Dear Mr. Smith:
AUG 0 a 289.8
CITY OF :ROLLING H jLS
In response to your letter of August 7t'', 2000, regarding the easement encroachment at the
South end of your property, we were reacting to what was obviously a violation of Rolling
Hills regulations (City and RHCA). It is true we are active in Caballeros and the preservation
of easements and the trail system; however, our notice to the City regarding the project at
the South end of your property was to stop apparently un-permitted construction in the
easement. Your easements may or may not be utilized by hikers or riders for whatever
reason, but as you and all Rolling Hills owners know, easements must be kept open and
unobstructed. That is the only issue. If both the City and Association later permit the
obstruction, the easement should be vacated to you since the original easement is no longer
a benefit to the Association.
On another matter regarding the City's "Stop Order", we do not feel it was right for the City
to allow your construction to proceed without a permit even though the consequences of
doing so may have been very cleat. When un-permitted construction is identified by
essentially every City in our County, the owner is given a Stop Work Notice by the
responsible agency and directed to apply for a permit.
Very truly
s,
Mr. and Mrs. David Bret olz
