ROLLING HILLS' CONDITIONALLY APPROVING ZONING CASE NO.'273
•
A VARIANCE •
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS HEREBY
RESOLVES AND ORDERS AS FOLLOWS: -
SECTION 1: A public hearing to consider the proposed Variances
with respect to real property described in Exhibit "A" of Zoning Case
No. 273 attached hereto was duly held on March 16, 1982 at 7:30 P.M. in
the Council Chambers of the City Hall, 2 Portuguese Bend Road, Rolling
Hills, California. Notice of the time, date, place and purpose of the
aforesaid hearing was duly given.
SECTION 2: Evidence,. both written and oral, was duly pre-
sented to and considered by the Planning Commissionat the aforesaid
public hearing. Applicant in Zoning Case No. 273 was represented at
the public hearing by Lowell Lusk, the applicant's architect..
SECTION 3: The Planning Commission finds, pursuant to
Sections 17.08.180,.17.08.190 and 17.17.070 of the Rolling Hills
Municipal Code, that:
1. The Commission visited.the;subject property on March ?,
1982.
2. The Commission found that the subject lot is an ..irreg
ularly shaped parcel on steeply sloping terrain, and that subject
property slopes steeply away_ from the street frontage after a yard.
area which..is relatively level.
3. The Commission found that the applicant's home has at
present side yards of 14'6":and 10', and is located approximately 20'
from the front property line and 400' from the rear property line.
4. The Commission .found that the setback proposed by the
applicant may be considered common in the neighborhood of the subject
property, and the proposed room addition is removed topographically
and visually from neighboring. property.
• At an adjourned meeting of the Planning Commission on
April 2, 1982 a Variance for extension of an existing non -conforming
use and a Variance of side yard setback requirements was approved,
subject to the following conditions:
1. This Variance shall not be effective for any purpose until the
owner of the property involved, or his duly authorized representative,.
has filed with the City of Rolling Hills an affidavit stating that he
is aware of and agrees to comply with all conditions of the approval.'
2. It is declared to bethe intent of the Planning Commission that if
any provision of the approval is held or declared to be invalid, the
approval shall be void and the privileges granted thereunder shall lapse.
3. It is .declared and made a condition of the approval that if any
conditions thereof are violated or if any law, statute or ordinance
is violated, the approval shall be suspended and the privileges granted
thereunder shall lapse;. provided that the applicant has been given
written notice to cease such violation and has failed to do so for a
period of thirty (30) days.
4. All requirements of the Zoning Ordinance and of the zone in which
the subject property is located must be complied with unless otherwise
set forth in the approval, or shown otherwise on the approved plan.
5. The property shall be developed and maintained in substantial con-
formance with the site plan on file marked Exhibit "A" except as other-
wise provided herein.
6. Prior to issuance of building permit a grading plan satisfactory to
the City Engineer shall be submitted.
SECTION 4: Based on the foregoing findings the Commission
hereby approves Zoning Case No. 273, a request by Dr. Guy Lemire,
owner of Lot 23-CF, located at 40 Chuckwagon Road, for Variances for
construction of a residence addition in the sideyard setback.
SECTION 5: The secretary, shall certify to the adoption of
this resolution and shall transmit copies of the same to the permit
holder and to the City Clerk..
SECTION 6: This action shall become final and effective
twenty (20) days after the adoption of this resolution unless within
such time an appeal is filed with the City Clerk in accordance with
the provisions of the Rolling Hills Municipal Code. This permit shall
expier unless used within one year from the date of grant.

'CONDITIONS OF APPROVAL - TENNIS COURTS
While a complete list of conditions cannot be recommended until a
public hearing has been held and all testimony taken, the following
list of conditions peairiiatE-a--‘,--` --ts is provided:
1. This Conditional Use Permit shall not be effective for any
purpose until the owner of the property involved, or his duly
authorized representative, has filed with the City Clerk of the
City of Rolling Hills an affidavit stating that he. is aware of
and agrees to comply with all the conditions of the Permit.

9. All proposed wall shall be a uniform earthen color. The color.
and material.sh1 be approved by the Planning Commission.
10. A bond shall depe ited with the City, to be held until
eighteen mon s afte completion, to guarantee the satisfactory
growth and m ntenance of the required landscaping.
11. All landscaping shall b�- planted and the irrigation system shall
be installed concurrent ith completion of the tennis court.
12. Tennis c urt fence shall balck or dark green vinyl coated

13. Additial offstreet parkin:. may be required.
