Thank you for your letter of April 9, 1993 requesting the
substitution of Rosea Iceplant for the proposed grasses to be
planted at the subject address.
We have consulted with the City's Landscaping Consultant and
determined that the former areas designated as "sand traps" shall
be planted with more natural vegetation, such as: ground roses,
bougainvillea, rosemary, or coyote bush.

In speaking to Mrs. Hou on the telephone on Monday, September 28, 1992, we reached a
verbal agreement indicating that construction of sand traps or sand areas adjacent to specific
grassy portions depicted on your landscape plans submitted September 17, 1992 constitute
a golf course. As discussed with Mrs. Hou, the City is responsible for determining and
regulating land use within the community and the Rolling Hills Community Association is
responsible for regulating landscaping and architectural features of construction within the
community.
It was agreed during the telephone conversation, that a revised landscape plan, without sand
traps, or sand areas or other landscape features which would depict a golf course land use
would be resubmitted to the City of Rolling Hills for review.
We apologize for any misunderstanding which Mrs. Hou described in our telephone
conversation. We strive to do our best to inform Rolling Hills residents of what is permitted
under the Rolling Hills Municipal Code and, at times, that can be a confusing process. We
do stand firm however, that the Rolling Hills Municipal Code does not permit golf course
land use on residential properties within the community.
As in our previous correspondence, you are urged to contact this office should you require
to discuss this matter further. You are also encouraged to contact this office so we can
provide you with a list of preferred landscaping materials.

Dear Mr. Hou:
The City has received your proposed plans and estimate for
landscaping requested by September 15, 1992. We have consulted
with the City Attorney and must reiterate that a "golf course" is
not a permitted use in the City of Rolling Hills.
Your submittal does not include new plans and, instead, depicts the
existing "golf course" plan. This plan and estimate are not
acceptable under the Municipal Code.
We cannot understand why you did not submit an acceptable plan
because in every conversation to date, you had agreed to submit a
landscape plan that could be approved by the City and Community
Association.
We urge you to reconsider and prepare suitable plans and submit
them to this office by October 9, 1992. Landscaping that retains
the natural topography and native plant growth is preferred.
Permitted uses, accessory uses and uses permitted with a
conditional use permit are attached (Sections 17.16.010, 17.16.011,
and 17.16.011). If you do not take action to comply with the
Municipal Code, we will pursue prosecution with the District
Attorney. However, if you take action to comply with the City's
requirements to provide an acceptable landscaping plan and bond, we
will discontinue preparatory prosecution action.
Should prosecution become necessary, the City will file to recover
all costs of the subject case. Since August 24, 1992 when the
"Stop Work Order" was issued by the County Building Inspector, the
City Manager, the Principal Planner, and other City staff have
spent numerous hours dealing with this case. We are also
documenting fees billed by the City Attorney.
Again, you are urged to contact this office and provide an
acceptable landscaping plan and bond for the re -landscaping of the
"golf course" portion of your property by October 9, 1992.

Dear Mr. Hou:
This letter is written to summarize our meeting with you and Mr.
Sean Bennett on Tuesday, August 25, 1992.
At that time, we discussed the scraping and grading of the natural
contours of your property to construct a five hole golf course that
includes a number of sand traps.
As stated at the meeting, a "golf course" is not a permitted use in
the City of Rolling Hills. In fact, retaining the natural
topography and native plant growth beyond the residential building
pad is desirable. Residents are encouraged to use natural native
planting. Formalized design is discouraged as are extensive uses
of ivy, eucalyptus compactus, and aleppo pines. The City and,
Community Association encourage leaving a large percentage of the
property in its natural state, especially the canyons, to insure
the retention of rural atmosphere and open spaces.
As we agreed, you will submit a landscaping plan and cost estimate
for approval by the City and Community Association within the next
three weeks, the deadline being Tuesday, September 15, 1992. The
City also requires a Faithful Performance Bond for Landscaping
(example attached), plus 15%, and retention of the bond for the
period of time from the delivery of the executed bond to the City
until the City Manager determines that the landscaping has been
installed pursuant to the landscaping plan as approved and that
such landscaping is properly established and is in good condition.
As you know, the County Building Department has issued a stop work
order. Therefore, no further golf course construction shall take
place in the interim at your property.
