Planning Commission Resolution No. 90-9-A was approved on May 5, 1990 and a six month time extension was approved on April 16, 1991. Since that time, the applicant has been pursuing the project with the County and all that remains is final approval by the County's Soils and Geology Division. THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. A request has been filed by Mrs. Stephanie Enright with respect to real property located at 35 Chuckwagon Road, Rolling Hills (Lot 18-CF) requesting .a modification to the condition of approval for a Variance to the side yard setback requirements to construct additions to the nonconforming residence, and Site Plan Review. The modification requested is to extend the allowable time period to await final approvals from the County.. Section 2.• The Commission considered this item at its meeting on December 17, 1991 at which time information was presented indicating that the extension of time is necessary due to the need for the Los Angeles County Soils & Geology Division to approve the project. Section 3. Based upon information and evidence submitted, the Planning Commission does hereby amend Paragraph B, Section 7 of Resolution No. 90-9-A and Paragraph 2, Section 3 of Resolution No. 91-10 to read as follows: "B. The Variance approvals shall expire within two years of the approval of this Resolution." Section 4. Mr. Andrews cites the requirement of further design study because the subject site has experienced some land movement that has severely affected the residential structure. Resolution No. 91-10 has been prepared, approving the six month extension, per review and motion by the Planning Commission. • • STAFF REPORT DATE: April 9, 1990 TO: PLANNING COMMISSION FROM: STAFF SUBJECT: ZONING CASE NO. 423; Request for Variance to encroach into the existing nonconforming side yard setbacks to construct additions to the residence and Site Plan Review to determine compatibility of the proposed residential additions and raised wood patio decking with the site; 35 Chuckwagon Road, Lot 18-CF; Owner: Stephanie Enright DISCUSSION The Planning Commission, at their regular meeting of March 20, 1990, continued the above -stated application to an adjourned meeting so as to inspect the site and surrounding properties. The applicant is requesting a variance to permit residential additions that will continue the building lines that perpetuate the nonconforming side yard setbacks. Issues and concerns raised at the previous meeting were discussed as follows: 1. RAS-1 zoned parcels of land require 20 foot side yard setbacks. The applicant desires to continue the easterly existing side yard of 18 feet with a four (4') foot, 64 square foot extension of the house, and the westerly side yard of 14-15 feet with an eight (8') foot, 204 square foot extension. A vicinity map notes the separation from the neighboring residences, and based upon the field inspection, view impairment would not seem to be at issue. Other properties in this area have nonconforming setbacks. Further, the project includes an additional 414 square foot addition and a 1,220 square foot raised wood patio deck that will satisfy required building setbacks. Findings that must be determined include special circumstances applicable to the site, no special privileges, and protecion of the public welfare. 2. Project details indicate that grading on the lot will not be required. Clarification should be made as it pertains to the westerly addition and the proposed substructure. Appropriate work to an existing retaining wall should be noted. Plans must also be noted to include building pad area coverage. The eight findings of fact must be satisfied for approval of site plan review. • • zc423 page 2 RECOMMENDATION Staff recommends that the Planning Commission closely examine the proposed project and potential impacts to the site and surrounding properties in accordance with the purposes and objectives of the Zoning Ordinance that address setback requirements and development compatibility. In order before a variance may be granted, the Commission must determine that there are special circumstances applicable to the property, special privileges are not granted, and it would not be detrimental to the public welfare or injurious to other property. REVIEW AND EVALUATION OF ISSUES In reviewing the applicant's request under Title 17 (Zoning), Staff would identify the following issues for evaluation: 1. The property under application is near the terminus of Chuckwagon Road and developed with a nonconforming residence, in that the required side and front yard setbacks do not comply with the current standards. The applicant is requesting variance relief from the code requirements to permit construction of residential additions that will continue the nonconformity as it pertains to the side yard setbacks. In the RAS-1 zone, 20 feet is required. Other properties in the area have nonconforming setbacks. 2. The project entails a four (4') foot, 64 square foot extension of the house that will continue an 18 foot side yard setback on the easterly side, and an eight (8') foot, 204 square foot extension on the westerly side that continues a 14 to 15 foot side yard setback. Additionally, the project includes a 414 square foot addition and a 1,220 square foot raised wood deck at the rear of the house that complies with required setbacks. 3. The plan indicates that no grading will be required for the proposed project. The plan should, however, be clarified to address the area of the westerly addition and the outcome of an apparent retaining wall that exists. 4. The plans should be clarified to include the building pad area calculations to verify consistency of development policy set forth by the City. s zc423 page 2 RECOMMENDATION Staff recommends that the Planning Commission closely examine the proposed project and potential impacts in accordance with the zoning requirements addressing side yard setback and development compatibility.
