Addition and remodel of existing residence. Variance is required: 1) To allow
encroachment of approximately one foot beyond the established front yard. 2) To
allow doors, light and ventilation along one end of basement.
Criteria to be satisfied for grant of Variance
Such change is based upon the following described exceptional or extraordinary
circumstances or conditions that do not apply generally to other property in the
same vicinity and zone. The shape and topography of the lot precludes the full use
and enjoyment of the site and places undue constraints on the design of improvements:
1) Narrow frontage and minimal buildable area limit location of house options. 2)
The natural fall of the land allows the end of the basement to open out to the lower
level of the lot facing the private pool area - this space could not be placed in an
alternate location on this site.
Such change will not be materially detrimental to the public welfare nor injurious to
the property or improvements in such vicinity and zone where property.is located because.
1) The encroachment of one foot beyond the established front yard is still within the
old required front yard requirement to which all existing residences on this street
have been built. 2) The basenent is located so as to be completely concealed from
any other property and only visible to the occupants of this site and only from the
rear lower area of the property.
