real property in the City of Rolling Hills, California,. legally

8 ASSOCIATION is a party to Declaration No. 150-AT and is the
9 holder of certain rights and privileges set forth in said Declara-
10 tion. Declaration No. 150-AT has been legally interpreted by the
11 Courts of the State of California to be part of a plan and design
12 of development of all property under jurisdiction of the ASSOCIA-
13 TION as provided for and established pursuant to the provisions
14 of Declaration No. 150 executed by Palos Verdes Corporation on

18 At the time of entering into this Agreement, Lot 21.,

22 which MINKES desires to construct a barn and corral prior to the
23 : construction of a residential building on said lot. Each of said
24 lots have a designated building site .as provided for in Declara-
25 tion of Restriction No. 150-AT or in the instrument of original
26 conveyance by developer and subdivider of the land covered by

ASSOCIATION is one of the parties to Declaration of
Restriction No. 150-AT and is the holder of certain rights and
privileges set forth in said Declaration of Restrictions and is
the owner of a nonexclusive easement seventy-five(75') feet in
width extending along the Westerly and Southwesterly boundary of
twenty-five
Lot 22 and an easement/ (25') feet in width extending along
the Westerly boundary of Lot 21. ASSOCIATION is also the
owner of a nonexclusive easement over and across Chuck Wagon Road
and Chesterfield Road, which roads are designated on said Record
of Survey as private streets.

MINKES desires to construct a barn or stable on Lot 22
prior to the construction of a residential dwelling. The Declara-
tion of Restrictions referred to herein and the Building Regula-
tions adopted by the ASSOCIATION pursuant to such Declaration of
Restrictions require that before there can be constructed any lot
or building site, whether a corral, stable, barn, or accessory
building, there first must be constructed a single-family dwelling
as such terms are defined in Declarations of Restrictions
No. 150-AT. Declarations of Restrictions No. 150-AT grants to
the ASSOCIATION the power to interpret the provisions of said
Declarations in case of uncertainty as to the meaning thereof and
ASSOCIATION has interpreted said regulations to permit the
construction of a barn, stable, and corral on Lot 22 prior to the
construction of the main residential dwelling as required by said
Building Regulations and the Declarations of Restrictions cover-

based on thl.ocation of the existing •idential dwelling and
improvements on Lot 21, from the terrain of Lots 21 and 22 and
finds that the natural aesthetics of said Lots and the adjoining
lots will be benefited.
NOW, THEREFORE, IT IS AGREED:
A. MINKES shall be granted the right to construct on
the real property described as Lot 22 of Record of Surveys, Book 7:1,
pages 12-14, as recorded in the Office of the County Recorder of
Los Angeles County, the barns or stable and corral in connection
therewith prior to the construction of the main residential
building upon the condition that. the plans and specifications for
said barn or stable and corral and the location thereof on said
Lot 22 shall be approved by the Architectural Committee of the
ASSOCIATION.
B. In the event MINKES or his successors in interest
shall elect to construct a main residential dwelling on said
Lot 22, he shall first secure from the Architectural Committee
their approval as to the location of said structure on Lot 22 and
its aesthetic compatibility with the existing stable or barn
prior to submitting plans and specification for the construction
of the residential structure as required by the Declarations of
Restrictions referred to above.
C. In the event the Architectural Committee does not
approve the location of the residential building to be constructed
on Lot 22 or the aethetic compatibility of the proposed structure
to the improvements already existing on said Lot, then MINKES or
their successors in interest agree that they will, prior to
commencing the construction of a residential building on Lot 22,

