MINKES shall be granted the right to construct on the real property described as Lot 22 of Record of Surveys, Book 7:1, pages 12-14, as recorded in the Office of the County Recorder of Los Angeles County, the barns or stable and corral in connection therewith prior to the construction of the main residential building upon the condition that. the plans and specifications for said barn or stable and corral and the location thereof on said Lot 22 shall be approved by the Architectural Committee of the ASSOCIATION. B. In the event MINKES or his successors in interest shall elect to construct a main residential dwelling on said Lot 22, he shall first secure from the Architectural Committee their approval as to the location of said structure on Lot 22 and its aesthetic compatibility with the existing stable or barn prior to submitting plans and specification for the construction of the residential structure as required by the Declarations of Restrictions referred to above. C. In the event the Architectural Committee does not approve the location of the residential building to be constructed on Lot 22 or the aethetic compatibility of the proposed structure to the improvements already existing on said Lot, then MINKES or their successors in interest agree that they will, prior to commencing the construction of a residential building on Lot 22, -4- 2 3 4 5 cause said Ilin or stable and corral 4101 existing to be removed from said lot, which lot shall be restored to its original condi- tion and contour as it existed prior to the construction of said barn or stable. D. If it is necessary for MINKES to remove the barn 6 or stable and corral as provided for above, all costs and expenses 7 of removing said structures, including attorney's fees and court 8 costs, if any, shall be paid by MINKES. The ASSOCIATION shall 9 not be responsible or liable for the cost of removing said struc- 14 tures. 11 E. This Agreement does establish and reserve and 12 impose a lien upon the real property described in Recital I 13 hereof for the purposes of insuring the costs and expenses, if 14 any, incurred by the ASSOCIATION if the ASSOCIATION is required 15 to remove said barn or stable and corral and the ASSOCIATION is 16 granted the right to enforce said lien. 17 F. In order to obtain a variance, the applicant must be able to demonstrate that practical difficulties or unnecessary hardships result through the strict and literal interpretation and enforcement of the zoning provisions. Variances are considered and decided upon by the Planning Commission following a public hearing. APPLICATION AND REQUEST FOR HEARING In order to obtain a variance, a property owner or his or her agent must submit an appli- cation and request a hearing before the Planning Commission. To do so, the applicant should complete the requirements enumerated herein, assemble the necessary application documents and call to make an appointment at (213) 377-1521. Making an appointment will assure that someone is available to explain the necessary procedures and review the case material for completeness and accuracy.
