The Flying Triangle sector of the City falls within this category, therefore no permits can be issued for any new work in this area. In order to obtain any permits, the site must first be evaluated for geological safe:G'y as a buildable site. A geological report must be prepared and submitted by a certified engineering geologist licensed by the State of California. The report„must contain recommendations for corrective action to stabilize the landslide; For specific technical requirements relative to stabilization of the landslide, please contact Mr. Art Keene, County Geologist, at (213) 738-2169. Such precautionary measures shall be as follows: (1) No imported material shall be brought into the Flying Triangle landslide area from without the area that will create a surcharge on the existing landslide. (2) All open fissures shall be filled with onsite material or material obtained from adjacent properties within the Flying Triangle landslide area with the owner's consent for redistribution on said property. (3) Total weight of any construction equipment and its contents shall not exceed three tons including truck, backhoe, tractor, dumpster or similar equipment. (5) All material from the demolished structure shall be exported outside of the City limits. P 494 145 587 Order to Abate Nuisance, Lot 13-FT 2 Ranchero Road, Rolling Hills CA The City Council of the City of Rolling Hills did, at its regular meeting of March 25, 1985, conduct a public hearing, duly noticed, at which testimony and evidence was submitted by all interested persons in the matter of abatement of a public nuisance at 2 Ranchero Road in the City of Rolling Hills. Upon consideration of all the evidence and testimony submitted, the City Council did find that a public nuisance exists at 2 Ranchero Road, to wit: A building was constructed without a building permit or geologic study; construction proceeded to completion after. a "stop work order" was issued; the structure was roofed with illegal roofing material; all of the above being in violation of the Roll- ing Hills Municipal Code, including Section 308(b)2 pertaining to prohibition of building in a geologic hazard area. Further, testi- mony from the District (City) Engineer indicates a "surcharge" on the landslide area may exist as a result of this construction which could create a hazard for adjacent properties. . As a result of these findings, the City Council has ordered you to abate the nuisance and return the property to its original condition prior to construction of the illegal structure within 30 days of this written notice. Herrick was directed by Art Keene, County Geologist, to construct a retaining wall on the property for purposes of curing a fissure problem which was developing. B. Keene recommended a retaining wall so that dirt could be taken from one part of the property to another and used to fill in the fissures. C. Wall was constructed and extended to include a foundation. Structure was erected in order to provide storage facility. D. Keene stated on March 20, 1985 that the structure's weight and configuration are not geologically significant with respect to the existing slide. The presence of the structure has no material impact on any aspect of the slide. E. The structure was built at a cost of $42,000. The structure is an extension of the retaining wall built at the request of the County Engineer. F. Herrick requests that a permit for the structure be issued. Herrick requests that it be made a matter of public record that he is fully aware of the eventual impact on the structure from the slide. G. I apprised him of the hearing date and time for the City Council to hear arguments and explained that the administrative process as set forth in the Municipal Code is straight -forward and provides for no administrative discretion at this function. Leach, City Manager SUBJECT: Abatement of Nuisance, 2 Ranchero Road INCORPORATED JANUARY 24, 1957 NO. 2 PORTUGUESE BEND ROAD ROLLING HILLS, CALIF. 90274 (213) 377-1521 March 11, 1985 On February 25, 1985 the City Council, at a regular meeting, did find and determine that a nuisance exists upon property located at 2 Ranchero Road, said nuisance being: Building a structure without prior authorization or building permit Construction of a building in a geologically hazardous area is a violation of Sections 301 and 308(b) of the Building Code The City Council instructed the City Manager to invoke the provisions of Chapter 8.24 (Abatement of Nuisance). The owners and persons in possession of the property at 2 Ranchero Road, Mr. and Mrs. Douglas Herrick, were notified in writing by certified mail (Certified Mail #P 494 145 588) of the Code violations and ordered to remove the structure within fifteen days of the notice to abate. The accompanying photographs taken this date (March 11, 1985) indicate that no "good faith efforts toward abatement" had been made as of this date. RECOMMENDATION At the expiration of the fifteen day notice to abate, if good faith effort to remove the nuisance has not been made, that a public hearing be set before the City Council for. the regular meet- ing on March 25, 1985 to hear and consider any protest of the owner, possessor or other interested person. Upon hearing the evidence submitted, the City Council make a determination as to whether the evidence constitutes a public nuisance, and if so found, order the abatement thereof. The Board of Directors appreciates the prompt action taken by the City to provide compliance with building requirements in Rolling Hills. In regard to the final paragraph of the report, mention is made that "It is also surprising that all of this material, including large concrete delivery trucks, passed through the City gates without a challenge with full knowledge of their destination." trucks To clarify your record, large concrete/did not enter Rolling Hills. Laborers contacted by Roger Vink said they hand -mixed the concrete on the site and Mr. Herrick advised him that the building materials had been stored on the property when he pur- chased it. Trucks with sand and bricks were stopped at the gates and Mr. Herrick discussed the "repairs" he was making on his property with Mayor Leeuwenburgh and City staff. It is my understanding that a "weight exchange" agreement was arranged to remove damaged bricks and replace with new ones. Leach Interim City Manager City of Rolling Hills William Magill /ilk — Sr. Building Engineering Inspector STRUCTURE UNDER CONSTRUCTION AT #2 RANCHERO, CITY OF ROLLING HILLS On February 21, 1985 I received a notice that a stable was under construction at #2 Ranchero Road. An inspection was made the same day; and it was found that a garage and workshop had been built with neither geological or plan approval, building permit nor inspection. The wood frame structure is approximately 22' by 64' with a concrete slab floor. The rear foundation is both a five foot retaining wall and supports for the garage. The wood shakes on the roof do not appear to be Class B fire retardant treated. The owner was not at home at the time of the inspection; however, a stop work order and a ten—day notice (copy attached) was left with one of the workers. It was estimated that approximately 34 cubic yards of concrete were poured in the footings and slab. Approximately 2500 brick were used in the retaining wall and at least one truckload of lumber for the building. This would mean that at least eight truckloads of materials had to be delivered to the site. On November 9, 1984 a meeting was held with Mr. Herrick on his property at #2 Ranchero Road. In attendance were Art Keene, County Geologist; Bill Magill, inspector; Harry Kondo, District Engineer; City Manager Ron Molendyk; members of the City Council and homeowners' association. At issue at the meeting was the method of filling ground fissures on his property to prevent rain water from flowing into the underlying soil strata. Mr. Herrick proposed to import from outside the City limits sandy or like material for this purpose. He was, however, admonished by Mr. Keene that, that was not permitted and no material that will add to the slide force and disturbing the soil balance, as well, can be imported from outside the slide area, Only material on his own property can be rearranged for this purpose. However, Mr. Herrick stated that there was insufficient soil on his property to accomplish this work. At which time a suggestion was made that soil from Mrs. Wagner's property, with proper authorization, could be used to fill the fissures. Mr. Herrick stated this was a fine idea; he welcomed it and verbally agreed to it in everyones presence. The meeting with him then concluded. With this in mind, Mr. Herrick is fully aware that no material, be it soil, sand or construction materials, can be brought into the slide area. Therefore, Mr. Joseph P.
