Touching base with a quick project status update and to discuss finishing / backfilling the wall that was started by previous contractor. Please find the attached plans and deputy inspection reports... It is my understanding that it was approved by city, the copies stamped and signed by Yolanta over the counter at City Hall were retained by Yolanta and PWI (previous contractor). From prior discussions with you, Yolanta and some digging around... It is looking like perhaps no plan check or permit Page 1 of 4 • was actually pulled but the PWI did have a couple of deputy inspections done while being built. We are about to start digging footing for the house and I would like to use the footing spoils from more remote locations of the house and backfill this wall prior to digging the footings closer to the wall which then blocks access for easy backfill. Also would like to get rid of the potential "open trench hazard"... I have had my foundation guys check the back drain for slope, remove debris, finish the rapping of gravel with filter fabric (leaving a few open areas for inspection if needed) and check water proofing (both an elastomeric and Miradrain products installed)... However, during this time should anyone have an accident exiting our driveway to Crest Road East, I intend to hold the Rolling Hills Community Association and Mr. and Mrs. Martin, 22 Crest Road East, directly responsible. I have verbally complained to the Martin's construction supervisor, to Kristin at the Association and Eva at the City of Rolling Hills numerous times during the past year. The last time I complained Kristin told me she would call Mrs. Martin personally to advise her that parked cars were completely blocking out our sight distance when pulling out of our driveway. My complaints have been ignored and the unsafe condition has continued. At my request to him, Art brought me some "no parking" signs and a few cones two weeks ago which help, but there is such a long string of autos, trucks, and larger equipment that block the road in both directions that it is impossible to see the way clear until you are out on the street and by that time we become sitting ducks. Today, we had a second near collision situation where a low profile automobile coming very fast was impossible to see while coming out of our driveway onto Crest. It again nearly resulted in an accident. The Association must do something to regulate this kind of very interruptive, construction parking! It surpasses being just a nuisance and is downright dangerous. This is a gravely serious condition which you have disregarded and I hereby put you on notice. You informed me that you received the letter as well. In the letter, Mrs. Severy, who resides at 29 Crest Road East, states that the construction workers working on your new residence at 22 Crest Road East are continually parking along the easement in such a way that they block her sight distance as she exits from her driveway. Mrs. Severy has spoken to me several times in the past with the same concern. Each time I contacted your construction manager to inform him of the complaint and asked him to have the workers move their vehicles. That seemed to work for few days or a week and then, according to Mrs. Severy, they would resume parking their vehicles and heavy equipment close to her driveway. I understand that the construction will be completed within two or three weeks and that this issue will be resolved. However, meantime, please inform your construction manager to speak to the workers and ask them to either park on the property or on the north side of the easement adjacent to your property. The resolution of approval of your project states that "all parking shall take place on the project site and, if necessary, any overflow parking may take place within nearby roadway easements". Therefore, we'd appreciate your informing your construction manager that the parking situation must meet the intent of this requirement. Perhaps we need an Ordinance, to cover the new type of noise pollution caused by the recreational use of these motorized vehicles, in our City, and secondly, stricter enforcement on illegal use of them on our trails. Sometime during the last few months, it appears that you have planted several rows of trees and shrubs and put a rock graden over the property line on to my. property. In order to avoid any confusion as to whose property this vegetation is on, I am requesting that you remove all of it by September 1, 1994. Please remove the gravel and humus that you have also stored on our property by the same time. It is our desire that the portion of our property which is an easement be let free of any planting so that it can be used for horse and hiking trails. Enclosed are pictures which show where the vegetation is in relation to the property line. The line is marked by the two red stakes one of which can be seen in the pictures. The other is line with the row of eucalyptus. We believe that these stakes were installed by the surveyors you recently used to mark the line.
