The California Department of Fish and Game has received and reviewed the final
monitoring report for the mitigation site at 5 and 6 Sagebrush Lane per
Streambed Alteration Agreement Notification #1600-2003-0077-R5. A site visit
was conducted on August 26, 2009 to review the site to ensure the construction
was completed as described in the streambed alteration agreement and to
determine if the mitigation, as defined within the streambed alteration agreement,
has met the success criteria, as well as the terms and conditions of our
agreement. The Department has determined, based upon this Final Monitoring
Report and the site visit, that the terms and conditions were met and that the
Department deems the mitigation to be successful.
The Department is closing Streambed Alteration Agreement #1600-2003-0077-
R5. We thank you for your cooperation in this matter. If you have any questions,

This report is prepared in response to the concerns of the Plan Checker of the Department of Public
Works of the County of Los Angeles reviewing the plans for your project. The Plan Checker's
concerns refer to the single drainage terrace included in the repair of the slope failure that occurred
below the building pad. To envision a suitable repair plan for the slope, on September 10, 1998, the
undersigned met with Mike Montgomery, Scott T. Ezell, and other County personnel at the job site.
The recently constructed residence limited the options for repair. After reviewing the site conditions,
we presented a recommended slope repair that would improve the conditions of the slope that existed
before the failure occurred. Because of the slope gradient and site constraints, the slope repair
proposed included a single terrace drain to be located as site conditions dictate. The proposed repair
was agreed to by the County personnel that asked that our recommendations be presented in a report.
On September 11, 1998, we presented our report. After reviewing the report, Mike Montgomery
and Scott T. Ezell requested a seismic analysis of the slope to verify that the single terrace was
adequate. We presented our analysis in our report dated September 28, 1998. The two reports,
containing a cross section and a map showing the single drainage terrace, were approved by Mike
Montgomery and Scott T. Ezell on their review letters dated November 24, 1998. A copy of

each letter is attached. In our opinion, because of the site conditions the single drainage terrace
incorporated in the slope repair comply with the intent of the building code. It is our desire that this
report gives assurance to the Plan Checker that the designed repair was agreed to by the parties
mentioned above.

We appreciate you providing the "as graded" plan for your development project on the above
mentioned lot. We have concluded an initial review of the "as graded" plan and visited the
construction site with the County's District Engineer Ms. Lata Thakar and Senior Engineering
Building Inspector Mr. Rafael Bernal. The initial review revealed some issues that need to be
resolved.
These issues are:
1. The original site plan as well as plans approved by the City's Planning Department were
approved without any grading. The "as graded" plan shows 1,750 cubic yards of cut
soil and 370 cubic yards of fill soil. At the site, cuts were made for a substantial
basement and a swimming pool.
2. During the course of construction, Mr. Andrew Glassell, contractor, requested and had
approved a request from the City Manager for a maximum of 450 cubic yards of soil to
be exported from your property at 5 Sagebrush Lane (Lot 100-A-3-RH) as follows: 130
cubic yards to 7 Maverick Lane (Lot 28-SK) and the rest for repair of the Flying Triangle
Landslide Area and the Clif Hix Riding. Ring. The import and export of more than this
amount requires the City Manager's approval and if the amount is more than 500 cubic
yards of soil, such action requires Planning Commission approval. It appears that much
more than 500 cubic yards of soil was exported from your lot and thus, prior Planning
Commission approval was required for that action.
Consequently, we have determined that your project is in violation of the original plans as
presented to and approved by the Planning Commission on January 17, 1995. Therefore, you
are hereby ordered to submit to the City in writing how you plan to resolve this situation and
bring your property into conformance with the approved project.
As an alternative to bringing the site into conformance with approved plans, you are permitted
to apply to the Planning Commission for a Variance to disrupt the balanced cut and fill ratio
and to allow the existing exportation of the substantial amount of soil. This request would also
have to be accompanied by a request to modify your Site Plan Review approval to increase
grading quantities.
Should you apply for the Variance and Modification to the Site Plan Review and pay
appropriate fees, we will consider modifying the stop work order to allow work to continue on

portions of your project that would not preclude the restoration of your property into
conformance with the development as originally approved by the Planning Commission. We
stand ready to review any proposals you may choose to offer as to what portions of this
project may continue without precluding you from returning the exported soil to your
construction site should the Planning Commission deny your request.
Your decision must be made in writing within the next 15 days (by February 13, 1997) as to
your course of action. Should you elect to make application for the Variance and Modification
to the Site Plan Review approval, we will make every effort to expedite your applications to
their earliest possible conclusions, but you should understand that there is no assurance that the
Planning Commission will approve those applications. Thus, it is possible that even after going
through the process of applying for the Variance and Modification to the Site Plan Review, you
may be required to return the site to its originally approved condition.
The "Stop Work Order" for building and grading work remains in effect and you are prohibited
from doing any work beyond closure of the septic system during this period.

