BACKGROUND
At the regular City Council meeting held Monday, August 14, 1995, the
recommendation from the Traffic Commission on this matter was continued to this
evening's meeting in order for staff to investigate issues relating to a possible
change of address of the property and any resulting setback impacts caused by the
change of address in conjunction with this new driveway request. A copy of the
staff report that was presented to he City Council on August 14th is attached for
reference.
Regarding the possible address change, staff has identified that number 55 or
number 57 Portuguese Bend Road are currently not attached to any other properties
in the area. However, it is worth noting that these addresses are not in sequence to
the adjoining properties. A map identifying the addresses of the properties in the
area is attached to this staff report.
We do not anticipate any encroachment difficulties with the existing structures on
the property when the required front, side and rear yards are reoriented on the lot as
a result of the new driveway, with or without the address change A map depicting
the new setback lines will be available at Monday's City Council meeting.
ADDITIONAL CONSIDERATIONS
In discussing this with the Fire Department, who would be a primary emergency
response unit, they felt that maintaining the address of 1 Wrangler Road, with
proper signage, would make the property easier to locate in an emergency situation

than if the property had a Portuguese Bend Road address of 55 or 57 which would be
out of sequence. The property immediately to the east is number 63 and
immediately opposite Wrangler Road is number 61. The property across the street,
which is vacant, is number 66. Representatives of the Sheriffs Department have
expressed similar comments regarding the address of the property.
Staff has contacted the property owner regarding this situation, who does not have
any difficulties with retaining the original number address with proper signage or
assisting staff with the administrative change of address should that be the desire of
the City Council.
RECOMMENDATION
It is recommended that members of the City Council consider the issues presented
this evening and provide appropriate direction to staff.

At the regular City Council Meeting held Monday, August 14, 1995, City
Councilmembers postponed consideration of the Traffic Commission
recommendation for your new driveway access at 1 Wrangler Road. Although
there were no expressed concerns regarding the location of the driveway itself, it was
felt that the address of 1 Wrangler Road might need to be changed to reflect a
Portuguese Bend Road address.
As indicated to you during our telephone conversation on Tuesday, we will be
presenting an updated staff report regarding this matter at the regular City Council
meeting to be held on Monday, August 28, 1995. This meeting will begin at 7:30 p.m.
in the Rolling Hills City Council Chambers. If I understood you correctly, you do
not have any objections to a change of address on your property.

BACKGROUND
At the regular meeting of the Rolling Hills Traffic Commission held Thursday, July
27, 1995, Traffic Commissioners made a recommendation for City Council
consideration regarding the above referenced project.
As indicated in the attached staff report, the applicant had created this new driveway
accessing this property from Portuguese Bend Road. Staff queried the property
owner (Marin) who filed an application for Traffic Commission review.
At the Thursday, July 27th Traffic Commission meeting, Commissioners
recommended that the City Council approve this driveway access based upon Traffic
Commission input and the Traffic Engineer review, subject to the following
conditions:
• That the driveway opening be flared for a distance of 10 feet in the southern
direction (downhill toward Wrangler Road) for a total driveway opening width
of 24 feet.
• The northern paved area of the driveway shall not be flared and shall maintain a
straight line from the garden wall to the edge of Portuguese Bend Road.
• That the existing driveway on Wrangler Road be abandoned and returned to its
natural state, including landscaping.

Attached to this staff report are plans depicting a new driveway access to 1 Wrangler
Road. Previously, the property had a paved driveway that exited to Wrangler Road.
However, due to conditions in the area, this driveway is no longer desired by the
property owner. It is proposed that the original driveway be abandoned and a new
driveway exiting the property at Portuguese Bend Road be established.
The proposed driveway has already been cut to Portuguese Bend Road. However, it
is not yet been paved. Originally, it was communicated to this office that the new
driveway access was simply for construction purposes. However, continued use of
that driveway prompted staff to query the applicant regarding their ultimate plans
for this access. Based upon staff input, the applicant has presented the attached
plans and requested Traffic Commission consideration of a new driveway access to
this property.
Plans indicate that the driveway is approximately 14 feet in width. Plans do not
specify any fanning of the driveway apron as it meets Portuguese Bend Road.
RECOMMENDATION
It would be in order for members of the Traffic Commission to consider this request
and make an appropriate recommendation for City Council consideration.

recommendations include:

PROPERTY DURING FY 1993-94 AND FY 1994-95.

BACKGROUND
Attached to this staff report is correspondence from Alfred A. Marin requesting a
waiver for the last two years of refuse collection service charges for property a 1
Wrangler Road. According to the correspondence, Alfred A. Marin is now the
owner of this property. In securing this real estate, Mr. Marin had to pay property
taxes due. The City of Rolling Hills collects its refuse collection fees through the
property tax collection system.
The total amount paid for refuse collection services • on that property was $1,746.75
during FY 1993-1994 and FY 1994-1995. Mr. Marin is claiming that the property was
unoccupied during this period of time.
Mr. Marin has also requested that refuse collection cease at this property as it is still
uninhabited. A copy of correspondence sent to BFI initiating this request is attached.
Rolling Hills Municipal Code Section 8.08.710, allows for dwellings under
construction to not be served, and therefore not billed for refuse collection services
under specified circumstances. A copy of that Municipal Code Section is attached.
Essentially, residential dwellings which remain unoccupied for a full four weeks or
longer shall not be liable for payment of collection fees. This applies to residences
that are under construction and newly constructed residences prior to occupancy.
Previous Similar Case
A copy of a staff report dated May 10, 1993 is also attached for your information. In
that report, Mr. and Mrs. Julian Tielens applied for a waiver of refuse collection fees
and/or penalties from 1987 and 1988. A copy of the minutes from that meeting are
also attached. At that time, the City Council denied the waiver for refuse collection

