SUBJECT: ZONING CASE NO. 415; Request for a Conditional Use Permit to
establish and maintain a Guest House and Site Plan Review to
determine compatibility of the proposed guest house with the
site; 12 1/2 Upper Blackwater Canyon Road, Lot 97-2-RH;

DISCUSSION
The Planning Commission, at their regular meeting of January 16, 1990,
continued the above -stated application to an adjourned meeting so as to
conduct a field trip to inspect the site and surrounding properties. The
applicant is requesting a conditional use permit and site plan review to
establish a 789 square foot guest house on the property.
Issues raised at the previous meetings included the following:
1. Required setback at the rear has been accomodated so as to
maintain a minimum 50 foot dictated separation from an identified flood
hazard area.
2. Grading impacts resulting from the 110 cubic yard cut/fill to
create a pad on the slope.
3. Compatibility of the use and landscaping to replant the site
4. The residence currently under construction was approved prior to
the City's Site Plan Review Ordinance. Plans for the residence, grading,
retaining walls, and pool have been approved by the City and Community
Association, and are inspected by the County.
RECOMMENDATION
Staff recommends that the Planning Commission closely examine the proposal
for land use compatibility, and evaluate potential impacts to the site and
surrounding properties. Before a conditional use permit may be granted,
the Commission must determine if the required showing is present in that
granting of the conditional use permit would be consistent with the
purposes and objectives of the zoning ordinance, and would be desirable to
the public convenience and welfare. Further, the Commission must consider
site plan review for the project and determine that findings required for
site plan review as set forth by the ordinance are satisfied.

REVIEW AND EVALUATION OF ISSUES,
In reviewing the applicant's request under Title 17 (Zoning), Staff would
identify the following issues:
1. The property under application is a parcel created by the 1987
Farrow subdivision (Lot 2, Parcel Map 16864). A new residence with
attached garage is currently under construction. This project had been
approved prior to the City's site plan review process.
2. The applicant proposes to establish and maintain a 789 square foot
guest house to the rear of the main residence. A restriction of the prior
subdivision called for a 50 foot setback from the easterly (rear) property
line of this "Lot 2" due to an identified flood hazard area. The
applicant's plans accomodate the setback restriction for all construction
and grading in the hazard area.
3. Grading work calls for 110 cubic yards of dirt quantity for the
cut/fill balance to create a pad area for the guest house structure. The
grading fill is directed to an area north of the residence. A 200 square
foot future stable with access is noted on the plans. Landscape plans to
screen the proposed structure and replant the site should be required by
the applicant for City review.
4. The Code prohibits guest homes to have kitchen facilities or to be
rented. Should the project be approved, appropriate conditions must be
imposed to assure compliance with the ordinance.

The Commission should receive public testimony and continue the matter to
an adjourned meeting so as to inspect the site and surrounding properties.
