Following our conversation on August 23, 2010 and per my correspondence of January 12,
2010, this letter is to confirm that prior to October 30, 2010, the view established by City
Council Resolution 834, per the attached photo, must be restored. With nesting season
concluded as of August 1, it is necessary to trim your trees and specifically lower the tree
identified with the hawk's nest which was untouched in the 2009 trimming. It would
appear that only the growth above the nest would need to be removed, leaving the nest in
place.
A cursory review of the parcel map and an informal conversation with Ross Bolton several
months ago, who recalls surveying the property line at one time, suggests that the property
line with your neighbor to the north follows the drainage course/canyon. As such, it
appears that the tree with the nest is on your property. If you feel that this particular tree is
not on your property and, therefore, not subject to Resolution 834, please provide the City
with appropriate documentation, such as a survey, indicating as such.
A failure to restore the view prior to October 30 will result in further code enforcement
action. However, it is our hope and intent to avoid such action with your cooperation and
trimming within the next 60 days.
