FINDINGS AND REPORT
The application of Mr. Richard Scheide, Lot 15-CF, Chesterfield
Tract, for a variance of Side Yard Requirements under Section 3.07
and Rear Yard Requirements under Section 3.08, Article 'III of Ordi-
Fp.ance No. 33 came on for hearing on the 24th day of October, 1972 in
the Council Chambers of the Administration Building, 2 Portuguese
Bend Road,. Rolling Hills, California, and the applicant, having sub-
mitted evidence in support of the application, the Planning Commis.
s$Qnq 'being advised, now makes its Findings and Report as required
by the Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Richard Scheide,
.s the owner of that certain real property described as Lot 15-CF,
Chesterfield Tract, located in the City of Rolling Hills, California,
and ghat notice of the public hearing in connection with said appLi.
oa ,on was given as required by Sections 8.06 and 8.07 of Ordinance
No. 33 of the City of Rolling Hills, California.
II.
The Commission further finds that no person appeared at said
pubic hearing in opposition to the application for a variance, and
that no evidence was received by the Commission, in opposition thereto,
and that Mrs. Leonard Swanson, 2 Chesterfield Road, owner of property
adjacent to the Schelde property, had written to advise that she had
no objection to the proposed location of the pool.
III.
The Commission further finds that the applicant requests the
variances to construct a swimming pool that would extend into the
rear yard and into the side yard, while retaining a ten foot distance
from the side property line". The Commission finds that variances to
permit construction should be granted in order to preserve substantial
property. rights possessed by other property in the same vicinity and
zone
IV.
From the foregoing it is concluded that a variance of Side Yard
Requirements under Section 3.07 and Rear Yard Requirements under
Section 3.Q8, Article III of Ordinance No. 33 should be granted by
the Planning Commission of the City of Rolling Hills to Mr. Richard
Scheide,Lot 15-CF, Chesterfield Tract, in accordance with the plot
plan marked Exhibit I on file in these proceedings, and it is, there-
fore, so ordered.
