Re: Boundary/Property Survey/Location of Trees and Easement Along Common

Dear Sirs,
This letter is to inform you that I/WS Surveying has received simultaneous authorization
from both of you to perform the aforementioned work.
Due to the I/WS job tracking system, this situation has only recently come to our
attention. It is our -professional responsibility to disclose this fact to both parties.
I/WS Surveying is giving both parties the option to cancel said contract or proceed with
the survey. We are requesting written authorization of such, from both parties. Should
you decide not to proceed, we will refund the retainer within 3 days of receiving notice of
cancellation of contract. Should you decide to proceed, we are requesting that you
acknowledge the fact in writing and acknowledge that we may be surveying for the other
party. Should we receive authorization to proceed, the survey(s) will be performed with
all of the technical and impartial requirements of a boundary survey.
Furthermore, should both parties authorize I/WS to proceed, it is our professional
responsibility to present all survey/boundary information to our client that reflects only
their portion of the survey per their survey contract.

Dear Mr. Irvine:
We are in receipt of your letter dated November 22 addressed to myself and
Mr. Stephen Shultz, who resides at 17 John Canyon Rd., Rolling Hills.
We are requesting an immediate performance of our contract dated October 4,
2005. Your office stated at that time that the lead time for completion of
this project would be 4 - 6 weeks. Also, there has been no mention whatsoever
of any conflict of interest with Mr. Steve Shultz until November 18, which
is six weeks post deposit and contract.
As explained to your company, we already have a survey of our property,
but need to verify the accuracy so we may proceed with the items of concern:
the roadway coming off of Crenshaw, the fence, and the trees on
the north and east sides, which are all indicated to be on the parcel and its
easements known as 6 Morgan Lane.
We are confident your survey will be totally unbiased and conform with the
standards of your industry.
We appreciate you expediting this project.
