Dear Mrs. Beiler-Hozumi:
At the January 17, 1995 meeting, the Planning Commission reviewed the subject
applications and agreed, pending your consideration, that the design of the proposed
project would be enhanced with the removal of the existing tennis court.
Other proposed conditions were: Convert the illegal two-story garage/office structure
back to a one story barn with loft, designate a minimum 550 square foot corral
adjacent to the existing barn; screen animal shelters with landscaping materials at the
north, especially as seen from the road; tack room office use does not permit sleeping
quarters nor kitchen facilities; restore and maintain the horse trail along the northern
boundary of the property; and that there be no further increase in size of the project
unless new applications made to the Planning Commission.
Attached are Chapters 6.32 (Animal Facilities) and 6.36 (Keeping Wild or Exotic
Species) of the Rolling Hills Municipal Code that should be of interest to you.
Please provide 8 copies of a revised plot plan showing any changes to the existing
plans by Monday, February 13, 1995.
Staff will prepare a staff report reflecting those changes that will be available after 3
PM on Friday, February 17, 1995.

ANIMAL FACILITIES

6.32.010 Dwelling house defined. For the purpose
of Sections 6.32.020 and 6.32.030, a "dwelling house" is
defined to be a building or structure designed and used
to house one family and the domestic employees of such
family. (Ord. 136 S803, 1976).
6:32.020 Fowls and rabbits --Limitations. It is a•
nuisance to, and no person shall keep, chickens, geese,
ducks, turkeys, pheasants, doves, pigeons, squab or similar
fowl or rabbits owned or controlled by him within fifty
feet of any street line or within twenty-five feet of any
property line or within one hundred feet of any dwelling
house or structure used as a dwelling house, other than a
dwelling house or structure occupied by said person.
(Ord. 136 S801, 1976).
• 6.32.030 Horses, donkeys and mules --Limitations.
It is a nuisance to, and no person shall; stable or corral
any horse, donkey or mule within thirty-five feet of any
building or structure used as a dwelling house. (Ord.
136 S802, 1976).
6.32.040 'Stallions and lacks --Fencing requirements.
It is unlawful to keep in the City any stallion or jack ex-
cept in an area enclosed by a fence located not less than
ten feet from any road, drive or bridle trail. Such en-
closure shall be constructed in a good, solid substantial
manner for the purpose of confining such stallion or jack.
A good, solid, substantial fence, within the meaning of this
section, shall have six wood stringers, the dimensions of
which shall not be less than two inches by six inches se-
curely bolted to wood posts five inches by six inches or
four inches by six inches firmly set at least three feet
in, the ground and not more than eight feet apart. One of
the stringers shall be sixteen inches above the surface of
the ground and the remaining stringers shall be placed at
sixteen -inch intervals above the bottom stringer. The

top stringer shall be not less than eight feet above the
surface of the ground on that portion of the enclosure which
is adjacent to or adjoining such road, driveway or bridle
trail. (Ord. 180 Si, 1980: Ord. 136 S804, 1976).
6.32.050 Goats --Limitations. It is a nuisance to,
and no person shall, keep or maintain any goat within fifty
feet of any dwelling house other than that occupied by said
person; or more than two goats within one hundred feet of
any dwelling house other than that occupied by said person;
or more than four goats within three hundred feet of any •
dwelling house other than that occupied by said person; or
more than five goats within one thousand feet of any dwelling.

6.32.060 Bees --Limitations. No person shall keep or
maintain or suffer to permit to be kept or maintained upon
the premises owned or controlled by said person in the City
any hive of bees within one hundred feet of any bridle

6.32.070 Cattle --Limitations. It is a nuisance to,
and no person shall, keep or maintain in the City cows or
cattle at.or upon premises owned, occupied or controlled by
said person within three hundred feet of any dwelling other
than that occupied by him; or keep or maintain any cattle
within three hundred feet of any school or within one
hundred feet of any street line. (Ord. 136 S807, 1976).

