I am following up to a letter sent to you from the City dated January 30, 2009 regarding
a trellis that you replaced on your property without required approvals. I appreciate
your prior letter to the City dated January 7, 2009 detailing the background of this
matter and indicating your intent to comply with zoning requirements. The Rolling
Hills Community Association has recently informed that you have obtained approvals
for the trellis from its Board of Directors (license agreement) and Architectural
Committee, provided that you remove the portion of the trellis extending over the side
property line.
As outlined in our letter to you, the next step in the approval process is for you to
obtain a Variance from the City Planning Commission for relief from Section 17.12.190
of the Rolling Hills Zoning Ordinance (prohibits encroachment within a setback).
Towards that end, I am enclosing an application packet for a Variance.
It is requested that you submit a complete application or alternatively remove the
subject trellis from the side yard setback by no later than December 8, 2009. Should
you require any assistance in preparing a variance application or wish to further discuss
