FINDINGS AND REPORT
The application of Mr. W. Jack Rode, Lot 1-CRB, Chesterfield
Ranchos B Tract, for a conditional use permit under Section 7009 (a),
Maximum Slope, and Section 7010 (c), Fill Slope, of Ordinance No. 153
came on for hearing on the 16th day of May, 1978 in the Council
Chambers of the Administration Building, 2 Portuguese Bend Road,
Rolling Hills, California, and the applicant, having submitted
evidence in support of the application, the Planning Commission, being
advised, now makes its Findings and Report as required by the Ordi-
nances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Jack Rode, is
the owner of that certain real property described as Lot 1-CRB,
located at 5 Chuckwagon Road in the City of Rolling Hills, and that
notice of the public hearing in connection with said application was
given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills, California. The Commission finds further
that letters were received from Claudia Hayes, 7 Chuckwagon Road
and From James E. Hawthorne, 22 Chuckwagon Road, expressing opposi-
tion to the request.
II.
The Commission finds that Mr. Rode requested approval of
a plan marked "Exhibit A", showing a building pad 15,300 square feet
in size, with a 1 1/2:1 cut slope and a 2:1 fill slope. A plan
marked "Exhibit B" demonstrated that in order to develop the property
in compliance with the grading ordinance with a 2:1 cut slope and.a
2:1 fill slope, the pad would be only 1,200 square feet, and would
be closer to the roadway, with the elevation of the pad on Exhibit "B"
approximately twelve feet higher than the pad elevation on Exhibit "A".
The Commission finds that a conditional use permit shioa.ld not be

granted in order to preserve substantial property rights possessed
by other property in the same vicinity and zone, and that the granting
of such a conditional use permit would be materially detrimental to
the public welfare and injurious to property in the same vicinity
and zone.
III.
From the foregoing it is concluded that a conditional use
permit should not be granted to Mr. Jack Rode, Lot 1-CRB, for grading
in excess of 2:1 based on the following reasons:
Letters in opposition to the request from Claudia Hayes,
5 Chuckwagon Road and James E. Hawthorne, 22 Chuckwagon
The severe slopes which would result from 1 1/2:1 grading
would detract from the appearance of the area
The property can be developed without a variance from
City standards for grading
There was no demonstration of hardship which would deprive
the applicant of substantial property right,
and it is, therefore, so ordered.

HILLS ADOPTING BY REFERENCE THE LOS ANGELES COUNTY
BUILDING CODE CONTAINED IN THE.1975 EDITION OF THE
BUILDING LAWS PUBLISHED BY BUILDING NEWS, INC, FOR
AND INSTEAD OF THE PRESENT BUILDING CODE,'AND MAKING
OTHER AMENDMENTS"
The City Council of the 'City of Rolling Hills does ordain as
Section.1:. Section 7009, entitled..."EXCAVATIONS" of the Los
Anggeles County. Building Code, which Building Code has been adopted by
reference as the Building Code of the City of Rolling Hills, Para-
graph (a) thereof, is amended to read:
"(a) MAXIMUM SLOPE. Cuts shall n4t be steeper
in slope than twohorizontal to one vertical,\\or exceed
a vertical height -.of thirty (30) feet unless the owner
receives a variance for a steeper slope from the Planning
Commission of the City of Rolling Hills, pursuant to the
provisions of Ordinance No. 33 of said City. The building
official may require the excavation to be made with a cut
face flatter in slope than two horizontal to one vertical
if he finds it necessary for stability and safety."
Section 2: Section.7009 (b) is amended to read as follows:
-"(b): DRIVEWAYS. Driveways which. provide access
from any lot or parcel of land to any of the private roads
in the City of Rolling Hills, which are maintained and
constructed by the Rolling Hills Community Association,
shall be so constructed that the first twenty feet of
said driveway, measured.. from the edge of the paved portion
of said private road, shall not be steeper in grade than
seven (7%) percent."
Section 3: Section 7010 (c).is amended to read:
"(c) FILL SLOPE. No fill slope shall exceed a
steepness of two horizontal to one vertical, nor exceed
a vertical height of thirty (30) feet. The owner shall
submit soil test data and engineering.calculaticns to
substantiate to the satisfaction of the Building Official
the stability of the fill slope and slope surface under
conditions of saturation."
