Mrs. Bharadia noticed this today upon arrival at 5:00 PM, with Mr. Hassholdt and his workers demolishing the wall. Apart from the wall being demolished illegally, it will have affect on driveway, soil erosion, and other far reaching unknowns. We hope you can assess this situation and prevent it from progressing (regressing) any further. We have pictures to show the damages. Dear Board Members, 10 Pine Tree Lane Rolling Hills, CA 90274 200 'rr?G` t13?, it JUN 1 8 2009 City of Rolling Hills Very recently Dr. Bharadia at 16 Pine Tree Lane brought to our attention that he is tinder the impression that the Pine Tree Lane extension and cul de sac are his personal property and liability. Actually this conversation was precipitated by our workers, who were grooming our lot 14 for Fire Department inspections. Our workers were moving our Gator along the road extension and cul de sac to pick up the bags of weeds. They were directed to leave the area and not use the road. I was shocked to hear that the road extension and cul de sac may not have been recorded and accepted by the Association. Dr. Bharadia's position was that no one was to drive on the road or cud de sac. He has posted it as private property. Since we were very much a part of this development, and we were required to dedicate our land as part of the road and cul de sac, we are very concerned. One of the primary conditions of the 16 Pine Tree Lane sub division was the dedication of this road extension to the entire community and the cul de sac was very much a part of the community plan. I hope you can investigate this issue and correct the problem. Our property is being impacted as now Dr. Bharadia has posted the extension and cul de sac as his private property. Since our property is a part of the development in this area and he has staked claims to our property, something needs to be done. The Board has failed to dedicate the road and now there is no cul de sac as required by the resolution for the sub division of 16 Pine Tree Lane. You have created a safety problem as construction vehicles face a dead end with no turn around. Their solution is to back up Pine Tree Lane. The City has accepted this road extension and cul de sac. The Board's failure to accept this project has created a property line dispute as well as genuine road hazards. 1 06-18-2009 14:56 • • PAGE2 It is very important that this problem be addressed now as new construction begins on Pine Tree Lane, and as you review this letter there are cement trucks and large dirt trucks moving cement and soil from 2 Pine Tree Lane. These trucks cannot make the right hand turn up the road. They are finding a dead end where the extention and cut de sac was developed as required by the sub divisions.They are being forced to back up the road to Portuguese Bend Road. We have inspected the progress of the grading work at the subject site. The rough grading and the final grading for the subject site has not been approved and accepted by our Department as yet. The standards for roadway improvements is under the jurisdiction of the Community Association of the City of Rolling Hills. The requirement for the width of the road is set by the Fire Department. As a standard practice we approve the grading job, only after ascertaining that the work conforms to the approved set of plans. In this particular case, since the access road is a part of the grading work, approval from the Fire Department and the Community Association•will be required before this job will be accepted and finaled. As noted on Page 3 of Recommendations of the County, the existing house on Parcel 1 appears to encroach approximately 10 feet into the easement on the easterly property line of Parcel 1 and approximately 45 feet into the front yard setback because of the street requirement. The Planning Commission in approving the subdivision has determined that the new front yard is at the cul-de-sac or western portion of Parcel 1, the existing stable would be encroaching into the front yard, but the residence would not, and the southern part of the residence would not be encroaching into the new side yard setback. 9. The additional homesite proposed on Parcel 2 indicates a 12,000 square foot building pad that does not encroach into any existing setbacks. There is an area set aside on the southwesterly slope for a 450 square foot stable and 550 square foot corral. 10. The driveway leading to the proposed building pad on Parcel 2 will have a slope of up to 17% with no more than a 7% slope at the 32 foot radius cul-de-sac bulb. 11. Future grading for Parcel 2 will require approximately 2,665 cubic yards of cut and 2,665 cubic yards of fill soil. 12. The Traffic Commission will have reviewed the proposed Pine Tree Lane, road extension and cul-de-sac on February 25, 1994 and any recommendations that they propose will be reported at tonight's meeting. 13. Staff met with the Manager of the Community Association, Peggy Minor, regarding the proposed project and noted that the Community Association has not approved the subdivision, nor does it intend to do so until the applicants come to some mutual agreement with the adjacent property owners about the construction of the proposed new Pine Tree Lane, the roadway extension and the'cul-de-sac. 14. After reviewing the Initial Study for the project, Staff has determined that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because mitigation measures have been added to the project. Accordingly, a Mitigated Negative Declaration has been prepared (attached). REOUIRED CITY COUNCIL ACTION The City Council may concur with the Planning Commission's findings and recommendation of approval of the subdivision. If the City
