side yard setback.
Criteria to be satisfied for grant of Variance
Such change is based upon the following described exceptional or extraordinary
circumstances or conditions that do not apply generally to other property in the
same vicinity and zone.
The proposed expansion is located in the only area feasible without encroaching
on the outdoor living area. The proposed addition is staying within:the same
architectural style. The nonconforming condition is already existing.
Such change will not be materially detrimental to the public welfare nor injurious to
the property or improvements in such vicinity and zone where property is located becau;
The expansion will not encroach into the outdoor living area. The proposed
addition will not be detrimental to the neighbors to the north due to the
fact there are no new windows on the addition that face toward the neighbors.

Chuckwagon road. The site is a relatively level building pad that slopes
westerly into a canyon. The site has an existing single family residence
with attached garage, pool and spa.
Existing planting materials include native brush and grasses on the slopes
and some non native plants and grass surrounding the property.
