 1990). Nevertheless we have
been actively pursuing this project throught the approval process.
The process has simplytaken an inordinately long time. We request
that our approval be extended for one year, to September 30, 1991.

Municipal Code, this letter shall serve as official notification that
the above -stated Zoning Case application was reviewed by the Planning
Commission at their regular meeting of June 19, 1990. At that
meeting, the Planning Commission voted to deny the request for a
modification to the site plan.
The Planning Commission's decision will be reported to the City
Council at their regular meeting on July 9, 1990. The decision of the
Planning Commission may be appealed pursuant to Sections 17.32.140 and
17.32.150 (enclosed) of the Municipal Code. A copy of Resolution 614,
establishing the fee for filing an appeal, is also enclosed for your
