Dear Mr. Podell;
This is to memorialize our conversation regarding the status of structures on your
property at 3 Pine Tree Lane.
The structures shown on several plans that were submitted to the City by George
Sweeney, Architect and stamp dated by staff on 6/26/08 and 4/2/10, which include
the residence, storage structure, guest house, garage, swimming pool, spa and tennis
court may remain on the property. Such structures may be maintained within the
existing footprint and existing uses. However, should a major addition and/or
remodel, new construction, or change in use of structures be proposed, the uses and
structures would have to be legalized, should it be discovered that either the uses or
the structures were not permitted in the past.

BACKGROUND
At the regular meeting of the Rolling Hills Traffic Commission held July 22 2004, the
Traffic Commission considered the attached staff report relative to a request to separate
the currently merged driveways that provide access to both 3 and 5 Pine Tree Lane.
As a result of the testimony provided at the meeting, and a review of this location in the
field by the Traffic Commission and the Traffic Engineer, the Traffic Commission has
recommended that the City Council approve the separation of these driveways subject
to the following conditions:
► That the driveway separation be constructed as described in the plan submitted to
the Traffic Commission on July 22, 2004, and
► That the planter separating the driveways be maintained with vegetation that will
not exceed 3 feet in height above the driveway surface immediately adjacent to the
planter.
RECOMMENDATION
It is recommended that members of the City Council approve this recommendation of
the Traffic Commission as presented or provide other direction to staff.

for consideration of the above referenced request. As you know, the Traffic
Commission considered your request, which included a field review of this proposal.
As a result of that review, the Traffic Commission will be recommending that the City
Council approve this request subject to the following conditions:
► That the driveways be constructed as depicted on the plan submitted to the Traffic
Commission.
► That foliage in the planter between the two driveways not exceed three feet above
the immediate adjacent driveway surface.
This request will be presented to the City Council for consideration on Monday, August
9, 2004. You are certainly N%•elcome to attend that meeting. A copy of the staff report
will be presented to you when it is prepared.
Please ensure that you receive any appropriate approvals from the Rolling Hills
Community Association and/or County and that any soil movement and other
construction involved in this project does not activate the necessity for further
discretionary approvals by the City or County.

BACKGROUND
Attached to this staff report is correspondence from Mr. Doug McHattie of Bolton
Engineering representing Dr. and Mrs. Ullrich, 5 Pine Tree Lane and Mr. and Mrs.
Podell, 3 Pine Tree Lane. The property owners desire to separate the driveway access to
their properties as it meets the roadway.
Currently, both driveways merge prior to the Pine Tree Lane. The applicants are
proposing to separate these driveways with the construction of a planter. As a result,
the northerly edge of the driveway to the Ullrich property, 5 Pine Tree Lane, will move
approximately 10 feet to the north. Plans regarding this proposal are attached to this
staff report.
RECOMMENDATION
It is recommended that members of the Traffic Commission review this request and
provide appropriate direction to staff.
