On November 10 the City Council voted to take jurisdiction in the matter, and on December 8, 1986 the Council voted to uphold the Planning Commission's approval of .the front yard variance, and to deny the variance of height limitation requirements. A copy of Resolution No. 557, which was adopted by the City Council on January 12, 1987, is enclosed. The resolution and the recorded acceptance form are to be retained in your file on the property. When the final plan has been signed by the City Manager you are authorized to issue the required permits. We ask, further, that the County Building Inspector monitor the construction as it progresses, to ensure that setbacks and height limitations will be maintained in accordance with the actions of the Planning Commission and City Council. At the November 10, 1986 meeting of the City Council, the Council decided to take jurisdiction of the matter, pursuant to Section 17.32.140 (C) of the Municipal Code. A public hearing was set for December 8, 1986, and it was the decision of the City Council that the front yard setback variance sought in Zoning Case No. 334 be approved, and the request for the height variance denied. Attached is Resolution No. 557, passed, approved and adopted on January 12, 1987. An acceptance form as required by Ordinance No. 207 is enclosed. When the Affidavit of Acceptance, duly executed and recorded, has been returned to the City, the Los Angeles County Department of Building and Safety will be notified that building permits can be issued. On October 21 a request for a Variance for encroachment into the established front yard, resulting in a 32' setback instead of the existing 33' setback for a residence addition was approved by unanimous vote of the Planning Commission. A request for a Variance of height limitation standards for a basement at the rear of the residence was approved with findings that a hardship exists because of topography and the shape of the lot, and because the request was supported by residents in the vicinity. Three members of the Commission voted for approval; two members voted against the motion. At the. November 10, 1986 meeting, of the City Council Councilwoman Murdock moved that the City Council take jurisdiction of the matter pursuant to Section 17.31.140 (C) of. the Municipal Code, stating that she considers the proof of hardship inadequate. The motion was seconded by Councilwoman Leeuwenburgh and carried with -three affirmative votes of the Council and two votes against the motion. At the City Council meeting on November 24, 1986 a public hearing on the matter will be heard. A field trip has been set for Monday, December 8, 1986 at 7:30-a.m. on your property at 33 Chuckwagon Road. Copies of the minutes of the Planning Commission meeting on October 21, 1986 and the minutes of the City Council on November 10, 1986 relative to your property are enclosed for your information.
