Evidence was presented that the driveway had been moved south (although slightly) as directed by the Council in Condition J. The Council found the new driveways locations satisfactory and compliant with Condition No. J, and the condition was hence satisfied. The driveways shall be developed as shown on the plan submitted for the meeting, on file with the City, stamp dated June 06, 2014. Specifically, the City Council required that the approaches and the portion of the driveways located on 38 Eastfield Drive have a porous surface, such as pavers. Please note that this approval is for a CUP, Variances and Site Plan Review for construction only necessary to construct the approved driveways and does not include any other grading or improvements elsewhere on your property. In addition, the abandoned portion of the existing driveway must be removed and a rolled curb constructed. Any landscaping you wish to introduce in the roadway or side easements must be reviewed and approved by the RHCA. Please also be advised that the City does not review construction of pilasters; and although shown on the plan are not part of this approval. As I am sure your file in this matter reflects, the efforts to obtain an additional driveway entrance so that my property at 40 Eastfield Drive and the Cootes' property at 42 Eastfield Drive may have separate entrances to their respective residences has been ongoing for over three years, as indicated in my status letter to you of March 24, 2010. Since before March 24, 2010, Mr. Cootes and I have been in constant discussions with the Baers (38 Eastfield Drive) regarding a mutually agreeable design for the requested driveway approaches. This eventual agreement was achieved alter several in person meetings, over twenty thousand dollars in engineering costs and application fees, eventual approval by the City's Traffic Engineer, Traffic Commission, and Planning Commission. Specifically, on January 26, 2012, the Traffic Commission, with the Baers' consent and approval, approved the third driveway approach on 38 Eastfield Drive. The third driveway approach was also approved by the City's Traffic Engineer. • Anton Dahlerbuech City Manager May 2, 2013 Page 2 The Planning Commission visited the site on August 14, 2012. On September 18, 2012, the Planning Commission approved the third driveway approach and required retaining walls as recommended by the City of Rolling Hill's staff in their Planning Commission Board Report for the September 18, 2012, Planning Commission meeting, (See Board Report, p. 2). In fact, at the City Council meeting on October 22, 2012, Councilmembers Lay and Hill both indicated that they were in favor of approving the CUP and variances required for the third driveway approach. Mayor Black indicated that he felt there would be too much asphalt intersecting into Eastfield Drive and that his property suffered from sharing a driveway with his neighbor. The Council then voted to continue the matter to provide me an opportunity to address the concerns of Mayor Black. The minutes of the meeting are inaccurate in that the matter was not denied but rather continued. I am sure a recording of the meeting would substantiate the actions of the City Council of continuing the matter. At the most recent City Council meeting regarding this issue on March 11, 2013, the Council reviewed my revised plan which consisted of moving the driveway two arlditional feet from the Baer's driveway. Because Mayor Black was not at the meeting the Council again voted to continue the matter to a date to be determined so that the new Council could hear the matter en bane. Mr. Cootes and I will continue to work with the Baers to again obtain mutual approval of the driveway approach design, even though we already had this mutual agreement at both the Traffic Commission and Planning Commission levels. The purpose of our visit was to investigate earth/dirt moving work allegedly being done on your property. We observed that work appeared to have been recently done at both the front and rear of your property. The following are our findings and direction to you. Work at front of property At the front of your property, the ivy-covered slope has been disturbed with a slope cut more than 3-feet in depth. This work constitutes "grading" (under the Municipal Code definition) and therefore requires a grading permit from the Los Angeles County Department of Building and Safety. Your options are either to 1) obtain approval for the grading work from both the County, based on conformity with building regulations, and the City, based on Municipal Code zoning regulations, or 2) restore the slope. Under the first option, to obtain approval from the County you will need to demonstrate first whether a grading permit is required. To do this you will need to commission a civil engineer to prepare a plan that would define the scope of work and assess slope and soil stability. To obtain approval from the City, regardless a grading permit is found to be required, you will need to supplement your prior planning approval (Resolution 1028, 11/26/07) by obtaining a Variance to exceed the maximum 40% allowed "disturbed area" on your property. If you opt to restore the slope, you will need to move the dirt back to its original location and immediately plant the slope and/or cover with mesh for erosion control. Work at the rear of property At the rear, closer to Outrider Road, we observed that the ground surface of an existing flat area appears to have been scraped and a narrow foot path cut that leads from the play yard down a Nicholas Tonsich September 28, 2009 slope to the lower flat area. In a conversation with Ms. Schwartz, you stated that your gardener had scraped weeds and vegetation in the lower area, and created a narrow path and that you wish to lay decomposed granite (D.G.) down in both the