134, Requesting a 5 foot encroachme, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Mr. David Byrd Lot 31-CF ZONING CASE NO. 134 FINDINGS AND REPORT The application of Mr. David Byrd. Lot 31-CF:, Chesterfield Tract, for a conditional use permit under Article III, Section 3.06, Front Yard Requirements and Section 3.07, Side Yard Require- ments came on for hearing on the 19th day of November, 1974 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. David Byrd, is the owner of that certain real property described as Lot 31-CF, Chesterfield Tract, located in the City of Rolling Hills, California and that notice of the public hearing in connection with said appli- cation was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II. The Commission further finds that no person appeared at said public hearing in opposition to the application; that Mr. James Hawthorne, 22 Chuckwagon.Road, had called to say he had no objec- tion to the wall in the sideyard as built, but would not want it higher, and Mrs. Gordana Swanson, 2 Chesterfield Road, called to say the planter in the side yard is displeasing to the eye and detracts from the appearance of the property. III. The Commission further finds that the applicant requests the conditional use permits to correct an existing violation, since the plans for the residence were inadvertently approved by the Architec- tural Committee with the construction of a wall in the front yard and a planter in the side yard, building permits were issued without the necessary variances under the Zoning Ordinance being obtained, and all inspections were made without recog.ition that the planter and walls were in violation, and the conditional use permits should be granted in order to preserve substantial property rights possessed by other property in the same vicinity and zone. IV. From the foregoing it is concluded that a conditional use permit under Article III, Section 3.06, Front Yard Requirements and Section 3.07, Side Yard Requirements should be granted by the Plan- ning Commission of the City of Rolling Hills to Mr. David Byrd, Lot 31-CF, Chesterfield Tract, in accordance with the plot plan marked Exhibit I on file in these proceedings, and it is, therefore, so ordered. /s/ Godfrey Pernell CHAIRMAN, PLANNING COMMISSION
