The current owners recently acquired the property with one of the oldest, original homes in Rolling Hills. In studying the existing structure, the owners's decided to repair and restore the dwelling and add a closet onto the master beroom. Unfortunately, flawed site plans on file at the city were relied upon. As the construction of the closet addition was nearing completion, a hostile neighbor complained about the construction. A new survey revealed a 7.5 foot encroachment into the 20' sideyard setback. The owners stopped work iri early 2015 and now filing this application at the request of the planning director. Several variances have been reviewed and the City council has taken jurisdiction of the project. SITE PLAN REVIEW CRITERIA Site Plan Review criteria upon which the Planning Commission must make an affirmative finding. Describe in detail the project's conformance with the criteria below: A. Is the project compatible with the General Plan, the Zoning Ordinance and surrounding uses? Explain how it compares to the sizes, setbacks and other characteristics of neighboring houses. Being one of the older properties in Rolling Hills, the owner was interested in preserving as much of the historical fabric as possible. This is one of the smalles properties in the zone. There are several existing non conforming conditions with the existing barn encroaching in the 20' sideyard setback along the northerly property line. The master bedroom closet addition encroaches into the southerly 20' side yard setback. Strong vegetation helps soften these encroachments. There will be 10 cubic yards of grading to complete a retaining wall 4' away from the corner of the master bedroom closet addition. The project is compatible with the zone as it is one of the original homes in RH. B. How does the project preserve and integrate into the site design, to the maximum extent feasible, existing natural topographic features of the lot including surrounding native vegetation, mature trees, drainage courses, and land forms (such as hillsides and knolls)? Explain how the project preserves and integrates existing natural features. The oroiect dos not significantly alter the native vegetation, mature trees, drainage courses or hillsides. A7' retaining wall MkK is proposed to replace an old PV Stone rubble wall that was removed during demolition in early 2015. The owners would like to keep all mature trees, including the pine tree at the south boundary discussed by the City Council. Being a restoration project by the current owners, the project will preserve natural features including the old house & other existing structures on the property. C. How does the site development plan follow natural contours of the site to minimize grading? Extensive grading and recontouring of existing terrain to maximize buildable area shall not be approved. Graded slopes shall be rounded and contoured so as to blend with existing terrain. Grading shall not modify existing drainage or redirect drainage flow unless into an existing drainage course. Explain the nature and extent of the impact of grading and proposed minimization on lots. iO yards of grading is proposed to construct a masonry wall where the PV Stone rubble wall previously existed. This is grading to trim existing slopes and backfill for the new retaining wall. The owner wishes to preserve all the existing mature vegetation and landscaping on the property. E. How does the site development plan preserve the natural and undeveloped state of the lot by minimizing building coverage? Lot coverage requirements shall be regarded as maximums and the actual amount of lot coverage permitted should depend upon the existing buildable area of the lot. The structural lot coverage is 16% with 20% maximum allowed. The total lot coverage of structures and flatwork is 28.1% with 35% allowed F. Is the site development plan harmonious in scale and mass with the site, the natural terrain and surrounding residences? Setbacks shall be regarded as minimums and more restrictive setbacks shall be imposed where necessary to assure proportionality and openness. Explain how the proposed project setbacks compare with the existing setbacks of neighboring properties. The renovation of the existing dwelling is harmonious and in scale with the surrounding residences, even with the small lot area. The setback issues have been discussed previously, overall the project seems to fit well in this existing neighborhood. No exotic grading is proposed or required. G. . Is the site development plan sensitive and not detrimental to convenience and safety of circulation for pedestrians and vehicles? Explain how the number and types of vehicles relate to the driveway location, design, landscaping and other on -site parking or storage areas. There is no change to the traffic generated by the restoration of the existing dwelling. Once the application is completed and received, the request will be placed on agenda for a future Board of Directors meeting. Association Members will be notified of your request and the matter will be posted in the Association or City mailings. 2. When the Board first reviews your request, they will schedule a field trip to the property. No discussion or decisions will be made on the field trip. Property and easement lines are required to be staked prior to the Board's field visit. If the property is not properly marked the field trip will be cancelled and the application will be removed from the meeting agenda. 