lower area and on the path. Your plan is acceptable, as long as you move no more dirt in either the lower flat or path areas, and that you keen the existing configuration of the lower pad. It is also required that no decomposed granite be placed on the slope between the house and lower level, and that you plant this slope immediately where necessary to control erosion. Please be advised that most of the lower pad area is located in the rear setback for your lot. Therefore no structures, including roofed play equipment or forts are allowed in this area (see zoning regulation 17.16.200 J. and L. attached). It is requested that you advise of your intent in resolving this matter by contacting either Ms. Schwartz or me within two weeks (by October 12th). Please be advised that it is against the City policy to allow new poles to be installed, without the City's permission and unless conditions of the property, such as existence of canyons or streams, preclude one from placing utility lines underground. We understand that the request to relocate Mr. Tonsich's telephone line was initiated by a private individual, Mr. Bauer, because Mr. Tonsich's line crossed Mr. Bauer's driveway. We would like to inform you that Mr. Tonsich, 40 Eastfield Drive, was recently granted City approvals to make improvements to his property. One of the conditions of approval requires that prior to finaling the construction, all of the utility lines serving 40 Eastfield Drive be placed underground. Once the telephone line extending from the new pole to 40 Eastfield Drive is placed underground, we will require that Verizon, at its sole expense, remove the recently installed pole. This letter will serve to confirm my request to allow the powerlines, currently running from Eastfield Drive across the top of my pool to the electrical panel on my house, to be relocated to the power pole located on Eastfield Drive between 38 Eastfield Drive and 40 Eastfield Drive, overhead to a new panel installed on my garage. I initially undertook the relocation of the powerlines because it seemed unsafe to have them running over the top of my pool. In furtherance of relocating the powerlines I spoke with Kenneth L. Allen of the Planning Department for Southern California Edison. Mr. Allen met with me at my property and indicated that the powerlines could be relocated by having them run from the existing power pole between 38 Eastfield Drive and 40 Eastfield Drive to a new panel located at my garage. Thereafter, I obtained the permit to relocate the panel from the Department of Building and Safety. At no time was I advised that the relocation of the panel would require me to have the powerlines placed underground. It was not until the inspector from the Department of Building and Safety, Rafael Bernal, inspected the new panel on my garage that I was informed that the City of Rolling Hills may require the powerlines to be placed underground. My request for a variance from the requirement that the powerlines be placed underground is based on several factors. First, had I known at the time I obtained the electrical permit that the lines were required to be placed underground I would not have placed a new panel on my garage, • • Craig R. Nealis October 8, 1997 Page 2 but merely ran the lines from my existing panel to Eastfield Drive which would have required a trench only on my property. Second, in order to place the lines underground at this time a trench would have to be placed almost entirely on the property of 38 Eastfield Drive. To obviate the need to remove driveways on either my property or 38 Eastfield Drive, a majority of the trees and shrubbery which divide the two properties would have to be removed as well. Third, in order to avoid the placement of the trench entirely on the property of 38 Eastfield Drive, I would essentially have to remove my driveway which would be cost prohibitive. Therefore, I request that the City allow me to run the lines from my garage to the existing power pole located between 38 Eastfield Drive and 40 Eastfield Drive. I will agree to place the lines underground when I have my driveway removed and replaced with an interlocking stone material within the next 24 months, which should provide me with enough time to have plans approved for the reconstruction and expansion of my garages. I appreciate your prompt attention to this matter since the current powerlines feed through the roof of my house and prevent the completion of my new roof thereby creating a risk of water damage should we experience heavy rains in the near future. (Ord. 257-U §4(part), 1995). 15.16.060 Section 83-1, Installation, amended. Sec- tion 83-1 of the Electrical Code of the City of Rolling Hills is subject to the following exceptions: A. Overhead service shall not be installed except to supply temporary service used for construction purposes only. B. The wiring between the serving electrical power and communications utilities systems and the premises served and the wiring between separate buildings shall be installed underground. C. Underground services may be installed in rigid, nonmetallic conduit or armored cable approved for under- ground installations and shall conform to Public Utilities Requirements and Standards and as approved by the Chief Electrical Inspector. (Ord. 257-U §4(part), 1995). 15.16.070 Amendment --Fees. Notwithstanding the pro- visions of Section 15.16.010, the Electrical Code is amend- ed by increasing the amount of each and every fee set forth in Section 82-8 to a sum set by resolution of the City Council. (Ord. 257-U §4(part), 1995). 