No person owning or having charge, custody, control or
possession of any animal, bird of prey, reptile or serpent
known by such person to be vicious or dangerous, or commonly

so, known, or owning or having charge, custody, control or
possession of any animal commonly referred to as a "wild
species," or any bird of prey or poisonous reptile or
serpent, shall permit or allow the same to be at large
upon any highway, street, lane, alley, court or other
public place or upon any private property other than within
the enclosed premises of such person. (Ord. 136 S901, 1976).
6.36.020 Keeping wild species --Permit required. Ex-
cept as provided in this chapter, no person shall have, keep
or maintain or have in his possession or under his control
within the City any animal, bird, reptile or serpent described
in Section 6.36.010 without first applying to and receiving
a permit from the City or an authorized representative to do
so. (Ord. 136• 5903, 1976) .
6.36.030 Keeping wild species --Confinement required.
No person owning or having charge, custody, control or pos-
session .of any animal, bird of prey, reptile or serpent de-
scribed in Section 6.36.010 shall allow such animal, bird,
reptile or serpent within the enclosed premises of such
person unless and until he has first secured an annual per-
mit from the City to do so and complies with all terms and
conditions of such permit, and, in addition thereto, such
animal, bird, reptile or serpent shall at all times be so
confined, controlled and restrained in such manner so the
life, limb or property of any person lawfully entering shall
such premises shall not be endangered. The City Manager
shall have reasonable discretion to revoke the permit if, in
the City Manager's opinion, the life, limb or property of
another is endangered. (Ord. 136 S902, 1976).
6.36.040 Keeping wild species--Permit--Conditions.
No permit shall be granted except with such conditions
attached as shall, in the opinion of the person or agency
approving such permit, reasonably insure the public health,
safety and general welfare, and no permit shall be granted
in any event for any animal, reptile or serpent at any par-
ticular location except upon an explicit finding by the per-
son or agency approving such permit that the issuance thereof
will not be contrary to the public health, safety and general
welfare. (Ord. 136 S905, 1976).
6.36.050 Keeping wild species --Temporary permit.
The City Manager may, following application for a permit
and pending final disposition of the same, grant a temporary
permit for the maintenance within the City of any such
animal, reptile or serpent, upon such conditions as the
City Manager shall, in the City Manager's discretion,
require when, in the City Manager's opinion, there is no

reasonable doubt as to the consistency thereof with the. V;
public health, safety and general welfare, but no animal, `.
reptile or serpent shall be otherwise kept or maintained=,
within the City or permitted to occupy any premises within
the City except while such a regular or temporary permit
is in full force and effect. (Ord. 136 S906, 1976).
6.36.060 Keeping wild species--Permit--Appeal.
A. Any person who is a party to a proceeding described in
Sections 6.36.020 and 6.36.030 who is dissatisfied with the
decision of the City Manager shall have the right to appeal
to the City Council. The appeal shall be filed in writing
with the City Clerk within ten days after the date of the
decision of the City Manager. Thereafter, the City Clerk
shall, within ten days after the date of filing the appeal,
set the appeal for hearing as a separate agenda item on
the next regular meeting of the City Council. While the
appeal is pending, the decision of the City Manager shall
remain in effect and the appealing party shall comply with
all the provisions thereof. The failure of the appealing
party to comply with the decision of the City Manager shall
be grounds for dismissal of the appeal.
B. At the time of the hearing on the appeal, the
City Council shall review and consider all evidentiary
matters relating to the decision of the City Manager and,
within ten days, shall make one of the following decisions:
1. Uphold the decision of the City Manager;
2. Reverse the decision of the City Manager;
3. Dismiss the appeal.
C. An appeal fee shall be paid as set forth in Chapter
6.56. No appeal shall be considered by the City Council
until such fee has been paid. (Ord. 205 53, 1983; Ord. 136
S904, 1976).
6.36.070 Impoundment authorized when --Costs. The
Director of Animal Control, or his authorized deputy, shall
take possession of any animal, bird, reptile or serpent for
which a permit has not been issued and shall keep the same
for a period of ten days, or until a permit has beensecured
by the owner, whichever event occurs first. The cost of
keeping such animal, bird, reptile or serpent while in the
control of the Director shall be paid for by the owner
thereof. (Ord: 136 S907, 1976).
