BACKGROUND
Attached is a request from Dr. Lemire for a one year extension for
a previously approved Variance for the encroachment into the side
yard setback of a breakfast nook addition and a bay window addition
to an existing single family residence, an extension to a
previously approved Variance for the continued encroachment of a
stable converted into a guest house in the side yard setback, and
an extension to a previously approved. Conditional Use Permit for a
guest house at the subject site.
Planning Commission Resolution No. 92-1 was approved on January 11,
1992.
Dr. Lemire said that the extension of time is necessary for
financial reasons. .The plan check had been in process with the
County. He explained that the provision to obtain a building
permit within six months for the guest house had slipped his mind.
RECOMMENDATION
It is recommended that the Planning Commission review the request.

A request for a Variance to encroach into the side yard setback to
permit the construction of a breakfast nook addition and a bay
window addition to the existing single family residence, a request
for a Variance to permit the continued encroachment of a building
structure into the side yard setback, and request for a Conditional
Use Permit to permit the conversion of a previously constructed
stable to a guest house.
BACKGROUND
1. The applicants have amended their request and are now also
requesting a Variance to permit the continued encroachment of
a building structure (the former stable converted to a guest
house) 9.4 feet into the side yard setback and a Conditional
Use Permit for a guest house.
2. The Planning Commission viewed a silhouette of the proposed
breakfast nook on October 5, 1991.
3. The applicants are also requesting a Variance to encroach 5
feet into the side yard setback to permit the construction of
a 200 square foot breakfast nook and a Variance -Co 'encroach 2
feet into the side yard setback to permit the construction of
a 20 square foot bay window.
4. Grading will not be required for the project site.
5. The structural lot coverage proposed is 4,655 square feet or
9% (20% permitted) and the total lot coverage proposed is
8,955 square feet or 17.4% (35% permitted).
6. The project has been determined to be categorically exempt
pursuant to the California Environmental Quality Act (CEQA).

1. The Planning Commission viewed a silhouette of the proposed
breakfast nook on October 5, 1991. It was also noted at the
time that the stable had been converted to living quarters and
would need to be reconverted to a stable or a conditional use
permit would be necessary. Los Angeles County building permits
do not reflect the conversion.
2. The applicant is requesting a Variance to encroach 5 feet into
the side yard setback to permit the construction of a 200
square foot breakfast nook and a Variance to encroach 2 feet
into the side yard setback to permit the construction of a 20
square foot bay window.
3. The existing house, garage and stable were built in 1958. A
A private pool was constructed in 1967. Then in 1982, a
Variance was approved for .a 312 square foot bedroom and bath
which was completed in January, 1983.
4. Grading will not be required for the project site.
5. The structural lot coverage proposed is 4,775 square feet or
11.2% (20% permitted) and the total lot coverage proposed is
9,075 square feet or 21.3% (35% permitted).
5. The project has been determined to be categorically exempt

DISCUSSION
In reviewing the applicant's request under Title 17 (Zoning), staff
would identify the following issues for evaluation:
1. The applicant is requesting a Variance to encroach 5 feet into
the side yard setback to permit the construction of a 200
square foot breakfast nook and a Variance to encroach 2 feet
into the side yard setback to permit the construction of a 20
square foot bay window.
2. The existing house, garage and stable were built in 1958. A
