Dear David,
In September (see attached) I verbally agreed to allow your agent onto my land for testing a
possibility of your purchase of a portion of our adjacent lands. I had assumed work was completed as
land since September has not appeared to be disturbed.
Well, apparently work was not done in September but on Wednesday of last week. Testing has
left mounds of soil and removed large areas of decorative ground cover.
Bottom line is I don't like way it looks, I don't think City of Rolling Hills would like how it was left
and I would like areas returned to "same" by February 1, 2000.
If restoration is not performed by 2/1/00 I will seek estimates using three local landscape
companies. I expect you will reimburse me for middle estimate based on your note.
This letter places you and your agents on notice. No more trespass upon my land by you or
your agents without my express permission. And under no circumstance should any work be
performed on my land without my physical presence or appointed representative.
And lastly not a single stipulation has been agreed upon for sale or transfer of my land adjacent

As you know, at the November 8, 1999 City Council meeting, members of the Rolling
Hills City Council considered your request to conduct soils and geology investigation
work on City owned property located in the vicinity of 86 Saddleback Road. Members
of the City Council have directed that City staff work with the City Attorney to prepare
an appropriate agreement to permit this activity. We will forward a copy of the
agreement to you when it is prepared.
However, the City Council was very specific in that any permission for this work does
not obligate or imply that the City is willing to exchange or sell the subject property.
We look forward to seeing you at the November 22, 1999 City Council meeting when
the agreement will be considered. Should you wish to discuss this further, please do
not hesitate to call. Thank you for your cooperation

On behalf of the owner of #86 Saddleback Road, we request the City allows us to
perform a soils and geology investigation on the portion of the City property located
adjacent to this property as shown on the attached sketch.
The soils and geology investigation will be performed under the direction of Tony Lee,
a professional engineer. The investigation will require excavating one or two trenches
down to bedrock about 4 to 6 feet deep.
The driveway for this property is being studied to allow realignment to reduce the
existing driveway steepness. The realignment that is being considered includes
placing a portion of the driveway on the adjacent City lot, Hesse's Gap Lot. To assure
that this is a reasonable alternative, we need a soils and geology investigation of this
area.
Enclosed is an 8 1/2" by 11" sheet that shows the lot line adjustment that is being
considered with the City. The lot line adjustment is an exchange of 5230 square feet
for 5230 square feet.
Also enclosed is a 1" = 20' drawing that shows the realigned driveway and lot line
adjustments with the two adjacent neighbors. We are negotiating with these neighbors
to obtain their permission for this driveway realignment.
If you have any questions or need additional information, please call.
