FINDINGS AND REPORT
The application of Mr. William Davisson, Lot 83-RH, Rolling
Hills Tract, for a conditional use permit under Section 3.01,
Paragraph 3 (c) of Ordinance No. 112 for construction of a tennis
court came on for hearing on the 17th day of May, 1977, in the
Council Chambers of the Administration Building, 2 Portuguese Bend
Road, Rolling Hills, California, and the applicant, having submitted
evidence in support of the application, the Planning Commission,
being advised,now makes its Findings and Report as required by the
Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. William Davisson,
is the owner of that certain real property described as Lot 83-RH
located at 7 Blackwater Canyon Road in the City of Rolling Hills, and
that notice of the public hearing in connection with said application
was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills, California. The Commission finds, further,
that no communication, written or verbal, was received in opposition
to the request. Written approval was entered into the file from the
following neighbors: Robert E. Norcross, 11 Middleridge Lane South;
J. Lee Hite, 10 Middleridge Lane South; R. A. Meurer, 9 Blackwater
Canyon Road; Gary Hathaway, 8 Blackwater Canyon Road and Dorothy
House, 5 Blackwater Canyon Road.
II.
The Commission finds that the applicant requests the conditional
use permit for construction of a tennis court in a legal location on
the property, which consists of 6.2 acres in the RAS-2 zone. The
applicant advised that the total land use, including a tennis court
would cover 8% of the net lot area, and a tennis court in the location
requested would be visible from only one neighboring home, and from the
roadway of Middleridge Road. The Commission finds that a conditional
use permit should be granted in order to preserve substantial property
rights possessed by other property in the same vicinity and zone, and
that the granting of such conditional use permit would not be materially
detrimental to the public welfare nor injurious to property in the same
vicinity and zone.
III.
From the foregoing it is concluded that a conditional use permit
should be granted under Section 3.01, Paragraph 3 (c) of Ordinance
No. 112, for construction of a tennis court on Lot 83-RH, subject to
approval of the landscaping by the Landscape Committee, to Mr. William
Davisson, 7 Blackwater Canyon Road, and it is, therefore, so ordered.
