Regarding your comment about proceeding without approval, my suggestion about finding a solution aside from the variance you had requested was not a suggestion that you proceed regardless of the Commission's decision, but a suggestion that you find a way of accommodating your needs without using the upper floor. INCORPORATED JANUARY 24, 1957 NO. 2 PORTUGUESE BEND ROAD ROLLING HILLS, CALIF. 90274 (213) 377-1521 August 26, 1987 Subject: Zoning Case No. 342 Dear Mr. and Mrs. Davisson: This letter is to serve as official notice, pursuant to Section 17.32.090 of the Rolling Hills Municipal Code, that your request for a Conditional Use Permit for conversion of an existing two story stable and garage to servants' quarters and a Variance of height limitation for a two story structure to be used as servants' quarters and garage (with loft) was denied by the Rolling Hills Planning Commission at a regular meeting on Tuesday, August 18, 1987 with findings that: 1) The City of Rolling Hills proscribes vehicular access or paved parking within fifty feet of a proposed guest house or servants' quarters; 2) The Municipal code sets forth that in the RAS zone no building shall exceed one story in height except a barn or stable, which may have a loft without glazed openings, to be used exclusively and only for the storage of feed, tack and stable equipment; 3) There is an expressed prohibition of parking facilities being attached to or in the vicinity of a guest house or servants' quarters; 4) It is not considered to be sound planning and zoning policy to retroactively approve a use in a structure which would not have been approved had the currently requested use and structural design been submitted at the time of original construction plan review. A formal report of the Commission's action is contained in the minutes of the proceedings before the Commission, and will be available to you after approval by the Planning Commission. The Planning Commission's action will be reported to the City Council at their next regular meeting on Monday, September 14, 1987 at 7:30 p.m. pursuant to Section 17.32.140 of the Municipal Code. The decision of the Planning Commission may be appealed by the applicant, pursuant to Section 17.32.140 of the Municipal Code. A copy is enclosed for your information. No. 2 PORTUGUESE BEND RD. • ROLLING HILLS, CALIF. 90274 ROLLING HILLS CALIFORNIA July 9, 1987 TO: Terry Belanger, City Manager FROM: Peggy Minor, Association Manager /✓ SUBJECT: Bill Davisson Stable Conversion Request In reply to your memorandum of July 2nd requesting comments with respect to RHCA Building Regulations pertaining to stable conversion for residential uses, the Architectural Committee has reviewed the Building Regulations with respect to Mr. Davisson's request and does not have authority to approve the conversion. Several conflicts occur with respect to regulations; i.e. 1. Residential structures are one-story structures of low silhouette. They are to be designed as "residential". The addition of skylights or any glazed openings in an existing two-story barn will compromise the design to appear to be a combination of a residential structure and barn accessory structure. 2. Addition of a "guest house, servants' quarters or habit- able" structure requires that the main residence have a third garage space. A garage is not allowed at the accessory building site, but may be incorporated with a stable site. 3. A stable/barn may be designed with a second story loft area provided that no glazed openings are in the loft. This requirementwas in effect when the Davisson's barn was designed and built in 1980. It is the Committee's opinion that it is not aesthetically possible to redesign an obvious two-story barn structure to appear to be a one-story servantsquartersas set forth in the Building Regulations. Page 2 Terry Belanger Bill Davisson Stable Conversion Request A new building for servants quarters would be one-story, have no garage spaces and require that a third garage space be pro- vided at the main residence. A location should also be noted for possible future stable and horse facility. I hope this clarifies a complex situation. The conversion request seems to embody all of the concerns expressed by RHCA Architect- ural Committee members and members of the Board of Directors when the regulations pertaining to stable and accessory buildings were revised periodically over the past 20 years.