3. The Board will visit the site and view the existing conditions. It is helpful to have someone present who is familiar with the property to answer any questions that arise. 4. The license agreement will provide that RHCA has the right to revoke the license if the applicant fails to maintain the subject easement or any conditions of the agreement. 06.23.15 Page 4 of 4 r October 29, 2015 Board of Directors Rolling Hills Community Association No. 1 Portuguese Bend Road Rolling Hills, CA 90274 RE: NUCCION EASEMENT LICENSCE REQUEST Dear Board Members, We are requesting an easement license for a fence at our property on 18 Portuguese Bend Road. Our lot is unique in that was a subdivision and the resultant grading has not left a logical placement for a fence outside of the given easements. Though our lot is as narrow as our our neighbor at 15 Portuguese Bend Road, our side easement is two and a half times as large as theirs. Unfortunately, we have had some imminent pet and personal safety concerns that make placing a fence very important, and thereby necessitating this request. 1. Easement Location North easement, between our property and 15 Portuguese Bend Road 2. Description of Item in Easement Three -rail fence with appropriate wire reinforcement. The fence would be placed approximately f' o'tie property line along the Northern border of our property. 3. Summary of Request 3.1 We need the fence in order to protect our pets and ourselves. We have had numerous coyotes access our backyard. The path they take goes from the bottom of the Blackwater Canyon trail, up the side easement between our property and 15 Portuguese Bend Road and then into our backyard. We have 4 cats and two older dogs, all of whom are presently vulnerable. A fence along this easement would make it much more difficult for coyotes to enter our property. Our Golden Retriever was also poisoned recently. The toxin was radiator coolant. We do not have any radiator coolant in our possession. A common mechanism for poisoning dogs is to soak dog treats in radiator coolant, causing a painful death. We witnessed our dog on the property of 15 Portuguese Bend Road 6 hours before he manifested symptoms. We have attached a police report describing the incident. We need the fence to keep our animals on our property and not allow them to access other, more hostile, properties. • • Finally, the home at 15 Portuguese Bend Road is non -owner occupied. The present resident has been witnessed on our property for no reason. A fence would provide a barrier to uninvited persons who presently have easy access to our home. Given the above safety reasons, the need for a fence is obvious. The reason we need to place the fence in the easement is primarily one of topography. Our lot was a subdivision and much grading had to be done in order to create a building pad. The lot is much more narrow than it is long and there are slopes both at our southern and northern borders. Placing the fence five feet from the property line places the fence in the most logical position based on the slope of the property, the present approved landscaping, and our septic tank. It would allow access to our property on both sides of the fence. It would also give five feet of easement for allowable access between properties. Combined with the easement required from our neighbors at 15 Portuguese Bend, there should be no safety or access issue. The easement in question is not a bridle trail and it is not used to access the Blackwater Canyon riding trail because of the unfavorable topography. 3.2 We cannot place the fence any further away from the property line than we have requested. Our driveway, approved landscaping, pool and the slope of our hill make it only feasible to place the fence in the requested location. 3.3 There are no obvious deleterious effects on RHCA with our proposed fence. The easement is not used as a bridle trail and there are no utilities in the easement. The utility pole on our property will be removed within the next six months, so no outside entity would need to access the easement. The location would allow access on both sides of the fence. Our neighbor has much shrubbery and overgrowth in the easement which presently obstructs the easement. We would be willing to pay for the removal of any and all easement shrubbery, planting or trees in order to improve access and safety if our request is granted. The Nuccions filed a request for a license agreement to remove the 70 year old wire fence.and replace it with a three rail fence. The the reason they gave was to secure their property from the Hassoldts. They swore under oath that they were afraid and we were hostel and threatening. Neighborhood calls quickly alerted us to this action which was posted at the front desk of the association. William called the association and Kathryn Bishop forwarded a copy of the application to him. At a later time William called and spoke to Kristen Raig and she informed him the application and information had been shredded. The Nuccions were using the City and the association to malign our name and to intimidate me to cut the trees. The association wants the wire fence removed as part of the approval for the wall to be constructed in the easement. Also the pine tree which is clearly on our property as shown by the survey is to be removed even though two arborist have declared it to be safe.