cause said Ilin or stable and corral 4101 existing to be removed
from said lot, which lot shall be restored to its original condi-
tion and contour as it existed prior to the construction of said
barn or stable.
D. If it is necessary for MINKES to remove the barn
6 or stable and corral as provided for above, all costs and expenses
7 of removing said structures, including attorney's fees and court
8 costs, if any, shall be paid by MINKES. The ASSOCIATION shall
9 not be responsible or liable for the cost of removing said struc-
14 tures.
11 E. This Agreement does establish and reserve and
12 impose a lien upon the real property described in Recital I
13 hereof for the purposes of insuring the costs and expenses, if
14 any, incurred by the ASSOCIATION if the ASSOCIATION is required
15 to remove said barn or stable and corral and the ASSOCIATION is
16 granted the right to enforce said lien.
17 F. It is expressly agreed to and stated by MINKES
18 and the ASSOCIATION that the covenants set forth above are binding
19 upon the successive owners of the real property described in
20 ' Recital I and the provisions of this Agreement and are made for
21 the direct benefit of Lot 21 of said Record of Survey and are a
22 burden on Lot 22 of said Record of Survey described herein and
23 ' the protection, maintenance, and improvement and development of
24 Lots 21 and 22 described herein and also all land described in
25 Declaration of Restrictions No. 150-AT, and said covenants shall
26 run with the land described in Recital I hereof for the period of
27 time set forth in said Declaration of Restrictions No. 150-AT.

2 inclusive, set forth above, are by this reference expressly made
3 a part of this Agreement, the same as though each of said Recitals

7 heirs and devisees and the their executors, administrators,
8 successors and assigns of the individual parties and the respec-
9 tive successors and assigns of all other parties herein as

VARIANCE
VARIANCE
A variance is a form of permit which is required of any property owner who seeks to vary
from the provisions of the City'S zoning ordinance in the development of property in the
City. In order to obtain a variance, the applicant must be able to demonstrate that
practical difficulties or unnecessary hardships result through the strict and literal
interpretation and enforcement of the zoning provisions. Variances are considered and
decided upon by the Planning Commission following a public hearing.
APPLICATION AND REQUEST FOR HEARING
In order to obtain a variance, a property owner or his or her agent must submit an appli-
cation and request a hearing before the Planning Commission. To do so, the applicant
should complete the requirements enumerated herein, assemble the necessary application
documents and call to make an appointment at (213) 377-1521. Making an appointment will
assure that someone is available to explain the necessary procedures and review the case
material for completeness and accuracy.
PLAN SUBMITTAL INFORMATION
Complete and submit for each application:
1. "Request.for Hearing" Application.
2. Owner's Declaration
Fifteen copies of plan MUST Accompany application„
3. Plan submittal using the "Checklist" as guide. Each plan must have computation of lot
coverage printed on the plot plan.
4. Ownership List: Prepare a complete list of names and mailing addresses of all property
owners of each parcel, within or partially within a 1,000 foot radius of the exterior
boundaries of the property under consideration, including the owner of the subject
property. Assign a number to each name on the list. This information must be as it
appears on the latest available assessment roll of the Los Angeles County Assessor.
This list shall be certified to be true and correct (complete Certified Property Owner's
Affidavit). An inaccurate or incomplete list is cause for removal of the case from
the agenda or to require a rehearing of the case.
Type Self -Adhesive Mailing Labels: In addition to the Ownership List required, submit
one complete set of typed self-adhesive mailing labels for all property owners listed
on the Ownership List.

REGULAR. MEETINGS
Once an application has been accepted as complete by the City, a hearing will be set before
the Planning Commission. Applications are considered at the regular meetings of the Plan-
ning Commission, which are held the third Tuesday of each month. Applications must be
submitted to the Planning Commission Secretary no later than the last Monday of the month
immediately preceding the regular meeting at iich the matter shall be considered. Provide
sufficient time in your plans to attend at least two meetings to allow the Planning Com-
mission to study the facts presented and to make a field trip review of the physical
conditions. The applicant or a representative must appear at the meeting.
AUTHORITY AND RESPONSIBILITY
In reviewing a request, the Planning Commission must consider the following:
1. The Planning Commission shall consider all matters presented to it fairly and impar-
tially, recognizing the rights of the applicant as well as its obligation to enforce
all zoning ordinances and resolutions adopted by the City Council of the City of
Rolling Hills.
2. The development and use of all land within the City of Rolling Hills should be directed
to the continuation of the existing rural open areas surrounding the existing residences
in the City, and each new improvement or use of land should be carefully examined to
determine what effect the proposed improvement or use of land will have on the terrain,
trees and natural flora in the City.
3. The granting of variances shall be carefully scrutinized to protect bridle trails,
and provide the proper spacing of residences and accessory building so as to prevent
overconstruction of the lot or parcel to be improved.