By copy of this letter, we are requesting that the County of Los Angeles issue a "Stop
Work Order" for any additional grading and building work on the premises 5
Sagebrush Road. This request follows the City's prior letters, dated December 6 and
17, 1996, asking you to submit "as graded" grading plans for the site showing the
exportation of a maximum of 450 cubic yards of soil, 130 of which was to go to the
Howroyd property at 7 Maverick Lane (Lot 28-SK) from your lot at 5 Sagebrush Lane
(Lot 100-A-3-RH). Those plans were not received by December 27, 1996 as requested
in our December 17, 1996 letter.
This request to the County is for the County to apply the provisions of the Uniform
Building code which allow the Building Official to stop work on a project when
there is evidence that the project is not being implemented in accordance with
approved plans (Uniform Building Code Section 104.2.4). The City's approval of the
project was based upon a site plan that showed no exportation of soil. The City
Manager subsequently authorized the exportation of a maximum of 450 cubic yards
of soil, in accordance with the authority provided by Section 15.04.150 of the Rolling
Hills Municipal Code. We have subsequently received several complaints and
reports from citizens indicating that up to 3 times the approved amount may have
been exported from your property to the Howroyd's property. Thereafter, we
requested preparation of "as graded" grading plans to indicate the total amount of
soil exported. Those "as graded" plans have not been forthcoming and has led to
the need to stop construction to further evaluate the status of the alleged violation
of the approved site plan.

As I indicated to you on the telephone, we have received several complaints
regarding the exportation of soil from your property in conjunction with the
construction of your residence. Reports indicate that up to 10 times above the
permitted quantity of soil was exported to 7 Maverick Lane. As you know,
exportation of a maximum of 450 cubic yards of soil was approved based upon the
attached request.
We are currently awaiting receipt of an as graded plan at the Howroyd property, 7
Maverick Lane, so we can compare the as graded condition to the permitted grading
that was approved by the Planning Commission.
We also require an as graded plan from you. We have not issued a stop work order
on your project. However, you should be advised that we are investigating this
matter. If our investigations indicate that the conditions imposed on your approval
were violated, we may have no choice but to order restorative action.
We are certain that you share our desire to clear up this situation as soon as possible
to avoid any unnecessary delays. In that light, we anticipate that you and your
representatives will provide full and complete cooperation.

Thank you for your letter dated September 19, 1996 requesting to export 240 cubic
yards of soil from the Blazevich job site at 1 Buggy Whip Drive. The letter appears
to satisfy the reasons why soil needs to be imported at 7 Maverick Lane and the Hix
Ring. However, you have not submitted any evidence supporting the need to
export the soil from 1 Buggy Whip Drive as required pursuant to Section 15.04.150 of
the Municipal Code (enclosed). Therefore, your request is denied at this time.
In order to consider your request for approval, you must comply with the
provisions of Paragraph 3 of Section 15.04.150 of the Rolling Hills Municipal Code
which provides an exception to the balance cut and fill ratio requirement.
Conditions which must be met include:
a. construction of the structure on the lot or parcel has commenced.
b. that the need to import or export soil could not have been foreseen prior
to commencement of construction and
c. that either the structure cannot be completed without the requested

the Building Code, entitled 'Excavations,' is amended to
add subsection 7015.4 to read:
7015.4 BALANCED CUT AND FILL RATIO.
1. No export or import of soil shall be permitted
from or.to any lot in the City.
2. No grading plan for which a permit is required
shall be approved unless the amount of soil to be cut
from the site equals the amount of soil to be filled
on the site.
3. The City Manager may grant an exception to the
requirements of parts 1 and 2 of this paragraph (d) to
allow for the import or export of soil not to exceed
500 cubic yards if he or she finds, based upon written
reports and other information submitted, that all of
the following conditions are present: (a) construc-
tion of a structure on the lot or parcel has com-
menced, (b) that the need to import or export the soil
could not have been foreseen prior to commencement of
construction, and (c) that either the structure cannot
be completed without the requested import or export of
soil or that an emergency condition exists due to the

Maverick Lane.
At this time I am requesting that we be allowed to export the allowable maximum of 500 cubic
yards of earth from the Blazevich property.
In as much as we have already moved 260 cubic yards to complete the Hilliard job, this would
leave 240 cubic yards that we would be allowed to export.
There has been an urgent request from the Caballeros to obtain dirt to finish the Hix ring.
I am estimating 110 cubic yards would complete that task. The remainder, 130 cubic yards, be
used to finish the Howroyd project as requested in the AGI letter, which is enclosed.

