Dear Mr. and Mrs. Olson:
The City of Rolling Hills has been asked to provide the City of Rolling Hills Estates and
the PV Peninsula Land Conservancy with access to George F. Canyon through the trail
easement between 11 and 16 Roadrunner Road as they proceed to implement a State
Grant that will restore the canyon vegetation. They have asked the City to allow entry
and parking on February 26 by 2 vehicles as they will be unloading approximately 1,000
plants for installation within the nature preserve. With the City's permission, this
particular access will avoid their making the 1 mile -long trip from the Eastfield
entrance.
We are writing to advise you of this request and ascertain if there are objections or
concerns. If this does not pose a problem, we will grant the City of RHE and PVPLC
with the access and parking they have requested.
We appreciate your responding to us by Thursday, February 22, 2007 in writing (by
email or letter). You can respond to either me or Marilyn Kern at either

Thank you for taking the time to meet with Tony Dahlerbruch, City Manger and me on
December 5, 2006. At the meeting you requested a legal opinion as to the City's authority
to require that you comply with the Municipals Code to underground the utility lines on
your property or apply for a Variance and pay a $750 fee, in light of the fact that you
encountered a physical obstacle while attempting to underground the utilities.
Michael Jenkins, City Attorney provided such an opinion. In a letter dated December 6,
2006, the City Attorney wrote that City staff has no authority to provide any relief from
the Municipal Code requirement that utilities be undergrounded whenever a remodeling
project results in the enlargement of the building footprint. He further reiterated staff's
position that you must apply for a Variance and submit a complete application and pay
the required processing fee of $750.
Therefore, please submit an application for a Variance with the appropriate plans and fees
no later than March 1. 2007, so that your request may be placed at the March 20, 2007
Planning Commission meting.
If you don't meet this timeline, you will give us no choice but to take appropriate code
enforcement measures to enforce the City of Rolling Hills Municipal Code, which
includes referring this matter to the Los Angeles County District Attorney's office for
disposition.

This letter is to notify you that the City directed the County Building and Safety inspector to
inspect your electric work and to release the electricity to your property via above ground
connection to the new meter panel. This action was taken at the advice of the Southern California
Edison Company inspector, who deemed the sagging power lines over your driveway dangerous.
In my letter to you dated September 26, 2006, I explained the City requirements for
undergrounding of utility lines when adding square footage to a residence or lengthening
electrical service. Your addition to the house triggered the requirement that you place utility lines
underground.
In your letter dated November 24, 2006. you request a waiver from the Zoning Ordinance
requirement for undergrounding of utilities. As I explained to you before, staff has no authority to
waive Zoning Ordinance requirements. Your option is to apply to the Planning Commission for a
Variance from this requirement.
My last correspondence to you included the application forms and other pertinent materials
required to be filed for the Variance. The fee for this application would be $950, ($750 for minor
Variance and $200 for environmental review). The Planning Commission meets once a month.
Please submit comaleted application, plans and the fee by December 27. 2006 so that I may
glace your reauest at the January 16. 2007 Planning Commission meeting. We are ready to
assist you in filling out the paper work and filing of the application.

At your request I am writing this letter as a plea for the city council to approve a waiver
for non compliance of Section 17.27.030 of the Rolling Hills Zoning Ordinance requiring
under grounding requirement of all utility lines when adding square footage to a
residence or lengthening electrical service. On September 22, 206, Rafael Bernal, Los
Angeles County Building official and Yolanta Schwartz inspected the property and
confirmed that an excavation of the trench we had begun for this purpose would be
extremely difficult to complete because of solid rock in the area and the roots of two
large pine trees would be weakened and in danger of falling.
During the course of construction a large delivery truck struck the power lines spanning
the driveway. Although they did not fall, the lines sagged to a point that a slender tall
pole was used to support them for minimal clearance and were obviously a serious and
dangerous hazard and remain so.
As the construction was 99% complete at this time and a final inspection by the County
was requested, Larry Fay of the Edison Co. suggested that they be allowed to remove the
sagging power lines at the same time as the installation of new ones to the new meter
panel. The County denied his request because the City had not granted a waiver for the
under ground lines.
I am hoping the City can act promptly in this case.

Recently, we received a letter from your contractor, K.E. Construction, requesting a
waiver from the undergrounding requirement due to the presence of solid rock in the area
between the driveway and the existing house, making the excavation for a trench
extremely difficult. In addition, he states that there are two large pine trees whose roots
would be weakened by the excavation of the trench and would be in danger of falling. On
September 22, 2006 Rafael Bernal, Los Angeles County Building Official and I inspected
the property to confirm these conditions.
Pursuant to the Zoning Ordinance requirement for undergrounding of utilities you can
apply to the Rolling Hills Planning Commission for a Variance from this requirement.
In order to approve a Variance, the Planning Commission must consider and make among
other findings, that there are exceptional or extraordinary circumstances or conditions
applicable to the property, such as size, place, topography and others constraints, and that
a special privilege is not being granted. I am enclosing the application forms and other
pertinent materials required to be filed for a Variance. The fee for this application would
be $950, ($750 for minor Variance and $200 for environmental review). The Planning
Commission meets once a month. The next meeting will be held on October 17, 2006. In
order to meet the State mandated noticing requirements for the October 17, 2006
Planning Commission meeting, your completed application must be submitted to the
Planning Department by October 4, 2006. We are ready to assist you in filling out the
paper work and filing of the application.
You may continue to work on your property during this process, however, the
construction on your property cannot be finaled by the Building Department until the

Hi Kevin,
This is to clarify SCE's requirements to underground the service at the above address. Per
SCE's Electrical Service Requirements, Section 3.13.0, a minimum depth must be
maintained. For voltages up to 30,000 volts, this depth is 30" from top of conduit to
finished grade. Encasement requires the same.
For your project, this shall be maintained from the panel to the pole. As to the conditions
of the soil you will need to traverse, or the expense involved, I can not speak to that •
If you can not meet SCE's requirements for minimum depth of conduit, then your service
will need to remain overhead.