15.16.080 Violations and penalties. A. No person, firm or corporation shall violate any of the provisions of the Electrical Code. Each person, firm or corporation violating any of the provisions of the Electrical Code shall be deemed guilty of a separate offense for each day or portion thereof during which such violation is commit- ted, continued or permitted and shall be punishable by a fine of not to exceed one thousand dollars or by imprison- ment in the County Jail for a period of not more than six months or by both such fine and imprisonment. B. In addition to the penalty set forth in subsection (A) of this section any person who shall commence any elec- trical work for which a permit is required without first having obtained a permit therefor shall, if subsequently permitted to obtain a permit, pay double the permit costs fixed by Section 82-8 of the Electrical Code for such work. (d) Uncovering. Said Chief Electrical Inspector shall have the author- ity to remove, or to require the removal of, any obstruction which prevents proper inspection of any electrical equipment. (e) Corrections. All defects shall be corrected within 10 days after in- spection and notification or within such other reasonable time as is per- mitted by the Chief Electrical Inspector. (f) Approval. Upon the completion of the electrical wiring in or on any building or structure of any nature, or tent, or premises, except as other- wise exempted in this Code, the person, firm or corporation installing the same shall notify the Chief Electrical Inspector, who shall inspect such installation, and if it is found by him to be fully in compliance with the pro- visions of this Code and all other laws and ordinances applicable thereto, he shall issue, as provided for herein, the certificate of inspection or ap- proval notice authorizing connection of the electrical service and the ener- gizing of the installation. (g) Connection. It shall be unlawful to energize or cause or permit to be energized any electrical wiring coming under the provisions of this Code, until such electrical wiring shall have been inspected and approved by the Chief Electrical Inspector. Provided, however, that temporary permission may be given to furnish electric current to, or the use of electric current through any electrical wiring for a length of time not exceeding 30 days, or other reasonable period if it appears to said Chief Electrical Inspector that such electrical wiring may be used safely for such purpose, and that there exists an urgent necessity for such use. • ARTICLE 83. REQUIREMENTS FOR INSTALLATION - METHODS AND MATERIALS SEC. 83-1. Installation All electrical installation shall be in conformity with the provisions of this Code, and shall be in conformity with approved standards for safety to life and property. Where no specific type or class of material, or no specific standards are prescribed by this Code, or by the National Electrical Code, conformity with a standard designated by the Chief Electrical Inspector shall be prima facie evidence of conformity with an approved standard for safety to life and property. SEC. 83-2. Materials All electrical materials, devices, appliances and equipment shall be in conformity with the provision of this Code, and shall comply with nation- ally recognized standards, acceptable to the Chief Electrical Inspector. Install marble mantles for fireplaces. 14. Rewire interior telephone lines; 15. Install security alarm. I • Lola M. Ungar October 30, 1998 Pan 3 I have retained an architect to draw the north elevations of my house which depict the windows which were installed. Pursuant to my conversation with Peggy, I will be submitting the elevations along with photographs to the Rolling Hills Community Association ("RHCA") for approval. Since the rough window openings remained the same, I do no anticipate the need to obtain structural permits. The remaining work on my home either has been permitted or is simply refurbishing existing construction. A few months ago I was visited by two Los Angeles County Firemen who requested that I remove the brush and weeds from the eastern hillside of my property. Thereafter, I hired a bobcat operator to clear the hillside and lower portion of my lot. There were no cuts or fills made on the hillside or lower lot, the size of the hill and lower lot are the same as they have always been since I have owned the property. On October 29, 1998, I had a telephone conversation with Craig. Craig asked me to address the current condition of the electrical service to my house in relation to the recent resurfacing of my driveway. I realize that the City of Rolling Hills authorized me to move the electrical service to a new drop on my property, so as to remove the condition of the electrical lines running over the top of my pool, based on my agreement to bury the lines when I tore out and replaced my driveway. I was under the impression that the need to bury the lines was precipitated by my initial request to run the power lines from the pole next to the Smith's property at 38 Eastfield Drive, across their driveway and to my electrical panel. This was based on the requirement that I had to obtain Mr. Smith's permission to run the lines across his property. When Southern California Edison ran the lines from the original power pole entirely across my property to my electrical panel, it did not seem that the need to bury the lines was as important since they do not impact the Smith's property nor are they visible to anyone who is not on my property based on the slope of my lot. Additionally, because of time constraints in preparing my house for my wedding reception, I really did not have time to have the driveway removed and replaced, so I merely had it resurfaced. I would appreciate a further accommodation regarding the electrical line issue. I would rather not have to remove the driveway or the trees between the Smith's property and mine so that a trench can be placed for the lines at this time. I am sure that the driveway will be removed by either myself or a subsequent owner. At that time the lines can be buried. • Lola M.