24, 1995, Traffic Commissioners considered the staff report relative to the driveway
access to 5 Sagebrush Lane. Following deliberation, Commissioners made the
following recommendations:
• That the foliage on the north side of Sagebrush Lane, as it meets Upper
Blackwater Canyon Road, be trimmed for a distance of 10 feet inward from the
roadway to a distance of 7 feet from the ground to accommodate sight distance.
• That the volunteer tree, approximately 40 feet south of the driveway entrance as
it meets Upper Blackwater Canyon Road, be removed.
Since these trees are not on your property, you will need to approach your neighbors
to address this situation.
These recommendations will be presented to the City Council at their regular
meeting to be held on Monday, April 10, 1995 beginning at 7:30 p.m. in the Rolling

the establishment of your driveway access from Sagebrush Lane (private drive) to Upper

roadway and purview of the Traffic Commission was limited to that roadway's opening

-Scope-
The purpose of this report is to summarize my findings regarding the re -grading of Lot 3,
Tract 30345. This lot is known variously as #3 Sagebrush Ln; #4 Sagebrush Ln; #5
Sagebrush Ln and finally, as #4 Canyon Mesa.
My letter of August 3, 1994 itemized on -site grading conditions during July, 1994. As
discussed in the letter, the old adobe soil was benched for support of engineered soils
above the old key area on the north side of the old fill. At this time the shallower portion
of the old fill appeared loose for compacted fill, with unusually deep benching. Exposed
bedrock was neutral relative to stability; the northern portion exposed an anticlinal
configuration which could also be described as supportive.
My letter of January 16, 1995 indicated that my observations showed no landsliding
existed on the nearby exposed bedrock shales. The report by K. Ehlert is compatible with
my findings. The only question I had at this time was pertinent to the use of Qols (old
landslide debris) underlying the old compacted fill and the mostly re -compacted fill. The

County required 309 statement, page 6 of Ehlert's report, was accepted without a stability
analysis by A. G. I. Geotechnical, their report dated 12-14-94, by Jaun A. vidal.
309 Statement
The County Geologic and Soils Review Sheets (1-13 and 1-17, 1995) would appear to
indicate the 309 statement made by Ehlert was acceptable despite that Qols mapped as
underlying the old and now compacted fill. The Qols would normally automatically
require a stability analysis showing a safety factor (S.F.)of at least.=1.5 for new
construction without a waiver being recorded. None was submitted and yet the County
approved the site for construction. I do not know why; I am not privy to their reasoning.
It my be that the original reports by 1) Lockwood; 2) Converse Wood Davis Dixon; and
Lockwood Singh and Associated met the necessary Section 309 statement required by the
County, and Ehlert's inclusion of a 309 statement was unnecessary.
Sewage Disnosal
To date, the location of the proposed seepage pit for effluent disposal has not been
specified or plotted on the As -graded Geologic Map by K. Ehlert. This may be beyond his
area of reponsibility. This should be done eventually, even though the County did not feel
it was necessary at this time. There could be a tacky problem here, in view of the fact that
Qols is shown to underly the old and newly compacted fills. No one wants to introduce
sewage effluent into old slide debris. Sewage disposal should be made into bedrock shales
with subdrainage away from the fill and any old in -place slide debris. This appears to be a
geologic procedural conundrum for which I have no solution. Perhaps the approved
lcoation is already on record and was specified by Converse, etal or Lockwood -Singh
Associates.
Summary
From the content of the As -graded Geologic Report by K. Ehlert and the Interim Soils
Compaction Report by A. G. I., Inc., it appears the only responsibility Ehlert and A. G. I.
had was to take out and replace the old fiill and determine the existence or non-existence
of landslide planes in the underlying bedrock. To this end, they have complied to the
satisfaction of the County.

The observations made by Keith Ehlert in the above report reference, whiich is dated
December 12, 1994 are compatible with my own observations of the site grading e.g., that
1) there is no apparent landslide feature in the bedrock supporting the new fill or for that
matter the old fill and 2) the old fill appears to be very firm indeed with no indication of
subsequent failure since it was placed.
From the text of the report, it would appear that no one has found evidence of old
(Quaternary) landslide, annotated on the sections and maps as Qols, including Bruce
Lockwood who was the initial investigating geologist. I find that the use of Qols is
incompatible with findings of all observers, including myself. The apparent departures of
bedding from consistency of a northward dip can be easily explained by minor tectonic
folding; in fact, the north end of the excavation for the new fill revealed a small anticlinal /
synclinal relationship with no slip planes to that depth. Lockwood states he observed
none at deeper depths in 1989.
Stability Relationships and Conformance With Code 309
If indeed the consultants feel that, despite their observations to the contrary, that the site is
underlain by old landslide debris, I find it difficult to accept their 309 statement without a
stability analysis based on at least a hypothetical slide plane beneath the older fill, which,
as yet, has not been explored. Their option is to eliminate the use of the term Qols and
• •
stand by their observations and convictions, or, submit a stability analysis showing a safety
factor of 1.5 or greater.
Alternatively, the County may accept the report provided they are convinced the old slide
debris shown on the map and geologic cross section has a calculated safety factor of at
least 1.25. This would require a recorded slide waiver.
County Review
I suggest the City waits for the County review on this matter before discussing the
question of a reqired stability analysis with them.

that the City hire an outside geologist to review and oversee the certified geologist employed

of this is to ensure, from the City's perspective, that removal and refill at the site is
accomplished in a manner that would pose no hazards on site or to adjoining properties.
It was further stipulated that Del Amo Savings Bank would be responsible for paying the
costs associated with this City employed geologist. You attended the City Council meeting
and agreed with this requirement.