fees requested by the Tielens. In that case, the residential dwelling was occupied and
did receive refuse collection services.
Staff Analysis
From our research, it does appear that the Munch property was occupied during FY
1993-1994 and FY 1994-1995. Additionally our investigation reveals that Mr. Marin,
did in fact, pay the $1,746.75 in refuse collection services covering that same period
of time.
Although refuse collection crews did not know that the house was unoccupied at
that time, and may, from time to time, have visited the rear yard area to determine
whether or not any refuse had accumulated, service was not provided to that
property from the standpoint of removal of residential refuse caused by residential
occupation of the property.
RECOMMENDATION
The residential dwelling at 1 Wrangler Road did not receive full service during the
time period specified because the house was unoccupied. Although no formal
waiver request was received by this office prior to FY 1993-1994, the waiver has now
been implemented at that location. The City Council may wish to consider Mr.
Marin's request in that light.

Dear Mr. Nealis;
The property at 1 Wrangler Road has been unoccupied since October 1993 when I became the
new owner. I did not advise the City or B.F.I. to start rubbish collection. It is difficult to
understand how the former owner was receiving City services when he had not paid any taxes
for a period of nine years to the County of Los Angeles or the City of Rolling Hills. Can you
explain that?
This note is to inform the City of Rolling Hills and its' contractor, B.F.I. that, until further
notice, DO NOT PICK UP THE RUBBISH. I anticipate at least another nine months before
service is required.
I am asking that in view of the fact that I personally have paid approximately 10 years of back
taxes and 2 years of present taxes on this address, would the City of Rolling Hills consider
reimbursing me for at least the two year period since 1993 for rubbish collection services I have
not received.

8.08.710 Dwellings under construction. Residential
dwellings under construction and newly constructed residen-
tial dwellings, prior to occupancy, need not be served and
for such period shall not be subject to the payment of the
fees herein specified.
A. Residential dwellings undergoing major alterations
or repairs, but occupied, shall receive regular service for
collectible rubbish other than the construction debris and
waste materials.
B. Residential dwellings which remain unoccupied for
four full weeks or longer, or a calendar month, shall not
be liable for the payment of the collection fees for such
periods, provided the following conditions are complied
with:
1. The occupant of the residential dwelling shall
notify the City and the Collector, at their respective
offices, of the vacancy. The notice shall be in writing
and the effective date shall be one week after the date of
the notification. Receipt of the notice shall be acknowl-
edged and a reference number assigned to avoid misunder-
standing;
2. The occupant shall notify the offices of the
City and the Collector the duration of the vacancy, if
known, at the time of the discontinuance of the collection
service; otherwise occupant shall notify promptly by mail
or phone the date of occupancy or resumption of occupancy;
and
3. The premises described in the notice shall not
be occupied during the period of the vacancy, and no refuse
of any type shall be produced during the period or collect-
ed from the residential unit. (Ord. 244 §1(part), 1993).

BACKGROUND
Attached to this staff report is correspondence from Dorothy and Julian Tielens requesting
a waiver for their 1987 and 1988 refuse collection bill and penalties totaling $2,283.13. The
Tielens are claiming that they did not know that this amount was due because the County
did not send a correct bill covering that period of time.
Under the refuse collection franchise agreement between the City of Rolling Hills and
Browning -Ferris Industries, the City of Rolling Hills pays BR directly for refuse collection
services based on a specific number of homes in the City. Rolling Hills residents pay for
refuse collection on their property tax bill, and the City receives reimbursement for refuse
collection charges through the fees that are returned to the City. Homes under construction
and newly constructed dwellings prior to occupancy are not served by the regular contracted

service. Provisions are also provided n the franchise agreement for residential dwellings to
not be liable for collections fee if the residential dwelling is unoccupied for four weeks or
longer and specific notice is provided to the City and BFI relative to this vacancy. If
however, no notice is provided, BR crews still check the rear yard of each house along their
route to determine if refuse collection is necessary.

Therefore, in the case under consideration, the City has expended $1,212.10 in refuse
collection service costs over the 1987 and 1988 year for refuse collection service at the
Tielens residence, 3 Wrangler Road.
Mrs. Tielens has been advised that Council will be considering her request at tonight's
meeting and may be in attendance. Sbe has also been advised of the staff recommendation.
RECOMMENDATION
The residential dwelling at 3 Wrangler Road did receive service during the 1987 and 1988
year because the house was occupied. It is therefore, not recommended that the City
Council waive the fees charged to the Tielens in this situation. The City Council may wish
to consider bow it wishes to address the issue of the penalties which have also been
requested for relief by the property owners.

policies.
After discussion, Councilmember Swanson moved that the City Council deny the waiver of refuse
collection and/or penalty fees requested by Mr. and Mrs. Julian Tielens from their 1987 and 1988
tax bill. Councilmember Pernell seconded the motion which carried unanimously.
