Dear Mr. Bennett: •
As you know, Southern California Edison ("SCE") is in the process of replacing deteriorated
utility poles within our service territory. As part of our deteriorated pole replacement program, SCE
has identified the captioned pole on your property as being in urgent need of replacement. SCE's
decision to replace a pole involves the consideration of several factors including the age of the pole,
insect damage, and pole loading. We understand you have expressed concern regarding the nature
of SCE's real property rights and have denied SCE crews access to your property until SCE
provided you with an explanation of SCE's real property rights.
Pursuant to your request, SCE has researched our files on the subject pole. The pole on your
property (SCE pole number 545767E) was installed in 1938. Pursuant to California law, where a
utility structure is placed on property and remains in position for 5 or more years, an easement right
is created by law. See Section 806, California Civil Code. hi the instant case, the pole was installed
approximately 75 years ago and is readily viewable. As such, SCE maintains rights to the pole. The
rights to the pole include the rights to make replacements and upgrades commensurate with the
deterioration of our equipment, increased need for electricity due to population growth, and changes
in technology. See e.g., Hill v. Allan, 259 Cal. App. 2d 470 (Cal. 1968); Applegate v. Ota, 146 Cal.
App. 3d 702 (Cal. App. 2d 1983).
I trust that the foregoing addresses your concerns with SCE's real property rights.
Accordingly, SCE crews will be onsite within the next several weeks to complete our work. We
appreciate your cooperation in this matter. To the extent you have any further questions or concerns,

Commission relative to your revised driveway apron.

At the regular meeting of the Rolling Hills Traffic Commission held Thursday, May
25, 1995, Commissioners recommended approval of your revised driveway apron.
This recommendation will be presented to the City Council for formal consideration
at their regular meeting to be held on Monday, June 12, 1995 beginning at 7:30 p.m.,
in the Rolling Hills City Council Chambers.
The Traffic Commission recommendation will include a requirement that the site
visibility for vehicles exiting the driveway shall not be impaired for a distance of 10
feet inward from the street.
